Agreement 2/17/1953 (2) AGREEMENT THIS AGREEMENT made and entered into this / Je- day of J'~~LV~ ' A. D. 1953, by and between SAM SOLLOWAY and MONA SOLLOWAY, his wife, parties of the first part, herein- after referred to as the OWN~RS and the CITY OF MIAMI BEACH, a Florida Municipal Corporation, party of the second part, herein- after referred to as the CITY. WIT N E SSE T H : That for and in consideration of the mutual covenants hereinafter set forth, the parties agree as follows: 1. The Owners will sell and convey and the City will purchase that certain parcel of land situate, lying and being in the City of Miami Beach, County of Dade, State of Florida, described as follows, to-wit: Southerly Twenty-five feet (25') of Lots Thirty-Eight (38) and Thirty-Nine (39) of Block Ten (10) of OCEAN SIDE SECTION, ISLE OF NORMANDY, according to the plat thereof recorded in Plat Book 25, page 60 of the Public Records of Dade County, Florida. 2. The Owners will, within twenty (20) days from the date hereof, furnish to the City, an abstract of title showing the Owners' title to be good and marketable. 3. The Owners will convey the said land to the City by good and suffioient warranty deed, free and clear of all en- cumnrances except restrictions of record, zoning ordinances of the City of Miami Beach, Florida, such municipal improvement liens as may be pending but not oertified at the time of the closing of the transaction contemplated hereby and taxes for the year 1953. 4. The warranty deed is to provide that title shall im- mediately be re-vested in the Owners, their heirs, successors, WEINSTEIN.WEINSTEIN & WEINSTEIN. ATTORNEYS AT LAW, 420 LINCOLN ROAD, MIAMI BEACH, FLORIDA or assigns if the City shall cease to use said land for the off-street parking of automobiles, and shall abandon the said land for such use. 5. The City agrees to pay to the Owners as the full purchase price of said land the sum of One Thousand, Dollars ttOOO) cash at the time of closing the transaction contemplated hereby. 6. The City agrees that no municipal improvement liens will be claimed or assessed for any portion of the cost of con- structing a sidewalk and pavement upon the lands to be acquired or the lighting thereof. 7. The transaction contemplated hereby shall be closed not earlier than March 31, 1953, and not later than April 6, 1953. 8. This agreement shall be binding upon each of the parties hereto, their heirs, successors and assigns.
