AGREEMENT
THIS AGREEMENT made and entered into thi$lSth day or
Februarv
, A. D. 1953, by and between PHOENIX INVESTMENT
CO., a Florida Corporation, party of the first part, herein-
arter rererred to as the OWNER and the CITY OF MIAMI BEACH, a
Florida Municipal Corporation, party of the second part, herein-
after rererred to as the CITY.
WIT N E SSE T H :
That for and in consideration or the mutual covenants
hereinafter set forth, the parties agree as follows:
1. The Owner will sell and convey and the City will
purchase that certain parcel of land situate, lying and being in
the City of Miami Beach, County of Dade, State of Florida, des-
cribed as rollows, to-wit:
Northerly Twenty-Five Feet (25') of Lots Firty-
Nine (59) and Sixty (60) or Block Ten (10) or
OCEAN SIDE SECTION, ISLE OF NORMANDY, according
to the plat thereof recorded in Plat Book 25,
page 60 of the Public Records of Dade County,
Florida.
2. The Owner will, within twenty (20) days from the
date hereof, furnish to the City, an ~bstract of title showing
the Owner's title to be good and marketable.
3. The Owner will convey the said land to the City by
good and sufficient warranty deed, free and clear of all encum-
brances except restrictions of record, zoning ordinances of the
City of Miami Beach, Florida, such municipal improvement liens as
may be pending but not certified at the time of the closing of
the transaction contemplated hereby and taxes for the year 1953.
4. The warranty deed is to provide that title .hall
immediately be re-vested in the Owner, its heirs, successors,
or assigns if the City shall cease to use said land for the

~or suoh use.
5. The City agrees to pay to the Owner as the ~ull pur-
ohase prioe o~ said land the sum o~ Seven Hundred Dollars ($700)
oash at the time o~ olosing the transaotion oontemplated hereby.
6. The City agrees that no municipal improvement liens
will be olaimed or assessed ~or any portion o~ the oost o~ oon-
struoting a sidewalk and pavement upon the lands to be aoquired
or the lighting thereo~.
7. The transaotion oontemplated hereby shall be olosed
not earlier than Maroh 31, 1953 and not later than April 6, 1953.
8. This agreement shall be binding upon eaoh of the
parties hereto, their heirs, suooessors and assigns.
IN WITNESS WHEREOF, the party o~ the ~irst part has
oaused these presents to be exeouted in its name by its duly
authorized o~~icers and has oaused its oorporate seal to be
a~~ixed and the party o~ the second part has oaused these pre-
sents to be exeouted in its name by its duly authorized offioers
