Opinion of Title 14 OPINION QE TITLE Property: THE CITY OF MIAMI BEACH The Northerly 25 feet of Lot 73 and the Northerly 25 feet of Lot 74 in Block 10 of OCEAN SIDE SECTION, ISLE OF NORMANDY, according to the Plat thereof, recorded in Plat Book 25, Page 60 of the Public Records of Dade County, Florida. FOR: I HAVE EXAMINED the abstract of title covering the above captioned property, which abstract contains the folloWing entries: Entries 1 to 52 inclusive, prepared by Southern Title Company, bearing Certificate No. 29740, covering that period of time extending from the Beginning to November 12, 1936 at 8:00 A. M. Entries 1 to 15 inclusive, prepared by Miami Title & Abstract Co., bearing Certificate No. 297611 coveri~ that period of time extending from November 12, 936 at 8:00 A. M. to May 3, 1945 at 8:00 A. M. Entries 1 to 7 inclusive, prepared by Miami Beach Abstract and Title Company, bearing Certificate No. 12892, covering that period of time extending from May 3, 1945 at 8:00 A. M. to December 28, 1945 at 8:00 A. M. Entries 1 to 7 inclusive, prepared by Dade-Commonwealth Title Insurance Company, bearing Certificate No. 189,301, cover- ing that period of time extending from December 28, 1945 at 8:00 A. M. to December 18, 1950 at 8:00 A. M. Entries 1 to 5 inclusive, prepared by Miami Beach Abstract and Title Company, bearing Certificate No. 20472, covering that period of time extending from December 18, 1950 at 8:00 A. M. to March 17, 1953 at 8:00 A. M. AND FROM SUCH EXAMINATION, I find that on the 17th day of March, 1953, at 8:00 A. M., the fee simple title to the aforesaid property was vested in: THOMAS DeTARDO and EVELYN I. DeTARDO, husband and wife, as an estate by the entireties, by virtue of that certain warranty deed dated December 22, 1950, made by Louis G. Lytton and Florence B. Lytton, his wife, and Jacob Mazer and Fannie Mazer his wife, and recorded on December 29t 1950 in Deed Book 3381 at Page 250 of the Public Records of Datte County, Florida. SUBJECT, HOWEVER, to the following liens, defects, impairments, and requirements: 1. Mortgage given by Thomas DeTardo, joined by his wife Evelyn I. DeTardo, to Louis G. Lytton and Fannie Mazer, dated December 27, 1950, and recorded on December 29, 1950, in Mortgage Book 2426 at Page 94 of the Public Records of Dade Count~, Florida, and securing an indebtedness in the sum of $9,125. Reservation by the Trustees of the Internal Improvement Fund of the State of Florida, of an undivided three-fourths (3/4) interest in all phosphate, mineral, and metals that may be in or under the above-described lands and an un-divided one-half (1/2) interest in all petroleum in or under the said above-described lands, recorded in that certain quitclaim deed dated May 8, 1930, given by the Trustees of the Internal Improvement Fund of the State of Florida, to Normandy Beach Properties Corporation, a MaS s. corporation, and filed for record May lL~, 1930, in Deed Book 1381 at page 525 of the Public Records of Dade County, Florida. 3. The property is subject to City, State and County taxes for the year 1953, although they are not yet due and payable. 4. Municipal zoning ordinances of the City of Miami Beach, Dade County, Florida. 5. Labor performed, or material furnishei, if any has been performed or furnished, to or in connection with the said property during the past ninety (90) days, shall, even though not now of record, constitute a lien against the property. 6. Rights of parties in possession, if any. 7. Any state of facts which an accurate survey may disclose.
