Agreement 2/17/1953 (6) AGREEMENT .. THIS AGREEMENT made and entered into this /7- day of palfd/11f ' A. D. 1953, by and between GEORGE FRANKLIN and "'V>t- ~ EL~~E FRANKLIN, his wife, parties of the first part, herein- after referred to as the OWNERS and the CITY OF MIAMI BEACH, a Florida Municipal Corporation, party of the second part, herein- after referred to as the CITY. WIT N E SSE T H : That for and in consideration of the mutual covenants hereinafter set forth, the parties agree as follows: 1. The Owners will sell and convey and the City will purchase that certain parcel of land situate, lying and being in the City of Miami Beach, County of Dade, State of Florida, des- cribed as follows, to-wit: Northerly Twenty-Five Feet (25') of Lot Seventy- Five (75) of Block Ten (10) of OCEAN SIDE SECTION, ISLE OF NORMANDY~ according to the Plat thereof recorded in ~lat Book 25, page 60 of the Public Records of Dade County, Florida. 2. The Owners will, within twenty (20) days from the date hereof, furnish to the City, an abstract of title showing the Owners' title to be good and marketable. 3. The Owners will convey the said land to the City by good and sufficient warranty deed, free and clear of all en cum- brances except restrictions of record, zoning ordinances of the City of Miami Beach, Florida. such municipal improvement liens as may be pending but not certified at the time of the closing of the transaction contemplated hereby and taxes for the year 1953. 4. The warranty deed is to provide that title shall immediately be re-vested in the Owners. their heirs. successors, WEINSTEIN, WEINSTEIN & WEINSTEIN, ATTORNEYS AT LAW, 420 LINCOLN ROAD. MIAMI BEACH, FLORIDA or assigns if the City shall cease to use said land for the off-street parking of automobiles, and shall abandon the said land for such use. 5. The City agrees to PIV to the Owners as the full purchase price of said land the sum of Three Hundred Fifty Dollars ($350) cash at the tiIIB of closing the transaction con- templated hereby. 6. The City agrees that no municipal improvement liens will be claimed or assessed for any portion of the cost of con- structing a sidewalk and pavement upon the lands to be acquired or the lighting thereof. 7. The transaction contemplated hereby shall be closed not earlier than March 31, 1953, and not later than April 6, 1953. 8. This agreement shall be binding upon each of the parties hereto, their heirs, successors and assigns.
