AGREEMENT
THIS AGREEMENT, Made and entered into this /".;z;-

, A.D. 1955 by and between HELEN COSTELLO,
a widow, party of the first part, hereinafter referred to as the
OWNER and the CITY OF MIAMI BEACH, a Florida Municipal Corpora-
tion, party of the second part, hereinafter referred to as the
CITY,

That for and in consideration of the mutual covenants
hereinafter set forth, the parties agree as follows:
1. The Owner will sell and convey and the City will
purchase that certain parcel of land situate, lying and being
in the City of Miami Beach, County of Dade, State of Florida,
described as follows, to-wit:
The northerly twenty-five (25')
feet of Lot Seventy-six (76),
Block Ten (10) of OCEAN SIDE
SECTION, ISLE OF NORMANDY, ac-
cording to the plat thereof
recorded in Plat Book 25, page
bO of the Public Records of
Dade County, Florida.
2. The Owner will, within twenty (20) days from the
date hereof, furnish to the City, an abstract of title showing
the Owner's title to be good and marketable,
3. The Owner will convey the said land to the City
by good and sufficient warranty deed, free and clear of all
encumbrances except restrictions of record, zoning ordinances
of the City of Miami Beach, Florida, such municipal improve-
ment liens as may be pending but not certified at the time of
the closing of the transaction contemplated hereby and taxes
for the year 1955.

4. The warranty deed is to provide that title shall
immediately be re-vested in the Owner, her heirs, successors
or assigns if the City shall cease to use said land for the
off-street parking of automobiles, and shall abandon the said
land for such use.
5. The City agrees to pay to the Owner as the full
purchase price of said land the sum of Six Thousand ($6,000.00)
Dollars cash at the time of closing the transaction contemplated
hereby,
6. The City agrees that no municipal improvement
liens will be claimed or assessed for any portion of the cost
of constructing a sidewalk and pavement upon the lands to be
acquired or the lighting thereof.
7. The transaction contemplated hereby shall be

8. It is further agreed by and between the parties
that the City may, after delivery of the deed herein called
for, demolish and remove that portion of the existing build-
ing on Lot 76, Block 10, Ocean Side Section, Isle of Normandy,
Plat Book 25, page 60, which extends over and upon that portion
of Lot 70 hereby agreed to be conveyed, provided, however, that
the City, as an incident to such demolition, shall make, or
cause to be made, at the cost and expense of the City, certain
structural alterations and changes in the remaining portion of
said building, as more particularly shown by a certain blue-
print, examined, approved, agreed to, and signed by the Owner,
a copy of which is attached hereto and made a part of this
agreement, as Exhibit "A", as fUlly as though set forth herein.
It is further agreed that the work shall be
completed within a reasonable time after its commencement and
shall be done in a good and workmanlike manner, and that the
material and fixtures used shall be of standard quality appro-
priate to the existing building and that in the event of any

dispute between the parties as to the quality of workmanship,
materials and fixtures used or to be used, such dispute shall
be referred to and finally determined by three arbitrators,
one of whom shall be the City Building Inspector, one to be
designated by the Owner, and the third to be appointed by the
two arbitrators herein designated.
9. This agreement shall be binding upon each of
the parties hereto, their heirs, successors and assigns.
IN WITNESS WHEREOF, the party of the first part has
hereunto set her hand and seal and the party of the second part
has caused these presents to be executed in its name by its
duly authorized officers and has caused its corporate seal
to be affixed, all as of the day and year first above written.

I HEREBY CERTIFY that on this day personally
appeared before me, an officer duly authorized to administer
oaths and take acknowledgments, HELEN COSTELLO, a widow, to
me well known to be the person described in and who executed
the foregoing agreement, and she acknowledged before me that
she executed the same for the purposes therein expressed.
