D. 1951, by and between JOE CASSELLA and CALLYNE CASSELLA, his wife, Part ies of the ii'irst Part, hereinaft er re- ferred to as the "Sellers" and CITY 0:1<" MIAMI BEACH, a Municipal Corporation of Florida, Party of the Second Part, hereinafter referred to as the "PurChaser", WIT N E SSE T H : For and in consideration of the sum of One (~I.OO) Dollar, heretofore paid to the Sellers by the Purchaser, receipt of which- is hereby acknowledged, and in consideration of the covenants ~ . hereinafter Bet forth, the parties hereto agree as follows: 1. The Sellers will sell and convey and the Purchaser will purchase that certain parcel of land situate, lying and being in . Kiami Beach, Dade County, Florida, described as follows, to-wit: That portion of Lot Nine (9) of Block Sixteen (16) of :;rORJ,TANDY BEACH SaUTE as shown on the flat thereof, recorded in Plat book 21, at page 54, of the Public Records of Dade County, "'lorida, bounded as follows: Bounded on the nortl, by the northerly Hne of said Lot ;'line (9); bounded on the south by the southerly line of said Lot '~ine (9); bounded on the east by the westerly line of Indian Creek Drive; and bounded on the west by a line parallel to the said westerly line of Indian Creek Drive and Ten (10) feet westerly there- from, said Ten (10) feet being measured at right angles to the said westerly line of Indian Creek Drive; 2. The Sellers will, within twenty (20) days from the date hereof, furnish to the Purchaser an abstract of title showing sellers' title to be good and marketable. 3. The Sellers will convey the said land to the Purchaser by good and sufficient warranty deed, free and clear of all en- cumbrances except restrictions and l'mitations of record, co~mon to the neighborhood; zonine; ordinances of the City of Miami Beach, Florida; pending municipal improvement liens; taxes for the year 19,51 which are to be :;:J!'o-rated as of the date of closing the transaction contemplated by this agreement. -1- OFFICE OF CITY ATTORNEY - CITY HALL - MIAMI BEACH 39, FLORIDA 4. 'rhe Purchaser agrees to pay to the Sellers as the full purchase price for said land, the sum of Four Thousand Two Hundred Fifty & nollOO ($4,250.00) Dollars cash at the time of closing the transaction contemplated hereby. 5. The transaction contemplated hereby shall be closed within Forty-five (45) days from the date of this agreement. 6. Thls agreement shall be binding upon both partles, the Sellers and the Purchaser, their heirs, successors and assigns. IN WITNESS W,~EREOF, the Sellers have hereunto set their hands and seals, and the Purchaser has caused these presents to be signed in lts name, by its duly authorized officers, and its corporate seal to be affixed, attested by the City Clerk of Miami Beach, Florida, as of the day and year first above written.
