OPINION on Abstract of Title prepared by Dade County
Abstract, Title Insurance and Trust Company, under Certificate No.
78095, comprising entries numbered 1 to 44 inclusive, covering that
period of time extending from the Beginning to March 2nd, 1928 at
8:00 A. H.; and continuation thereof', prepared by Miami Beach Abstract
and Title Company, under Certificate No. 9120, comprising entries
numbered 1 to 13 inclusive, covering that period of time extending
from March 2nd, 1928 at 8:00 A. Ii. to and including Hay 3rd, 1941 at
8:00 A. )'.'.; and continuation thereof, prepared by the same company
under Certificate No. 9141, comprising entries nur1bered 1 to 4 in-
clusive, covering that period of time ecdending from hlay 3rd, 1941
at 8:00 A. H. to and including May 14th, 1941 at 8:00 A. r:l.; and
continuation thereof, prepared by the same company, under Certificate
No. 11582 covering that period of' time extending f'rom May 14th,

sive, covering that period of' time extending f'rom April 26th, 1948
at 8:00 A. M. to November 11th, 1949 at 8:00 A. M.; and continuation
thereof, prepared by the same company, under Certif'icate No. 244571,
comprising entries numbered 1 to 7 inclusive, covering that period
of time extending from November 11th, 1949 at 8:00 A. IiI. to December
24th, 1949 at 8:00 A. ~.; and continuation thereof, prepared by
Miami Beach Abstract and Title Company, comprising entries n~bered
1 and 2, covering that period of time extending from December 24th,
1949 at 8:00 A. M. to and including January 11th, 1951 at 8:00 A. M.;
purporting to delineate the title to that certain parcel of land
situate, lying and being in Dade County, Florida, to wit:
Lot Eight (8) in Block Sixteen (16)
of NORMANDY BEACH SOUTH, according
to the Plat thereof, recorded in
Plat Book 21, at Page 54, of the
Public Records of Dade County, Florida.
From an exwaination of said Abstract of Title, and basing my
opinion solely upon the same, I am of the opinion that as of the 11th
day of January, 1951 at 8:00 A. M., the fee simple title in and to
the land above described, was vested in
DR. JOIDl PURL PARSONS and CLARA A.
PARSONS, his wife, tenants by the
entireties with rights of survivor-
ship

That certain mortgage dated June 15th, 1948 from
JOHN MYERS, joined by his wife, SADIE MYJ!;RS to HARRY J. GERSON and
ANNET'rE GERSON, his wife, recorded in Mortgage Book 1981, at page 236,

of the Public Records of Dade County, Florida, securing an indebted-
ness in the sum of Nine thousand ($9,000) Dollars.
2. Those certain restrictions and limitations contain-
ed in that certain Warranty Deed dated February 17th, 1928 from
REUBEN B. GRYZMISH, et al., to ROY IRWIN, recorded in Deed Book 1862,
at page 38 of the pUblic Records of Dade County, Florida.
3. Tax8s for the year 1951 which, although not yet
due or payable, are a lien against the lam.

4. Rights of part~n possession; questions of sur-
vey; zoning ordinances of the City of Miami Beach, Florida; posable
mechanics' liens for labor performed or materials furnished on or
about the premises within the past three months.

and CLARA A. PllRSONS, his wife, Parties of the First Part, herein-
after referred to as the "Sellers" and CITY OF HIAHI BEACH, a
municipal corporation of Florida, Party of the Second Part, herein-
after referred to as the "Purchaser",
WIT N E SSE T H :
For and in consideration of the sum of One ($1.00) DOllar,
heretofore paid to the Sellers by the Purchaser, receipt of which is
hereby acknowledged, and in consideration of the covenants hereinafter
set forth, the parties hereto agree as follows:
1. The Sellers will sell and convey and the Purchaser will
purchase that certain parcel of land situate, lying and being in
Miami Beach, Dade County, Florida, described as follows, to-wit:
The Easterly Ten (10) Feet of Lot Eight
(3) of Block Sixteen (16) of NOill4ANDY
BEACH SOUTH, according to the Plat thereof,
recorded in Plat Book 21, at page 54, of
the Public Records of Dade County, Florida,
the said Ten (10) feet being measured at
right angles to the westerly line of Indian
Creek Drive.
2, The Sellers will, within Twenty (20) days from the date
hereof, furnish to the Purchaser an Abstract of Title showing Sellers'
title to be good and marketable.
3. The Sellers will convey the said land to the Purchaser by
good and sufficient warranty deed, free and clear of all encumbrances
except restrictions and limitations of record common to the neighbor-
hood; zoning ordinances of the City of Miami Beach, Florida; pending
City of Miami Beach improvement liens; taxes for the year 1951 which
are to be pro-rated as of the date of closing the transaction contem-
plated by this agreement. It is understood and agreed that the cost
of street paving or sidewalk construction on the lands hereinabove
described shall not be assessed against the remaining portion of the
said Lot 8.

4. The Purchaser agrees to pay to the Sellers as the full
purchase price for said land, the sum of lcifteen Hundred & no/100
($1,500.00) Dollars cash at the time of closing the transaction
contemplated hereby.
5. The transaction contemplated hereby shall be closed
wi thin Forty-five (l1-5) days from the date of this agreement.
6. This agreement shall be binding upon both parties, the
Sellers and the Purchaser, their successors and assigns.
IN WITNESS vnI~(EOF, the Sellers have hereunto set their hands
and seals, and the Purchaser has caused these presents to be signed
in its name, by its duly authorized officers, and its corporate
seal to be affixed,
