SUBJECT: Anchors Shops - Fuddrucker's Status Report
On September 27, 2000, The Redevelopment Agency adopted a resolution authorizing the execution
of the First Amendment to the Lease Agreement with Abkey No. 17, Inc., a Florida Corporation
d/b/a! Fuddruckers (Tenant). The purpose of the Amendment was twofold; to address certain
unforeseeable conditions encountered by the Tenant which resulted in delays to the completion of
the design and buildout of the restaurant space, the scope of which includes the restoration of the
lobby of the Anchor Hotel, and to address the loss of 349 square feet or approximately 55 percent
of the usable space on the second floor of the Anchor Hotel due to certain City Code requirements.
Among the provisions of the Amendment was a "Completion Date for Subtenant's Work", which
was set for February 28, 2001.
Since the execution of the First Amendment, the Tenant's Architect has been finalizing the
permitting for the main restaurant space, comprising the Justice of the Peace and the new space.
During the first week in December, the Tenant's Contractor initiated electrical and fue sprinkler
work in the the Anchor Hotel which was permitted separately from the main restaurant. While there
is no provision in the Lease Agreement or the First Amendment thereto with regards to construction
progress, a Letter of Notice , dated November 14, 2000, was sent to Fuddruckers, expressing
concern over the lack of visible progress with the buiIdout of the space. Fuddruckers has since
responded that construction will be underway as soon as the final permit is issued by the City. It
should be noted that Fuddruckers is obliged to begin paying rent on March 1,2001, whether the
restaurant has been completed or not.
In the meantime, the Administration wilI continue to work with theTenant's design and development
team to facilitate the opening of the facility within the timeframe stipulated in the First Amendment
to the Lease Agreement.

Dear Christina:
Our construction at the Anchor Hotel portion began in November rather than October.
The remaining space in the Anchor Shops will begin construction as soon as we receive
the permit from the City, which we hope will be prior to the end of the year.
