Gonzalez ~J-~ City Manager SUBJECT: FILM PRODUCTION COMPLAINTS At the April 18,2001 City Commission Meeting, Commissioner Nancy Liebman requested an L .T .C. explaining why the administration was not able to enfome existing laws related to complaints received with respect to Film Production activities in residential areas. The Department of Code Compliance along with the Office of"Arts, Culture and Entertainment" has taken enforcement action against production activities that were violating the City Code. On February 12, 2001, both the Code Compliance Department and a representative from "Arts, Culture and Entertainment" responded to 244 San Madno to discuss the continuous photo-shoots that were occurring at the location. The photographers were issued Notices and were advised to cease and desist immediately, which they complied with. In addition, Notices were issued to the property at 324 W. San Marino Drive on December 13, 2000 for operating the location as a hotel. The case was forwarded to the Special Master and the property owner was found guilty of the violation and ordered to cease and desist immediately. Notices were also issued for altering the structure without the required permits, which a heanng is scheduled before the Special Master for May 24, 2001. On December 1, 2000, the same address was issued property maintenance violations. The case was prosecuted before the Special Master. They were adjudicated guilty and ordered to comply by April 8, 2001 or a $100.00 per day fine would begin to accrue. Currently, the daily fine continues to accrue. As you can see from the above, enforcement action was taken against the locations on San Marino Drive. When a complaint was received, the complaint was throughly investigated. If violations were discovered, Notices were issued and if compliance was not achieved in a timely manner the case was forwarded to the Special Master.
