A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH APPOINTING Victor M. Diaz, 1r. AS
REPLACEMENT CITY COMMISSIONER FOR COMMISSION GROUP III
IN ACCORDANCE WITH MIAMI BEACH CITY CHARTER SECTION
2.07.
WHEREAS, by letter dated June 6: 2008: Miami Beach City Commissioner Richard
Steinberg announced his intention to run for the Florida House of Representatives District 106,
thereby resigning from his elected position in City Commission Group III, effective November 4,
2008; and
WHEREAS: pursuant to Miami Beach City Charter section 2.07, the remaining members
of the City Commission may appoint by majority vote an individual to fill the vacancy in City
Commission Group III during the 30 days following the vacancy (November 5, 2008 through
December 4, 2008): and
WHEREAS, City Charter section 2.07 further states that if an appointment is not made
by the City Commission, a Special Election shall be called to fill the vacancy on the City
Commission; and
WHEREAS, in order to fill the vacancy as soon as possible and avoid the burdensome
and extraordinary expense associated with a Special Election, the Mayor and City Commission
desire to fill the vacancy by appointment, and as such hereby consent by majority vote that
victor rt. Dlaz, Jr. fill the vacant City Commission Group III seat for the remainder of said
term, expiring in November, 2009.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that victor >t. Diaz, Jr. be
appointed to fill the vacant City Commission Group III seat for the remainder of said term,
expiring in November, 2009.
PASSED and ADOPTED this 4th day of December 2008.
