96-22104 RESO RESOLUTION NUMBER 96-22104 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROPRIATING $45,250 FROM REALLOCATED BOND FUND 351 INTO EXISTING WORK ORDER NUMBER 2066 TO PROVIDE FUNDING FOR THE REQUIRED ENVIRONMENTAL SERVICES RELATED TO THE TRANSITION OF COURSE OPERATORS AT THE CITY'S BA YSHORE AND NORMANDY SHORES GOLF COURSES. WHEREAS, the City's golf course management agreement with American Golf Corporation expires on September 30, 1996; and WHEREAS, it has been determined that hazardous waste contamination exists at the Bayshore Golf Course maintenance facility; and WHEREAS, the likelihood exists that the Normandy Shores Golf Course maintenance facility is also contaminated with hazardous wastes; and WHEREAS, the City must protect itself against potential liabilities related to exposure or additional contamination as well as assess the extent of the contamination on the golf courses; and WHEREAS, in order to obtain this information, the City must implement environmental testing and risk evaluations at the Bayshore and Normandy Shore golf course facilities; and WHEREAS, funding in the amount of $45,250 is available in Reallocation Bond Fund 351 and the funds will be expended through amendments to existing Professional Service Agreements. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the appropriation of $45,250 from Reallocated Bond Fund 351 into existing Work Order Number 2066 to provide funding for the required environmental services related to the transition of course operators at the City's Bayshore and Normandy Shores golf courses is approved. ADMINISTRATION RECOMMENDATION Approve the resolution. BACKGROUND The City's golf course management agreement with the American Golf Corporation expires September 30, 199q, and the Chuck Hart Management Group is scheduled to take over as the City's interim course operator on October 1, 1996. Because the Bayshore golf course maintenance facility is extensively contaminated with hazardous wastes, the City must fully disclose the information regarding the condition of the site to the Chuck Hart Management Group. The City will also be required to indemnify the Chuck Hart Management Group against the pre-existing condition of the facility. Because of the condition of the facility, the City must also take steps to minimize potential future liabilities related to employee exposure to hazardous wastes or any additional contamination that the Chuck Hart Management Group may cause. However, the City lacks sufficient information to properly prepare an indemnification agreement or limit future liabilities. Therefore, the City needs to immediately implement the additional environmental testing and risk evaluations needed to provide the required information. Because the likelihood exists that the Normandy Shores Golf Course maintenance facility is also contaminated with hazardous wastes, that facility must also be subjected to environmental testing and risk evaluations.
