2008-26948 ResoRESOLUTION NO. 2008-26948 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING THE SALE OF ONE (1) USED 1981 DARLEY PUMPER TRUCK AND ONE (1) USED 1987 SPARTAN LADDER TRUCK, IN THEIR "AS IS" CONDITION, TO THE CUERPO GENERAL DE BOMBEROS VOLUNTARIOS DEL PERU (VOLUNTEER FIREFIGHTERS OF PERU), IN THE AMOUNT OF $10,000. WHEREAS, a request was made on behalf of the Cuerpo General De Bomberos Voluntarios Del Peru (Volunteer Firefighters of Peru), to purchase one (1) used 1981 Darley Pumper Truck, and one (1) used 1987 Spartan Ladder Truck, in the amount of $10,000; and WHEREAS, the Cuerpo General De Bomberos Voluntarios Del Peru services the emergency needs of Sister City Ica, Peru; and WHEREAS, the two units will be used in public service in Ica, Peru; and WHEREAS, the City has declared these vehicles surplus, with an estimated total value of $10,000; and WHEREAS, the aforementioned vehicles are being sold in their "as is" condition, and the City makes no representation and/or warranties as to the condition of the vehicles, whether expressed or implied, and assumes no further responsibility for said vehicles. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby approve the sale of one (1) used 1981 Darley Pumper Truck, and one (1) used 1987 Spartan to the Cuerpo De Bomberos Voluntarious Del Peru, in the amount of $10,000; said vehicles are being sold in their "as is" condition, with no warranties and/or representations, whether expressed or implied, and with the City assuming no further responsibility for same. Supporting Data (Surveys, Environmental Scan, etc.): Safety across the City was rated by residents as one of the most important areas affecting their quality of life and as one of the changes that would make Miami Beach a better place to live. Item Summary/Kecommendation: Miami Beach citizen Tomas Datorre has made a request to purchase one (1) used 1981 barley Pumper Fire truck and one (1) used 1987 Spartan Ladder truck, in their as is condition, on behalf of the Cuerpo General De Bomberos Voluntarios Del Peru (Volunteer Firefighters of Peru) in the amount of $10,000. These two units have been declared as surplus and have been replaced. The units do not meet the National Fire Protection Association code standards and are therefore not certified for use in the U.S. Due to the age and condition of the City's surplus fire trucks, a fair value is $10,000, which would typically be realized through an auction. These units will continue to be used for public service by serving the emergency needs of our Sister City, Ica, Peru. The Administration recommends that the sale be approved. ADMINISTRATION RECOMMENDATION Adopt the Resolution. ANALYSIS A letter of request to purchase one (1)1987 Spartan Ladder Truck and one (1)1981 Darley Pumper Truck has been made by Miami Beach citizen Tomas Datorre on behalf of the Cuerpo General De Bomberos Voluntarios Del Peru (Volunteer Firefighters of Peru) in the amount of $10,000. (Please review the attached letter). This volunteer firefighting agency services emergency needs of the City of Miami Beach's Sister City, Ica, Peru. The 1987 Spartan Ladder truck and the 1981 Darley Pumper truck, were previously used in a reserve service, and reached the end of their useful life to the City. Both units have been replaced and are now declared as surplus. The 1987 Spartan Ladder Truck was approved for replacement per January 11, 2006 Commission Memorandum R2B. The 1981 Darley Pumper truck was approved for replacement per April 16, 2008 Commission Memorandum R2A. Currently, these surplus vehicles do not meet the standards of the National Fire Protection Association code NFPA 1911, which governs the inspection, maintenance, testing and retirement of in-service apparatus and therefore cannot be certified for continued use in the U.S. without substantial rehabilitation. Comparable used fire trucks are NFPA certified, refurbished and command a higher asking price. Due to the age and condition of the City's surplus fire trucks, a fair value is $10,000, which would typically be realized through an auction process. As the use of these Fire trucks is not realistic in the U.S. for Fire services, the sale of the two units to our Sister City in Peru for the approximate auction value, will allow the units to continue to be used for public service. As Peru is not subject to the same NFPA standards as U.S. fire departments, with a modest investment our Sister City can make continued Fire service use of the two units. Commission Memorandum December 10, 2008 Page 2 of 2 Pursuant to Section 2-315(c) of the Miami Beach City Code, the City Manager or his designee shall have the authority to sell all surplus stock that has become unsuitable for public use. Additionally, the City Manager or his designee shall have the authority to donate surplus stock to another governmental entity, agency, or not-for-profit organization without placing the surplus stock for public sale if the donation serves a charitable or public purpose, the donation is in the best interest of the city, and the value does not exceed a replacement value of $25,000.00. The sale of subject surplus trucks serves a public purpose and it is in the City's best interest to sell said trucks for $10,000. CONCLUSION The Administration recommends that the Mayor and City Commission approve the sale of one (1) used 1987 Spartan Ladder Truck and one (1) used 1981 Darley Pumper Truck, in • their as is condition, to the Cuerpo General De Bomberos Det Peru (Volunteer Firefighters of Peru), in th amount of $10,000, finding the sale to be in the best interests of the City.
