2001-24523 RESO RESOLUTION No. 2001-24523 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ADOPTING THE FOURTH AMENDMENT TO THE POLICE CONFISCATION TRUST FUND FOR FISCAL YEAR 2000/01, IN THE AMOUNT OF $410,000, TO BE FUNDED FROM THE PROCEEDS OF STATE CONFISCATED FUNDS. WHEREAS, Section 932.705, F]orida Statutes, addresses the purpose and procedures to be utilized for the appropriation and expenditures of the Police Confiscation Trust Fund; and WHEREAS, the Chief of Police of the City of Miami Beach has determined that the need for appropriation and expenditures exist and the appropriation and expenditure of forfeiture funds is in compliance with Section 932.705, F]orida Statutes; and WHEREAS, such funds are available in the Police Confiscation Trust Fund. NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby adopt the Fourth Amendment to the Fiscal Year 2000/0] Police Confiscation Trust Fund Budget for the City of Miami Beach, in the amount of $410,000, as reflected in the attached Exhibit "A". This is a self-defense, rape prevention program for women. 5,000 DUE ENFORCEMENT DETAIL - The Patrol Division will be conducting a 10-week DUI Enforcement Detail. Friday and Saturday are the target days. Two DUl!DRE (Drug Recognition Expert) trained officers will be assigned to lO-hour shift on each night on overtime. 16,000 CONTRIBUTION TO "AYUDA", a non-for-profit organization for its Parents Now! Program. For the last four years this program has been helping families with children at risk, preventing child neglect and child abuse in Miami Beach. DATE: July 18, 2001 FROM: SUBJECT: ADMINISTRATION RECOMMENDATION Adopt the Resolution. ANALYSIS Florida Statute 932.705 provides for expenditures offorfeiture funds for law enforcement purposes. The Chief of Police of the City of Miami Beach has reviewed and identified the need for the appropriation and has established that the expenditures of forfeiture funds is in compliance with Section 932.705, Florida State Statutes. These forfeiture funds have been deposited in the Police Confiscation Trust Fund. The City has complied with all statutory procedures involved in the transaction ofthese funds. The Administration requests authorization to adopt the Fourth Amendment to the operating budget for the Police Confiscation Trust Fund for Fiscal Year 2000/01 and to appropriate $410,000 from State Funds to provide for the expenditures listed in Exhibit "A".
