2001-24525 RESO RESOLUTION NO. 2001-24525 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE PLACEMENT OF TEN (10) BANNERS FOR FOSTER'S 2001 NATIONAL LIFESAVING CHAMPIONSHIPS, TO BE HELD AUGUST 9, 2001 TO AUGUST 11, 2001, AS REQUESTED BY THE APPLICANT AT THE FOLLOWING LOCATIONS: MCARTHUR CAUSEWAY, BETWEEN THE COAST GUARD STATION AND ALTON ROAD; SAID BANNERS TO BE AFFIXED TO LIGHT POLES IN THE PUBLIC RIGHT-OF-WAY, MEASURING 3 FEET X 7 FEET AND HAVING COPY AND DESIGN AS SHOWN ON THE ATTACHED DRAWINGS; TO BE INSTALLED AND REMOVED IN ACCORDANCE WITH ALL OTHER APPLICABLE CITY REQUIREMENTS; THE ADMINISTRATION FURTHER RECOMMENDS THAT THESE BANNERS BE INSTALLED NO EARLIER THAN JULY 27,2001, AND REMOVED BY AUGUST 12, 2001. WHEREAS, Foster's 2001 National Lifesaving Championships (Applicant) will be held August 9, 2001 through August 11, 2001 in the City of Miami Beach; and WHEREAS, in order to publicize the event and draw attention of the media and the public at large, the Applicant has requested light pole banners. measuring 3 feet by 7 feet; and WHEREAS, the Applicant has been through the required design review permit process in order to obtain approval for said banners; and WHEREAS, said banners are to be installed no earlier than July 27, 2001, and removed by August 12, 2001; and WHEREAS, the Applicant has requested approval and authorization for the placement of a total of ten (10) banners; and WHEREAS, the Applicant has posted a performance bond to ensure the removal of the banners by August 12, 2001, and will ensure that any damage to light pOles will be repaired at its expense, and will meet all other applicable City requirements; and WHEREAS, City Code Section 82-411 (d) requires that the Mayor and City Commission approve the installation of temporary banners. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission herein approve and authorize the placement of ten (10) banners for Foster's 2001 National Lifeguard Association to be held in the City of Miami Beach, August 9, 2001 through August 11, 2001, as requested by the Applicant at the following locations: McArthur Causeway, between the Coast Guard Station and Alton Road; said banners to be affixed to light poles in the public right-of-way; measuring 3 feet by 7 feet and having a copy and design as shown on the attached drawing; and to be installed and removed in accordance with all other applicable City requirements; the Administration further requires that these banners be installed no earlier than July 27, 2001, and removed by August 12, 2001. The light pole banners for the Foster's 2001 National Lifesaving Championship are 3' in width and 7' in length double faced and are made of vinyl. The banners will be digitally printed. The banner design consists of the event logo (Foster's and oars with lifesaving ring), event name in text (National Lifeguard Championship) event location and date. ADMINISTRATION RECOMMENDATION Adopt the Resolution. ANALYSIS The City Code Section 82-411 (d) requires that the City Commission approve the installation of temporary banners which reads, in part: (1) The right to install, as well as the number, location and method of installation of banners shall be subject to the design review process and approved by the City Commission and the Public Works Department. AGENDA ITEM e 7 X DATE 7-/8-01 Commission Memorandum July 25, 2001 Foster's 2001 National Lifesaving Championships Page 2 (2) Banners shall not exceed three feet in width by seven feet in length. Banners may be double-sided. The color, design and material of all banners shall be approved under the design review process. (3) Banners announcing special events either to be held in the City or to be associated in some manner with the City, as determined by the City Commission, may be erected up to 30 days prior to the event being announced and must be removed within seven days after such event. Special event banners shall require prior approval by the City Commission. (4) A performance bond shall be required to ensure the removal of the banners in case of advanced deterioration of the banners, or if a dangerous condition presents itself, the City may at its sole discretion direct banners to be removed at any time. The purpose of the banners is to promote and welcome the participants of Foster's 2001 USLA National Lifesaving Championships, which includes a variety of races such as swimming, paddling, rowing and kayaking. This event, to be held in Lummus Park, is free and open to the public. If approval is granted, the proposed temporary banners are recommended to be installed no earlier than July 27,2001 and removed no later than August 12, 2001 by the banner company. The City Commission should approve the installation of the subject light pole banners Foster's 2001 National Lifesaving Championships, to be held in the City of Miami Beach, from August 9, 2001, to August 11, 2001.
