96-22129 RESO RESOLUTION NO. 96-22129 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AMENDING RESOLUTION NO. 92- 20518, BY ELIMINATING THE REQUIREMENT THAT AT LEAST FOUR OF THE SEVEN DIRECT COMMISSION APPOINTMENTS TO THE GOLF ADVISORY BOARD BE PERMIT HOLDERS AT ONE OF THE CITY'S MUNICIPAL GOLF COURSES. Whereas, Resolution No. 79-15941, adopted on June 6, 1979, amended Resolution No. 13599 to provide that all members of the Golf Advisory Committee, except ex-officio members, must be permit holders at one of the City's Municipal Golf Courses; and Whereas, Resolution No. 92-20518, adopted on June 3, 1992, amended Resolution No. 79- 15941 by reducing the number of permit holders from seven to at least four of the seven direct Commission appointments be permit holders; and Whereas, Resolution No.92-20518 does not specify which four elected officials are required to appoint permit holders; and Whereas, the Board and Committee Review Committee, based on their preliminary recommendation, are recommending a new Golf Advisory Committee composition which favors at- large appointments rather than direct appointments and eliminates the golf permit holder requirement. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission herein amend Resolution No. 92-20518 by eliminating the requirement that at least four of the seven direct Commission appointments to the Golf Advisory Board be permit holders at one of the City's Municipal Golf Courses. ADMINISTRATIVE RECOMMENDATION: Approve the resolution. BACKGROUND: The Mayor and each City Commissioner have one direct appointment each to the Golf Advi~ory Bol:1rd. Prior to June 1992, all seven direct appointments were required to be permit holders at one of the City's Municipal Golf Courses. The current requirement per resolution no. 92-20518 adopted on June 3, 1992 reduced the number of permit holders from seven to at least four. This creates a conflict because the resolution does not specify which four elected officials are required to appoint a permit holder. Additionally, the Board and Committee Review Committee, based on its preliminary recommendation, favors a new committee composition which eliminates the golf permit holder requirement. CONCLUSION: Because resolution no. 92-20518 does not clearly specify which four elected officials are required to appoint golf permit holder, and based on the Board and Committee Review Committee's preliminary recommendation, the Administration recommends eliminating the golf permit holder requirement.
