RESOLUTION NO. 2001-24541
A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, ESTABLISHING AN
APPLICATION PROCESSING FEE FOR STREET PERFORMERS
AND ART VENDORS IN PUBLIC AREAS PURSUANT TO THE
STREET PERFORMER AND ART VENDOR ORDINANCE.
WHEREAS, the Street Performer and Art Vendor Ordinance of the City of Miami Beach
City Code allows the Miami Beach City Commission to establish an application processing fee for
Street Performers and Art Vendors in Public Places by adoption of a Resolution; and
WHEREAS, the permit process for Street Performers and Art Vendors in Public Areas
requires the filing and processing of a permit application, the review of appropriate art products
offered for sale by a potential permittee, the potential review of the artist's studio to ascertain the
originality of a piece of art and a lottery system to fairly and appropriately allocate permits among
interested Street Performers and Art Vendors; and
WHEREAS, it is in the best interest of the City of Miami Beach to recoup costs associated
with the processing of the Street Performers and Art Vendors permit applications.
NOW, THEREFORE BE IT DULY RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the application processing
fee for Street Performers is hereby established at $15.00 per each permit and the Art Vendors
application processing fee is hereby established at $50.00 per each permit to be paid and collected
as per the provisions of the Street Performers and Art Vendors Ordinance.

ANALYSIS
Upon passage of an Ordinance before the members of the City Commission at the July 18,2001
Commission Meeting, it will be necessary for the members of the Commission to establish an
application processing fee for the permit by Resolution.
The process for a Street Performer and Art Vendor Permit requires the submitting of a detailed
application to the Occupational Licensing Office of the City of Miami Beach and review of the
pertinent information. Anticipated in the application process for artists is the examination of
representative samples of the applicant's work for purposes of verifying information as set forth in
the application. The City's review may also necessitate a visit to the studio or workshop of the
permit applicant in order to verify that the art is of his or her own creation. The process also
anticipates that a lottery may be administered by the Occupational Licensing Office in order to assign
the limited number oflocations which will be available on a quarterly basis.
The City issues various permits that range from a low of$15.00 for non-profit organizations and T-
shirt vendors to a higher end fee of approximately $200.00 for flower stands. As this particular
permit has a process which will potentially necessitate several hours of work per each individual
artist's application, it is suggested that a fee of $50.00 per permit would be appropriate and would
cover most of the City's expenses attendant to the processing of this permit and for performers, less
ofa review is required and a $15.00 fee would be appropriate.
