95-21577 Reso RESOLUTION NO. 95-21577 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA AUTHORIZING AND DIRECTING THE ADMINISTRATION TO SUBMIT AN APPLICATION TO THE METROPOLITAN DADE COUNTY OFFICE OF AMERICANS WITH DISABILITIES (COORDINATION OFFICE) FOR THE PURPOSE OF RECEIVING FUNDS TO ACHIEVE COMPLIANCE WITH THE AMERICANS WITH DISABILITIES ACT, AND EXECUTE THE ATTACHED INTERLOCAL AGREEMENT BElWEEN THE CITY OF MIAMI BEACH AND THE COORDINATION OFFICE FOR THE PURPOSE OF RECEIVING THE CITY'S FISCAL YEAR 1994-95 GRANT AWARD IN THE AMOUNT OF $43,837.96 AND APPROPRIATE THE FUNDS WHEN RECEIVED. WHEREAS, in order to be eligible to receive a grant for the purpose of ADA compliance for improving accessibility to persons with disabilities and for carrying out the City of Miami Beach's ADA Compliance Transition Plan, an application must be submitted to the Metropolitan Dade County Office of Americans with Disabilities (Coordination Office) no later than May 15, 1995; and WHEREAS, the City is seeking an award of $43,837.96 upon the condition that a component of the City's project be dedicated to public awareness programs; and WHEREAS, the City received a grant for $40,970.61 from the Coordination Office last year under the same grant program; . WHEREAS, the City desires to enter into the attached Interlocal Agreement with the Coordination Office to receive its allocated funding, NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that: Section I. The City Administration is hereby authorized to submit an application to the Metropolitan Dade County Office of Americans with Disabilities Act Coordination Office. Section II. The Mayor and City Clerk are hereby authorized to execute the attached Interlocal Agreement with Metropolitan Dade County. Section III. The disbursing officers of the City are hereby authorized to disburse the funds required by the terms of the Interlocal Agreement from ADA grant funds. ADMINISTRATION RECOMMENDATION The Administration recommends adoption of the attached Resolution authorizing the Mayor and City Clerk to execute an Interlocal Agreement with the County ADA coordination office for improving the accessibility of persons with disabilities and carrying out the City's ADA Compliance Transition Plan. BACKGROUND On May 18, 1994, the City Commission adopted Resolution No. 94-21161, for the execution of an Interlocal Agreement between the City of Miami Beach and the County ADA coordination office. The City received funding in the amount of $40,920.61, most of which has been spent, and the remainder of which has been earmarked to conduct public awareness programs concerning the City's programs for persons with disabilities. The City's ADA Coordinator has prepared a list of how other available funds will be used and has prepared the City's ADA Compliance Transition Plan. It is estimated that the need for funding will exceed the available resources already committed to the Plan. continued. . . AGENDA ITEM R -'1- c;, DATE 5-,~-q ( Comm. Memo. (ADA) - 2 - May 3, 1995 The City of Miami Beach's Mayor's Ad Hoc Barrier-Free Environments Committee has endorsed the expenditure of funds in accordance with the City's ADA Compliance Transition Plan. To be eligible to receive county funds, all participating cities must submit a program plan to the county assuring that these funds will be used in accordance with State law. All program plans submitted are to be reviewed and endorsed by each City's Handicapped Advisory Board. Further, all monies that were not distributed due to the failure of a city to submit or comply with all program plan criteria are placed in a special fund for redistribution to those cities which are in compliance. The criteria the County uses as a review of program plans includes the condition that the plan be adopted by Resolution. Since the City has already been informed to apply for $43,837.96 for FY 1994-95, the City must now adopt this Resolution to receive the funding award. ANALYSIS: The City needs to submit a grant application to the County ADA Coordination Office no later than May 15, 1995. The City of Miami Beach's ADA Coordinator will be responsible for the implementation of the grant. All required grant compliance documents shall be prepared as well by the City's ADA Coordinator. In addition, the City intends to submit an application for additional funds once the County sends notices of funding availability for FY 1995-96. Lastly, the County further stipulated in its award notice that a public awareness component be defined, and that the attached interlocal Agreement be executed before the county can release the fund award. The public awareness component will be designed, by the City's ADA Coordinator, and carried out in consultation with the Mayor's Ad Hoc Barrier-Free Environments Committee and the City's Public Information Office and will include the placement of ADA public service information in the City's newsletter and airing a Public Services Announcement on the City's Cable TV channel. The Administration proposes that this grant be applied for, and that the associated interlocal agreement be executed. The program plan will be submitted to the County on or before May 15, 1995. Once the agreement has been executed, and upon a fInal determination by the County of the availability of the funds, the City will be eligible to receive its allocated share of funding under this program. continued. . . (ADA) - 3 - May 3, 1995 CONCLUSION It is the Administration's recommendation that the City apply for this grant to receive $43,837.96 funding allocation from the Metropolitan Dade County Office of Americans with Disabilities Act (ADA) Coordination, for the period May 3, 1995 through September 30, 1995 and to execute the associated interlocal agreement.
