A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, AUTHORIZING THE WAIVER OF THE FACILITY
RENTAL FEE FOR THE FLAMINGO PARK BASEBALL STADIUM FOR THE
PERIOD OF MAY 1, 2009 TO JULY 31, 2009, AT AN ESTIMATED VALUE OF
$6,509, FOR USE BY THE FLORIDA DIAMOND PROS BASEBALL CLUB
("CLUB"), ANOT-FOR-PROFIT ORGANIZATION PROVIDING COACHING,
EDUCATION AND MENTORING FOR SOUTH FLORIDA YOUTH IN A
SHOWCASE- BASED PROGRAM THAT ASSISTS YOUTH IN REACHING THE
NEXT LEVEL OF PLAY (HIGH SCHOOL, COLLEGE OR PROFESSIONAL) AND
THE OPPORTUNITY TO PLAY BASEBALL DURING THE SUMMER; FURTHER
ESTABLISHING THAT THE CITY'S HARD COST EXPENSES FOR LABOR,
LIGHTS ETC., ESTIMATED AT APPROXIMATELY $7,000 AND A SECURITY
DEPOSIT OF $3,000 WILL BE PAID BY THE CLUB.
WHEREAS, recently, staff was approached by the Florida Diamond Pros Baseball Club
("Club"), anon-for-profit that provides South Florida youth with an opportunity to play baseball during
the summer while away from their schools; and
WHEREAS, the Club is arecently-incorporated 501 (c) 3 that includes the participation of
various coaches experienced in youth baseball, both at the high school and travel team level
including youth from Miami-Dade and Broward County who play on three teams: 16 and under and
two 17 and under teams; and
WHEREAS, the program provides coaching, education and mentoring in a showcase-based
program that assists youth in reaching the next level of play, whether that is high school, college or
professional baseball; and
WHEREAS, the Club fundraises to cover the costs of youth that cannot afford participation in
the summer-long program, which also includes participation in tournaments outside of the area (e.g.
Orlando, Georgia, etc.); and
WHEREAS, specifically, the Club requested a waiver of the rental fee for the use of the
Flamingo Park baseball stadium for the program period of May 1 -July 31, 2009; and
WHEREAS, approximately six to seven of the total participants are Miami Beach residents.
The Club participates in baseball tournaments with other, similar programs. These tournaments
provide an opportunity to showcase the talents of these youth to scouts from high schools, colleges
and professional baseball teams in one setting. This approach is similar to the approach currently
used in high school basketball; and
WHEREAS, The coaching staff includes Tom Duffin (Head of Player Development and Head
Baseball Coach), a former major league baseball professional and currently the coach of the
Monsignor Pace High School baseball team and other coaching staff that have been involved in
youth baseball in the area; and
WHEREAS, it is anticipated that scouts and teams attending the games and tournaments
would stay in local hotels; and
WHEREAS, the projected facility rental fee, based on a current rental agreement with Beach
High is $6,509 for the anticipated period; and
WHEREAS, this cost is exclusive of labor costs for Parks staff and costs for lighting, and
would require that the Club rake/drag and line the field and manage the scoreboard themselves; and
WHEREAS, the estimated hard costs to be paid by the Club for labor, electric, etc. is
$7,000, and the Club would be required to provide a security deposit of $3,000 to offset any costs
associated with repairs of the field at the end of their use; and
WHEREAS, inconsideration of a rental waiver, the Club has offered to provide the City with
three (3) free two-day baseball clinics for City youth, with all cost for these clinics borne by the Club;
and
WHEREAS, additionally, free admission would be provided to each game for all City
residents; and
WHEREAS, the club would also be required to provide proof of adequate insurance; provide
background clearances for all staff comparable to the screening used for Parks employees; maintain
hours of operation to reduce any disruption to the Neighborhood; (it would be a condition of use that
all games must be concluded by 9:45 P.M. to allow for the fields to be turned off by 10:00 P.M. as a
consideration to the neighborhood.) and provide for litter control of the stadium, facility parking lot
and surrounding area.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby approve and
authorize the waiver of the facility rental fee for the Flamingo Park Baseball Stadium for the period of
May 1, 2009 to July 31, 2009, at an estimated value of $6,509 for use by the Florida Diamond Pros
Baseball Club ("Club"), anot-for-profit organization providing coaching, education and mentoring for
South Florida youth in a showcase-based program that assists youth in reaching the next level of
play (high school, college or professional) and the opportunity to play baseball during the summer;
further establishing that the City's hard costs expenses for labor, lights etc., estimated at
approximately $7,000 and a security deposit of $3,000 will be paid by the Club.

Parks and Recreation appeared as one of the most important areas affecting resident's quality of life. Of
the 79% of residents and 82% of businesses rated the overall quality of the recreational programs and
facilities as excellent or good and 58% of residents stated that they go to recreational facilities a couple of
times a month or more. More recreational opportunities appeared as one of the changes residents would
make to make Miami Beach a better place to live, work, and play.

The Florida Diamond Pros Baseball Club, anon-profit local youth showcase baseball program, has
requested the use of the stadium for a summer program from May to July to provide practice, games and
tournaments for participating youth. A waiver of the rental rates has been requested. In exchange for any
waiver, the Club would provide free baseball clinics and free access to their games for all City residents.
The use of the stadium will activate the space, and has the potential of attracting out-of-town visitors who
may stay in our area. The Club would also pay for all hard costs associated with their use (labor, lights,
etc.), as well as provide a security deposit and the appropriate insurance and background clearances.
As this program will positively impact and benefit the youth of Miami Beach and offer another recreational
opportunity for our residents and visitors, the Administration recommends the approval of this resolution.

BACKGROUND
Recently, staff was approached by the Florida Diamond Pros Baseball Club ("Club"), anon-
for-profit that provides South Florida youth with an opportunity to play baseball during the
summer while away from their schools. The program provides coaching, education and
mentoring in a showcase-based program that assists youth in reaching the next level of play,
whether that is high school, college or professional baseball. The Club fundraises to cover
the costs of youth that cannot afford participation in the summer-long program, which also
includes participation in tournaments outside of the area (e.g. Orlando, Georgia, etc.).
Specifically, the Club requested the use of the Flamingo Park baseball stadium for the
program period. As pro~osed, use of the facility would begin as early as May 2"d, and run
through at least July 30t .The organization has requested a waiver of the field rental fee for
this period.
The Club is arecently-incorporated 501 (c) 3 that includes the participation of various
coaches experienced in youth baseball, both at the high school and travel team level. The
program includes youth from Miami-Dade and Broward County who play on three teams: 16
and under and two 17 and under teams. Approximately six to seven of the total participants

School baseball team. Other coaching staff includes individuals that have been involved in
youth baseball in the area. It is anticipated that scouts and teams attending the games and
tournaments would stay in local hotels. It is the Club's intention to charge a small admission
fee to help defray their costs.
ANALYSIS
The Flamingo Park baseball stadium has a seating capacity of approximately 400 persons in
bleacher seating. The stadium has lights and can support evening play. Summer
programming is currently confirmed only for the adult baseball league (South Florida
Baseball League) all day on Sundays (this league has been playing in the park for more than
a half-dozen years); and for one week of the Park's baseball summer camp (July 20-24) until
5:00 p.m.
As you may be aware, the City Commission has approved an ongoing relationship with
Miami Beach Senior High for the use of the stadium during their baseball season (February
to April/May). The City charges the School Board a flat fee for the use of the stadium for 118
days during that period. This use includes City staffing, field prep, etc. As proposed to the
City, the Club would use the stadium for a total of 48 days for a combination of practices,
games or tournaments. At least 41 of those games would require "evening" play (e.g. would
require lights). While the City has daily rental rates, and discounts for multiple rentals, these
rates were developed for occasional or one-time rental of the stadium, not the longer term
nature of what is proposed by the Club; that use would be closer to the use by Beach High.
The current rental agreement with Beach High is $16,000 for the season, or a daily rental
rate of $135.60 for the 118 days of use. Using this rental rate as a basis for comparison, the
rental rate for the Club's use of the stadium for 48 days would be $6,509. This cost is
exclusive of labor costs for Parks staff and costs for lighting, and would require that the Club
rake/drag and line the field and manage the scoreboard themselves. The estimated hard
costs for labor, electric, etc. is $7,000. The Club would also be required to provide a security
deposit of $3,000 to offset any costs associated with repairs of the field at the end of their
use. Additionally, the Club would have to accommodate the previously scheduled Adult
league on Sundays, as well as the City's summer camp program in their scheduling. It is
also a condition of use that all games must be concluded by 9:45 P.M. to allow for the fields
to be turned off by 10:00 P.M. as a consideration to the neighborhood.
Inconsideration of a rental waiver, the Club has offered to provide the City with at least three
(3) free baseball clinics for City youth. These two-day clinics would be coordinated by the
Club, and would be offered each month of their season. Participants would be provided with
pointers on pitching, fielding and batting from some of the head coaches of local teams, as
well as invited, guest teachers. The Parks staff would assist in coordinating the registration
for these free camps, but all costs for these clinics would be borne by the Club. Additionally,
free admission would be provided to each game for all Miami Beach City residents. The
club would also be required to provide proof of adequate insurance; provide background
clearances for all staff comparable to the screening used for Parks employees; maintain
hours of operation to reduce any disruption to the Neighborhood; and provide for litter
control of the surrounding area.
CONCLUSION
The Florida Diamond Pros Baseball Club, anon-profit local youth showcase baseball
program, has requested the use of the stadium for a summer program from May to July to
provide practice, games and tournaments for participating youth. A waiver of the rental rates
has been requested. Resolution 2002-24731 established guidelines for the approval of
rental fee waivers for qualified groups, organizations or users of the City's Park facilities.

Rent Waiver
Provisions are made for City-based and non-City-based non-profits with or without 501(c)3
status. All requests are forwarded to the City Manager for review and/or approval. In light of
the request for a waiver of rent for a use of greater intensity than provided for in the
resolution, this matter is forwarded to the Commission for your consideration. Additionally,
as the proposed season is scheduled to begin on May 1, 2009, it was necessary to place the
item directly on this Commission agenda for consideration. In exchange for any waiver, the
Club would provide at least three (3) free baseball clinics and free access to their games and
