2009-27079 ResoRESOLUTION NO. 2009-27079 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ELECTING COMMISSIONER VICTOR DIAZ, GROUP III, AS VICE-MAYOR FOR A TERM COMMENCING ON JULY 1, 2009, AND TERMINATING ON OCTOBER 31, 2009, AND RESUMING THE ROTATION POLICY STARTING WITH COMMISSION GROUP VI FOR THE NEXT TERM. WHEREAS, pursuant to Resolution 2005-26043, the Mayor and City Commission amended and re-established the policy of rotating the position of Vice-Mayor every four months; and WHEREAS, based on this policy, the next group in the Vice-Mayor rotation is Commission Group VI; and WHEREAS, the rotation period for Commission Group VI begins July 1, 2009 and concludes on October 31, 2009; and WHEREAS, Commissioner Deede Weithorn, Group VI, has suggested electing Commissioner Victor M. Diaz, Jr., Group III, to be the next Vice-Mayor in the rotation; and WHEREAS, the Mayor and City Commission accept the suggestion of Commissioner Weithorn to elect Commissioner Diaz, Group III, as Vice-Mayor for the term July 1, 2009 through October 31, 2009 and then to continue with the rotation policy starting with Commission Group VI; and WHEREAS, the Mayor and City Commission have voted to proceed with the procedure set forth above. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that Commissioner Victor M. Diaz, Jr., Group III, is hereby elected as Vice-Mayor of the City of Miami Beach, Florida, for the term commencing on July 1, 2009 and terminating on October 31, 2009 and that for the next term, the rotation policy starting with Commission Group VI shall be resumed. ANALYSIS The City Commission have established a policy of rotating the position of Vice-Mayor every four (4) months. There are (2) two different options for selecting aVice-Mayor for the July 1, 2009 through October 31, 2009 period, to wit: Option #1: Elect Commissioner Diaz, Group I I I, for the term July 1 St through October 31St and for the next term, November 1, 2009 through February 28, 2010, continue with the rotation starting with Commission Group VI. Option #2: Elect Commissioner Diaz, Group III, for the term July 1, 2009 through October 31, 2009, skip Commissioner Weithorn's rotation, and continue with the established rotation starting with Commission Group I.
