2001-24554 RESO RESOLUTION NO. 2001-24554 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, SETTING A PUBLIC HEARING FOR SEPTEMBER 20, 2001, TO CONSIDER A WAIVER OF DEVELOPMENT REGULATIONS PURSUANT TO SECTION 142-425(d) OF THE LAND DEVELOPMENT REGULATIONS FOR THE MIAMI BEACH CHAMBER OF COMMERCE FACILITY LOCATED AT 1920 MERIDIAN AVENUE; SAID WAIVER REGARDING THE MIAMI BEACH CHAMBER'S REQUIRED PARKING FOR THE AREA LEASED TO STATE REPRESENTATIVE DAN GELBER PURSUANT TO CHAPTER 130 OF THE LAND DEVELOPMENT REGULATIONS. WHEREAS, the Miami Beach Chamber of Commerce (MBCC) is compleling its new facility at 1920 Meridian Avenue; said facility will require 23 parking spaces, of which 16 will be provided on site and seven (7) spaces will be satisfied by a combinalion of (I) a waiver of development regulations (4 spaces); and (2) pursuant to a restrictive Covenant in Lieu of Unity of Title (3 spaces); and WHEREAS, in order for MBCC to open its building in a timely manner, it is necessary to waive certain development regulations pertaining to MBCC facility's required parking pursuanl to Chapter 130 of the City's Land Development Regulations for a site leased to a governmental use, which has been determined to be four (4) parking spaces, and the other three (3) spaces will be provided pursuant to a Covenant in Lieu of Unily of Title, to be presented for City Commission approval on September 20, 2001; and WHEREAS, pursuant to Section 142-425 (d) and (e) the Mayor and City Commission may waive development regulations following a noticed public hearing advertised in a newspaper at least fifteen (15) days prior to hearing and in order to meet this notice requirement, a public hearing must be set at today's Commission meeting for September 20,2001. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that a Public Hearing shall be held on September 20,2001, to consider the above request for waiver of development regulations in the City Commission Chambers at 1700 Convention Center Drive, Miami Beach, Florida and the City Clerk is hereby authorized and directed to publish and distribute the appropriate public notice of said public hearing at which time all interested parties will be heard.
