2001-24558 RESO RESOLUTION NO. 2001-24558 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AN AMENDMENT TO THE CITY'S ONE-YEAR ACTION PLAN FOR FEDERAL FUNDS FOR FISCAL YEAR 2000/2001 TO REALLOCATE HOME PROGRAM INCOME IN THE AMOUNT OF $51,638 FROM FISCAL YEARS 1997/1998, 1999/2000, AND 2000/2001, AND HOME PROGRAM FUNDS IN THE AMOUNT OF $1,000 FROM FISCAL YEAR 1998/1999, TO BE UTILIZED FOR REHABILITATION INITIATIVES IN ACCORDANCE WITH THE HOME PROGRAM REGULATIONS. WHEREAS, on February 18, 1992, the City was designated by the u.s. Department of Housing and Urban Development (HUD) as a Participating Jurisdiction to receive funds through the HOME Investment Partnerships (HOME) Program under 24 CFR 92; and WHEREAS, the City has established a HOME Investment Partnerships Program (HOME Program) under the rules of the U.S. Department of Housing and Urban Development (U.S. HUD), which provides financial assistance for the purpose of providing affordable housing within the City; and WHEREAS, on July 12, 2000, the City adopted Resolution No. 2000-23997 which approved the One-Year Action Plan for Federal Funds for Fiscal Year 2000/2001 and allocated $451,200 HOME Program funds for rehabilitation initiatives; and WHEREAS, the City wishes to amend the One-Year Action Plan for Federal Funds for Fiscal Year 2000/2001 by reallocating HOME Program Income in the amount of$51,638 from fiscal years 1997/1998,1999/2000, and 2000/2001, and HOME Program funds in the amount of$I,OOO from fiscal year 1998/1999, to be utilized for rehabilitation initiatives; and WHEREAS, on July 19, 2001, the City advertised a 30-day citizen comment period in accordance with U.S. HUD regulations and City's adopted Citizen Participation Plan; and NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the City's One-Year Action Plan for Federal Funds for Fiscal Year 2000/2001 is hereby amended to reallocate HOME Program Income in the amount of $51,638 from fiscal years 1997/1998, 1999/2000, and 2000/2001, and HOME Program funds in the amount of$I,OOO from fiscal year 1998/1999, to be utilized for rehabilitation initiatives in accordance with the HOME Program regulations. To: From: ADMINISTRATIVE RECOMMENDATION Adopt the Resolution. ANALYSIS Since 1992, the City has received an annual allocation of HOME Investment Partnerships (HOME) Program funds from the US. Department of Housing and Urban Development (US, HUD) for the purpose of expanding the supply of housing for persons meeting the income criteria of the HOME Program. This Program encourages partnerships between the government and the private sector, including for-profit and not-for-profit organizations for the acquisition, construction and rehabilitation of housing. On July 12, 2000, the City Commission approved Resolution No. 2000-23997 adopting the City of Miami Beach One-Year Action Plan for Federal Funds for Fiscal Year 2000/2001, which allocated HOME Program funds for that fiscal year. The One- Year Action Plan allocated $451,200 HOME Program funds for rehabilitation initiatives. In accordance with US. HUD regulations, an amendment to the One-Year Action Plan is required in order to adjust previously allocated funding. This amendment to the One-Year Action Plan provides an additional $52,638 in HOME Program funds for rehabilitation initiatives by reallocating Program Income generated in accordance with the HOME Program regulations. Therefore, the amount of HOME Program funds available for rehabilitation initiatives for fiscal year 2000/2001 increases to a total of$503,838. \\CH2\ VOLl \DDHP\sALL IMIGUELL \Action Plan Amendment 2000-2001_ memo,doc AGENDA ITEM C 7 K DATE ?- S-,Of September 5, 2001 Commission Memorandum One-Year Action Plan Amendment for Fiscal Year 2000/2001 Page 2 The HOME Program regulations stipulate that Program Income generated by HOME-assisted undertakings is to be utilized for HOME Program projects. Therefore, this amendment reallocates Program Income funds to rehabilitation initiatives for the City to fund HOME Program projects. The Program Income funds currently being reallocated include: . $1,388 in Program Income from fiscal year 1997/1998 previously allocated to the Notice of Funding Availability (NOFA) for fiscal year 1999/2000, . $250 of Program Income from fiscal year 1999/2000 generated from an application fee to the NOF A for fiscal year 1999/2000, and . $50,000 in Program Income from fiscal year 2000/2001 recently generated when the City recaptured the funds from the sale of a HOME-assisted unit. Also, $1,000 in HOME Program funds from fiscal year 1998/1999 is being reallocated to reflect an adjustment in the HOME Program funding allocation from U. S. HUD to the City for that fiscal year. Once this amendment is adopted, the City will issue its annual HOME Program NOF A for fiscal year 2000/2001 in the amount of $503,838 for rehabilitation initiatives, which includes the $52,638 reallocated funds. In accordance with u.s. HUD regulations, and the City's adopted Citizen Participation Plan, on Thursday, July 19, 2001, a 30-day citizen comment period was advertised on the proposed amendment. The City did not receive any comments. The Administration recommends that the Mayor and City Commission ofthe City of Miami Beach approve an amendment to the City's One-Year Action Plan for Federal Funds for Fiscal Year 2000/2001 to reallocate HOME Program Income in the amount of $51,638 from fiscal years ] 997/1998, 1999/2000,2000/2001, and HOME Program funds in the amount of$I,OOO from fiscal year 1998/1999, to be utilized for rehabilitation initiatives in accordance with the HOME Program regu:Jatio s.
