2001-24583 RESO RESOLUTION NO. 2001-24583 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE PLACEMENT OF FIFTEEN (15) BANNERS FOR LATIN AMERICAN WEEK 2001, TO BE HELD OCTOBER 11, 2001 TO OCTOBER 14, 2001, AS REQUESTED BY THE APPLICANT AT THE FOLLOWING LOCATIONS: CONVENTION CENTER DRIVE, BETWEEN 17TH STREET TO DADE BOULEVARD; DADE BOULEVARD, WASHINGTON AVENUE TO ALTON ROAD; AND 17TH STREET, BETWEEN MERIDIAN AVENUE TO WASHINGTON AVENUE; SAID BANNERS TO BE AFFIXED TO LIGHT POLES IN THE PUBLIC RIGHT-OF-WAY, MEASURING 3 FEET X 7 FEET AND HAVING COPY AND DESIGN AS SHOWN ON THE ATTACHED DRAWINGS; TO BE INSTALLED AND REMOVED IN ACCORDANCE WITH ALL OTHER APPLICABLE CITY REQUIREMENTS; THE ADMINISTRATION FURTHER RECOMMENDS THAT THESE BANNERS BE INSTALLED NO EARLIER THAN SEPTEMBER 28, 2001, AND REMOVED BY OCTOBER 16, 2001. WHEREAS, the Latin American Week 2001 (Applicant) will be held October 11, 2001, through October 14, 2001, in the City of Miami Beach; and WHEREAS, in order to publicize the event and draw attention of the media and the public at large, the Applicant has requested light pole banners, measuring 3 feet by 7 feet; and WHEREAS, the Applicant has been through the required design review permit process in order to obtain approval for said banners; and WHEREAS, said banners are to be installed no earlier than September 28 , 2001, and removed by October 16, 2001; and WHEREAS, the Applicant has requested approval and authorization for the placement of a total of fifteen (15) banners; and WHEREAS, the Applicant has posted a performance bond to ensure the removal of the banners by October 16, 2001, and will ensure that any damage to light poles will be repaired at its expense, and will meet all other applicable City requirements; and WHEREAS, City Code Section 82-411 (d) requires that the Mayor and City Commission approve the installation of temporary banners. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission herein approve and authorize the placement of fifteen (15) banners for the Latin American Week 2001 to be held in the City of Miami Beach, October 11, 2001, through October 14, 2001, as requested by the Applicant at the following locations: Convention Center Drive, between 17th Street to Dade Boulevard; Dade Boulevard, Washington Avenue to Alton Road; and 17th Street, between Meridian Avenue to Washington Avenue; said banners to be affixed to light poles in the public right-of-way; measuring 3 feet by 7 feet and having a copy and design as shown on the attached drawing; and to be installed and removed in accordance with all other applicable City requirements; the Administration further recommends that these banners be installed no earlier than September 28,2001, and removed by October 16, 2001. ANALYSIS The City Code Section 82-411 (d) requires that the City Commission approve the installation of temporary banners which reads, in part: AGENDA ITEM ~ 7 !) DATE 9-;J::J-OI Commission Memorandum September 20, 2001 Latin American Week 2001 Page 2 (1) The right to install, as well as the number, location and method of installation of banners shall be subject to the design review process and approved by the City Commission and the Public Works Department. (2) Banners shall not exceed three feet in width by seven feet in length. Banners may be double-sided. The color, design and material of all banners shall be approved under the design review process. (3) Banners announcing special events either to be held in City or to be associated in some manner with the city, as determined by the City Commission, may be erected up to 30 days prior to the event being announced and must be removed within seven days after such event. Special event banners shall require prior approval by the City Commission. (4) A performance bond shall be required to ensure the removal of the banners in case of advanced deterioration of the banners, or if a dangerous condition presents itself, the City may at its sole discretion direct banners to be removed at any time. The purpose of the banners is to promote Latin American Week 2001, an interchange with four of the City of Miami Beach's Latin American Sister Cities that will include food and entertainment typical of the visiting Latin American cities. If approval is granted, the proposed temporary banners are recommended to be installed no earlier than September 28,2001 and removed no later than October 16, 2001 by the banner company.
