2009-27144 ResoRESOLUTION NO. 2009-27144 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, RECOMMENDING THE MIAMI- DADE COUNTY SUPERVISOR OF ELECTIONS RELOCATE THE APPLICABLE MIAMI BEACH POLLING PLACES FOR THE NOVEMBER 3, 2009 GENERAL ELECTIONS. WHEREAS, at the request of Vice-Mayor Diaz, the Miami-Dade County Supervisor of Elections, Chief Deputy Supervisor of Elections, and City of Miami Beach staff met to review the polling precincts, to discuss concerns with the current location of voting precincts at City Fire Stations. As a result, the Miami-Dade County Elections Department submitted a list of revised polling precincts for the City's review and consideration; WHEREAS, at the June 3, 2009 City Commission Meeting, the item was referred to the Neighborhoods/Community Affairs Committee; where the item was discussed at the June 17, 2009 Committee meeting; and WHEREAS, at the July 15, 2009 City Commission Meeting, the Mayor and City Commissioners approved the recommendation from the Neighborhoods Community Affairs Committee regarding Miami Beach Polling Place Relocations; and WHEREAS, the following polling locations list is to be recommended to the Miami- Dade Elections Department: 1) Precinct 41, located at Miami Beach Fire Station No. 1, to be relocated to Precinct 46 located at South Shore Community Center; 2) Precinct 44, temporarily located at The Savoy Hotel, to be relocated to South Pointe Park Community Center; 3) Change Miami Beach Hispanic Community Center, from Precinct 19 to Precinct 18; 4) Change Normandy Park and Pool from Precinct 18 to Precinct 19; 5) Precinct 39, Fire Station No. 1, to be relocated to Precinct 36 at Flamingo Park Boys and Girls Club; 6) Precinct 21, to be relocated to the Ronald W. Shane Center, if the Elections Department. deems this to be a suitable facility. NOW THEREFORE, BE IT DULY RESOLVED THAT THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA hereby approves and authorizes the City Clerk to transmit this Resolution to the Miami-Dade County Supervisor of Elections recommending the above changes in polling precincts locations. Commissioner Deede Weithorn was also present. Motions were made to forward these changes to the Commission for their consideration. Commissioner Libbin voted "no" on each of the items because he did not have enough information and requested that Miami-Dade County Elections Department provide the information below on any precinct that has changed locations more that twice in the last four (4) municipal elections (8 years), and on several precincts that have not relocated: Number of Registered voters Number of voters who have voted at the precinct Number of voters who vote absentee or early voted. Attached, for your perusal is the July 7, 2009 letter from Ms. Tara C. Smith, Chief Deputy Supervisor of Elections, Miami-Dade Elections Department, providing the information requested at the June 17, 2009 Neighborhoods/Community Affairs Committee Meeting (Attachment "B"). It should be pointed out that the July 7 letter from Ms. Smith indicates that after their analysis regarding relocating precinct 15 it is their recommendation to relocate the precinct to the North Shore Park Youth Center, however the most desirable location would be the Shane Water Sports Center. Please advise, however, if your commission is able to persuade Shane Water Sports to utilize their facility for future elections since this location is the most desirable. As you know, the Elections Department's efforts have been unsuccessful. I hope this information proves helpful as your commission makes their determination on precinct locations. I would like to take this opportunity to reiterate an important note. The verbiage on any legislation regarding this matter should recommend that the Supervisor of Elections relocate the applicable precincts. Only the Supervisor of Elections can designate or approve specific locations as polling places. If and when a resolution passes, the Supervisor of Elections will then consider whether to make those changes.
