2009-27118 ResoRESOLUTION NO. 2009-27118 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING THE CONCEPT PLAN DESIGN, AS SUBMITTED BY BOYS AND GIRLS CLUB OF MIAMI DADE, INC. ("BGCM-D"), FOR THE PROPOSED CAPITAL IMPROVEMENTS CONSISTING OF DEMOLITION OF THE EXISTING STRUCTURE, LOCATED AT 1000 12T" STREET, MIAMI BEACH, FLORIDA; AND CONSTRUCTION OF A NEW TWO STORY STRUCTURE, HAVING APPROXIMATELY 10,000 SQUARE FEET, ON THE APPROXIMATE FOOTPRINT OF THE CURRENT STRUCTURE; AND AS SAID CONCEPT PLAN DESIGN WAS SUBMITTED AND REVIEWED BY THE CITY MANAGER, AND APPROVED BY THE CITY'S PLANNING BOARD AT ITS JUNE 23, 2009, MEETING; ALL AS FURTHER REQUIRED PURSUANT TO THE MANAGEMENT AND OPERATION AGREEMENT BETWEEN THE CITY AND BGCM-D, DATED NOVEMBER 5, 2008 WHEREAS, the City is the owner of that certain facility currently referred to as the Boys and Girls Club (and hereinafter referred to as the Premises), located at 1000 12th Street, Miami Beach, Florida; and WHEREAS, the Boys and Girls Club of Miami-Dade, Inc. (BGCM-D) is a Florida not-for-profit corporation which has developed a proven track record in providing programming for youth in both educational support and athletic activities; and WHEREAS, the City is desirous of forging a partnership with BGCM-D to manage and operate a Boys and Girls Club on the Premises previously leased to the BGCM-D, and has deemed that it would be in the City's best interest to continue the programming provided by BGCM-D in the new facility; and WHEREAS, concurrent with its desire to engage BGCM-D in the programming of a Boys and Girls Club, and in order to effectively and fully accomplish such purpose(s), the City has also identified the need for capital improvements to the Premises, and BGCM-D has committed to fund the design, development and construction for the Boys and Girls Club in Flamingo Park; and WHEREAS, the proposed expansion of the Premises from cone-story building to a two-story building will allow for increased programming and increased capacity while remaining within the physical footprint and impact to the open space of the park; and WHEREAS, at its regular meeting on November 5, 2008, the Mahyor and City Commission approved Resolution No. 2008-26939, waiving, by 5/7t S vote, the competitive bidding requirement, finding such waiver to be in the best interest of the City, and authorized the Mayor and City Clerk to execute a Management and Operation Agreement for a Boys and Girls Club in Flamingo Park (the Agreement); and WHEREAS, pursuant to the terms of the Agreement, BGCM-D is required to submit its Concept Plan Design, detailing the proposed improvements to the Premises to, respectively, the (i) City Manager (for administrative review and comment); (ii) City's Planning Board (for review and recommendation); and (iii) City Commission (for final review and approval); and WHEREAS, the Concept Plan Design was timely submitted to the City Manager and reviewed by staff; and, at its regular meeting on June 23, 2009, following a presentation by BGCM-D, the Planning Board also reviewed and endorsed the Concept Plan Design; and WHEREAS, accordingly, the Administration would hereby recommend that the Mayor and City Commission approve the Concept Plan Design, as submitted by BGCM- D to the City Manager, and as endorsed by the City's Planning Board. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby approve the Concept Plan Design, as submitted by Boys and Girls Club of Miami Dade, Inc. BGCM-D), for the proposed capital improvement of a new facility, located at 1000 12 h Street, Miami Beach, Florida; and as said Concept Plan was submitted and reviewed by the City Manager, and as approved by the City's Planning Board at its June 23, 2008, meeting; all as required pursuant to the Management and Operation Agreement between the City and BGCM-D, dated November 5, 2008. Of the 79% of residents and 82% of businesses rated the overall quality of the recreational programs and facilities as excellent or good and 58% of residents stated that they go to recreational facilities a couple of times a month or more. ANALYSIS The City is the owner of that certain one-story facility currently referred to as the Boys and Girls Club (herein after referred to as the Premises), located at 1000 12th Street, Miami Beach, Florida. BGCM-D is a Florida not-for-profit corporation which has developed a proven track record in providing programming for youth in both educational support and athletic activities. At its regular meeting on November 5, 2009, the Mayor and City Commission approved Resolution No.2008-26939, waiving, by 5/7tnsvote, the competitive bidding requirement, finding such waiver to be in the best interest of the City, and authorizing the Mayor and City Clerk to execute a Management and Operation Agreement with BGCM-D for a Boys and Girls Club in Flamingo Park (the Agreement). The BGCM-D has operated in the present Premises for approximately 18 years under a Lease Agreement. Under the terms of the Management and Operation Agreement, BGCM-D will be responsible for the demolition of the current facility, and the design, development, construction and funding for a new building. The City retains ownership of the improvement at all times. The BGCM- D will retain full responsibility for any and all capital costs for the first ten years of the Agreement, and will split equally any capital costs with the City for the remaining balance of the Agreement, which term is fifty years total (including renewal terms). Pursuant to the terms of the Agreement, BGCM-D is required to submit its Concept Plan Design Commission Memorandum BGCM-D Concept Plan July 15, 2009 Page 2 of 3 and comment); (ii) the City's Planning Board (for review and recommendation); and (iii) the City Commission (for final review and approval). Additionally, a Certificate of Appropriateness for Demolition is required in order to commence demolition of the existing facility and will be brought to the City Commission after being heard by the Historic Preservation Board. The Concept Plan Design, attached as Exhibit "A", was timely submitted to the City Manager and reviewed by staff. Planning staff undertook a preliminary evaluation of the Concept Plan for the facility, which is proposed to be developed on the site of the existing one story building located in the southwest portion of Flamingo Park and adjacent to the Police Athletic League. At its regular meeting on June 23, 2009, following a presentation by BGCM-D, the Planning Board endorsed the Concept Plan Design. CONSTRUCTION AND ARCHITECTURE The proposed architecture is relatively affordable and functional, using precast concrete construction which has been previously used in the recent construction of the Boys and Girls Club Education Center in the City of Miami. The architecture is intended to be a simple and functional background and not an architectural feature building in Flamingo Park. The plan calls for atwo-story construction to reduce the physical footprint and impact to the open space of the park. The building is set back from 11th Street, removing the children from close proximity to vehicular traffic when entering and exiting the area. It is the expectation that the Planning staff and the Historic Preservation Board will require awell- designed public footpath/bikepath constructed adjacent to the new facility to provide a safe pedestrian and bicycle connection through the park from 11th Street to 12th Street. CONCLUSION Accordingly, the Administration would hereby recommend that the Mayor and City Commission approve the Concept Plan Design, as submitted by BGCM-D to the City Manager and as endorsed by the City's Planning Board. Gomez, AICP Planning Director PLANNING BOARD SATE: June 23, 2009 SUBJECT: File No. 1931 -Review of Concept Plan for the new Boys and Girls Club building. At the November 5, 2008 meeting, the City Commission adopted a resolution authorizing the Mayor and the City Clerk to execute a Management Agreement with Boys and Girls Clubs of Miami-Dade, Inc, whereby Boys and Girls Club would pay for the full cost of design and construction of the facility that would be located in approximately the same area as the current facility in Flamingo Park. The Boys and Girls Club would also demolish the current structure as part of their project. The City hosted a community meeting to discuss a variety of options for the Master Plan for the renovation of Flamingo Park. Included in all of the options was a provision for the location of a new Boys and Girls Clubs facility. The City's consultant recommended in the three most acceptable scenarios that the Boys and Girls Club be located in approximately the same area in which the current facility has operated. When presented to the community there were no adverse comments received as a result of this recommended location. The Management Agreement, as recommended by the Finance Committee and approved by the City Commission, is for an initial term of thirty (30) year term and two (2) renewable ten (10) year terms for a newly constructed Boys and Girls Club. It also provides that the Boys and Girls Club will assume all responsibility for the care, maintenance and operation of the facility, and the Club would pay for the full cost of design and construction of the facility and demolition of the current structure as part of their project. The City would be allowed to use the facility at times that do not interfere with the programmatic needs of the Boys and Girls Club at no charge, other than direct expenses associated with the facility use. The Agreement provides for the Boys and Girls Club to assume responsibility for any capital costs in the first ten (10) years of the Agreement and to equally split any capital costs for the balance of the Agreement. The City retains significant supervision, oversight and control and because it is a management agreement as opposed to a lease or a conveyance, the Charter provision of Section 1.03 (sale, exchange or conveyance or leases of 10 years or longer), does not apply. It should be noted that the Agreement also requires Planning Board approval of the Concept Plan. Concept Plan Preliminary Evaluation Planning staff have undertaken a Preliminary Evaluation of the proposed Concept Plan for the new Boys and Girls Club, to be located in Flamingo Park slightly to the east of the existing Track and immediately north of the Police Athletic League (PAL) building. The main entrance to the new facility will be from the north, near the intersection of 12~' Street and Michigan Avenue. Planning Board File No. 1931- Boys and Girls Club June 23, 2009 Page 2 The subject site is located within the locally designated Flamingo Park Historic District, created in 1990, and within the National Register Historic District, (officially known as the Miami Beach Architectural District), and listed on the National Register of Historic Places in 1979. Consequently, the proposed demolition of the existing non-contributing single story Boys and Girls Club structure on the site shall require a Certificate of Appropriateness for Demolition being granted by the City Commission at a public hearing as well as a Certificate of Appropriateness for the proposed new construction being granted by the City's Historic Preservation Board, similarly at a public hearing. Over the last year or more, Planning staff members have met on several occasions with the Boys and Girls Club representatives and their architect, in an effort to plan a functional and appropriately designed facility that is relatively affordable, using precast concrete construction (which is the construction-of-choice by the Boys and Girls Club). While there are still minor plan and design issues remaining to be worked out between staff and the applicant, the Concept Plan has developed in a quite satisfactory manner, considering the aesthetic and planning limitations of the precast system. The Boys and Girls Club is not intended to be an architectural feature building in the Flamingo Park. Rather, it is a simple and functional background building, serving a valuable public service for local youths, and utilizing two-story construction to reduce the physical footprint and impact upon the open space of the park. Additionally, the building is advantageously well set back from 11 ~' Street, where the children will be better protected from vehicular traffic when entering and exiting. The main entrance to the building is wisely located nearer to 12~' Street, which is much less heavily trafficked during daytime hours. Both Planning staff as well as the Historic Preservation Board will likely require that a well designed public footpath/bikepath be created adjacent to the Boys and Girls Club, to~provide a convenient, pleasant, and safe pedestrian and bike connection through the park from 11 Street to 12~' Street. The Planning Department is looking forward to working with the applicant and architect in the final develop of the architecture as well as the highly important site plan for the proposed new Boys and Girls Club facility in South Beach.
