WHF.RF,AS, the City of hfiami Reach Cicneral and Special Elections will be scheduled
to he held on 'fucsdac. November 3, 2009 liar the purpose of electing a Alayor and
Commissioners in Groups I, II, and ili, and presenting to the voters four (4) ballot
questions; and
~VIIEREAS, A Run-off Election, if necessary, will be scheduled for Tuesday, November
17, 2009; and
R`HEKEAS, pursuant to >\liami Bcach City Code Section 38-6 entitled "Carly Voting"
subsection (a) thereof, commencing with the November 2005 municipal election. "...all
City of \-liami Beach general, runotl"and special elections are hereby exempted from the
provisions of F.S, § 101.6a7(1)(d) (the "L'arly ~•'otutg Statute"). The early voting statute
provides for early voting to begin on the ISa' day before an election and end on the
second day before an election and provides other operational restrictions": and
WHT':REAS, ~livni Beach City Code Section 38-6(b) provides that '`...early voting, if
authorized by the City Commission, shall commence at Miami Reach City Hall eight
days prior to the Cicneral Election, and shall occur for a total of seven consecutive days:

SUBJECT: A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, PURSUANT TO CITY CODE SECTION 38-6,
AUTHORIZING EARLY VOTING FOR THE NOVEMBER 3, 2009, AND FOR THE
NOVEMBER 17, 2009 RUNOFF ELECTIONS, IF A RUNOFF ELECTION IS
REQUIRED.
The City Commission needs to authorize early voting and establish the early voting dates,
times, and location(s) for both the General Election and Run-off Election, if a Run-off
Election is required.
If the City Commission authorizes early voting, the Administration recommends that the City
Commission approve, at a minimum, one early voting site. Miami Beach City Hall, and
consider a second, the North Shore Branch Library, and the early voting dates and times as
listed below:

FUNDING
Funding in the amount of approximately $400,000 will be included in the FY 2009/10 budget
to cover early voting estimated costs of $36,000 (General and Run-off) for two sites based
on the schedule listed above and the cost of a general election and a runoff election.
ANALYSIS
The City of Miami Beach General Election is scheduled to be held on Tuesday, November 3,
2009, for the Mayor and Commission Groups I, II and III. A Runoff Election: if necessary, will
be scheduled for Tuesday, November 17, 2009.
Pursuant to Miami Beach City Code Section 38-6(a) -Early Voting, commencing with the
November 2005 municipal election: all City of Miami Beach general, runoff and special
elections are hereby exempted from the provisions of F.S. § 101.657(1)(d) (the "Early Voting
Statute"). The early voting State Statute provides for early voting to begin on the 15th day
before an election and end on the second day before an election and provides other
operational restrictions.
Miami Beach City Code Section 38-6(b) provides that early voting, if authorized by the City
Commission, shall commence at Miami Beach City Hall eight days prior to the General
Election, and shall occur for a total of seven consecutive days: with early voting to occur on
the Saturday and Sunday immediately preceding any Run-off Election. As such, the seven
(7) early voting dates and suggested early voting times for the general election would be as
follows:
