2009-27162 ResoRESOLUTION NO. 2009-27162 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE CITY MANAGER TO ACCEPT, ON BEHALF OF THE CITY, DONATIONS MADE TO THE CITY FOR THE PURPOSE OF MAKING IMPROVEMENTS INCLUDING, WITHOUT LIMITATION, THE PURCHASE AND INSTALLATION OF CERTAIN AMENITIES TO THE RECENTLY APPROVED DOG PARK IN WASHINGTON AVENUE PARK (THE "DOG PARK"); AUTHORIZING THE CITY MANAGER TO TAKE SUCH ACTIONS, AS HE MAY DEEM NECESSARY AND IN THE BEST INTEREST OF THE CITY INCLUDING, WITHOUT LIMITATION, MAKING EXPENDITURES AND/OR REIMBURSEMENTS FROM THE DONATIONS TO IMPLEMENT ANY OF THE AFORESTATED IMPROVEMENTS TO THE DOG PARK; AND FURTHER REFERRING TO THE NEIGHBORHOODS AND COMMUNITY AFFAIRS COMMITTEE: A) A PROPOSAL BY MR. AND MRS. PROBUS (SOUTH POINTE NEIGHBORHOOD RESIDENTS) FOR THE PLACEMENT OF A MEMORIAL PLAQUE IN THE DOG PARK IN MEMORY OF MRS. PROBUS'S MOTHER, IN CONJUNCTION WITH A DONATION TO THE CITY BY MR. AND MRS. PROBUS IN THE AMOUNT OF $10,000, TO BE USED FOR THE AFORESTATED IMPROVEMENTS TO THE DOG PARK AND B) THE CITY'S PROPOSED MEMORIAL BRICK WALKWAY IN THE DOG PARK. WHEREAS, at the January 28, 2009, Commission meeting, the Administration requested the matter of dogs off leash in City parks, and other public properties in general, be referred to the Neighborhoods and Community Affairs Committee for discussion and there were on-going discussions at the Neighborhoods and Community Affairs Committee meetings concerning this issue; and WHEREAS, at the June 3, 2009 Commission meeting, the issue of a dog park at South Pointe Park was discussed. Following the discussion, the Commission approved an action that established an enclosed dog park at Washington Avenue Park, south of the old library building, and appropriated $60,836 to complete the work; and WHEREAS, included in the approval of a dog park in the Washington Avenue Park was the directive for the Administration to work with the RDO ("Responsible Dog Owners") and other interested parties in the community to obtain input for the design and layout of the new dog park; and WHEREAS, the Administration, RDO representatives, and members of the community have met on three occasions to discuss the layout and design of the Washington Avenue Dog Park and it was expressed by both the RDO and community that this park should be "something special" and have some amenities that are in addition to those that are found in other dog parks, including a water feature for the dogs to play in, and a unique street crosswalk unifying the newly constructed dog park with the existing dog park across the street; and WHEREAS, it was made clear by the Administration that the funding approved by the City Commission did not include these amenities and, therefore, such enhancements would need to be paid for by other non-City sources; and WHEREAS, Jonas and Carla Probus ("Mr and Mrs. Probus"), residents of the South Pointe neighborhood and users of the City's dog parks, have most generously offered to donate $10,000 toward the costs of construction of a water feature for the Dog Park, conditioned upon the placement of a plaque honoring Mrs. Probus's mother in the Dog Park after approval for and compliance with the City's established requirements and procedures set forth in Article VI of Chapter 82 of the City Code; and WHEREAS, the Administration is recommending that the donation proposal of Mr. and Mrs. Probus be referred to the Neighborhoods and Community Affairs Committee for further discussion and direction; and WHEREAS, the working group identified other enhancements that exceeded the available funding for the Washington Avenue Dog Park. These include an additional bench, a concrete slab surrounding the water feature, a water collection cistern, and a crosswalk to more visibly link the two parks. Initial estimates indicate that the water feature elements preferred (as well as associated infrastructure costs to install the water feature) exceed the generous $10,000 donation and the working group agreed to a fundraising goal of approximately $20,000 - $25,000 to cover these additional costs; and WHEREAS, at this time, the estimated project cost is a total of $97,152.88. The City's allocation is $60,836 leaving a balance of $36,316.88 needed to be raised by private efforts; and WHEREAS, the working group consisting of the Administration, the RDO, and community representatives have agreed to an action plan consisting of a three prong fundraising approach consisting of: Level 1) engraved bricks to be sold for $125.00 each; Level 2) a donor's slab to commemorate donations between $1,000.00 and $2,000.00; and Level 3) possible naming rights to the Washington Avenue Dog Park for donations between $50,000.00 to $100,000.00 subject to the approval for and compliance with the City established requirements and procedures in Article VI of Chapter 82 of the City Code. WHEREAS, the City Administration is currently reviewing a comprehensive corporate sponsorship package to include guidelines and specific donation opportunities which would include provisions that any memorials or naming rights would be subject to the process set forth in Article VI of Chapter 82 of the Miami Beach City Code; and WHEREAS, the memorial plaque proposed by Mr. and Mrs. Probus, as well as the City's proposed brick memorials for a walkway in the Dog Park require referral to the Neighborhoods and Community Affairs Committee for review and consideration; and WHEREAS, the City Administration further seeks authorization to proceed with the Washington Avenue Dog Park design concepts and fundraising action plan set forth herein. NOW, THEREFORE, BE IT DULY RESOLVED THAT THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, as follows: 1) That the City Administration is hereby authorized to proceed with the fundraising action plan and the design concepts set forth herein for the Washington Avenue Dog Park; 2) That the City Manager is hereby authorized to accept, on behalf of the City, donations made to the City for Dog Park amenities in the Washington Avenue Park and to take such actions as he deems necessary and in the best interest of the City including, without limitation, making expenditures or reimbursements from the donations to implement improvements for said Dog Park; 3) That the memorial proposed by Mr. and Mrs. Probus in honor of Mrs. Probus's mother and the City's proposed memorial brick walkway in the Dog Park are hereby referred to the Neighborhoods and Community Affairs Committee for review and consideration. In response, the community has worked with the Administration to accomplish the following: 1. Mr. and Mrs. Jonas and Carla Probus, residents of the South Pointe neighborhood and users of the City's dog parks, have most generously offered to donate $10,000 towards the costs of construction of a water feature for the dog park, conditioned upon the placement of a plaque honoring Mrs. Probus' mother. The plaque would be in compliance with the City's established procedures for such placement. 2. The working group identified other enhancements that exceeded the available funding. These include an additional bench, a concrete slab surrounding the water feature, a water collection cistern, and a crosswalk to more visibly link the two parks. Initial estimates indicate that the water feature elements preferred (as well as associated infrastructure costs to install the water feature) exceed the $10,000 donation. At the meeting held on August 6, 2009, the working group agreed to a fundraising goal of approximately $20,000 - $25,000 to cover these additional costs. The fundraising efforts would focus on a three-prong fundraising approach: o LEVEL I: Individual "memorial" bricks with engraving (dog name, etc.) to be sold for $125.00 each. It was agreed the first order would be for 200 bricks. The bricks would be inlaid in the walkway and other areas of the dog park deemed appropriate. o LEVEL II: "Grauman's Chinese Theater" concept, whereby donors would purchase a "slab" in the walkway at a donated cost of $1,000 each and have their dog's paw imprints in the cement with their dog's name. o LEVEL III: Offer naming rights to the park. It was suggested that the value of this could be $50,000 - $100,000, depending on terms and conditions. No sponsor has been identified as yet, and any potential sponsor would be forwarded to the City Commission for discussion, further direction and ultimate approval. There was also discussion as to how the donated funds would be received/deposited. The conclusion was that the City of Miami Beach would develop the format and print the brick donation order form. The individual brick order form would have both the City and RDO (Responsible Dog Owners) logos, and indicate that the brick donation is $125.00 (value is $100.00). Page 3 of 3 Washington Avenue Dog Park Donations A goal of 200 bricks to be sold was established, with the volunteers assuming the responsibility to "sell" the bricks. All checks and credit card orders would be deposited with and processed through the City of Miami Beach only, but the form would include information on how to donate to RDO to support their programming. The new Washington Avenue Dog Park as jointly conceptualized by our residents and the Administration includes the following features: • Perimeter fencing replacement and restoration; • New double gated entry with swing gates; • Installation of a new walkway designed to include inlay bricks and "paw print" slabs as previously explained; • New striped crosswalk (location to be determined based on County approval) to tie into the dog park currently located at the RDO across the street; • Landscape improvements, to include but not be limited to, removal, re-grading, leveling and sodding of park; relocation of trees to other areas of the park to provide more open space; the installation of fabric cloth and recycled pine bark brown mulch as needed; planting of a hedge around the perimeter fence to soften appearance; • Installation of a new irrigation system with controller; • A 20' diameter water spray feature with 5 features for dogs; • A rain water cistern system to collect water to augment the irrigation system; • New park furnishings to include trash receptacles (2), dog waste bag dispenser (3); park benches (4); a drinking fountain w/pet bowl; a donation plaque; and park rules and regulations signage. At this time the estimated project cost is a total of $97,152.88. The City's allocation is $60,836 leaving a balance of $36,316.88 needed to be raised by private efforts. The group expressed a preference of what features to prioritize should sufficient private funds not be raised. A copy of the proposed dog park layout, including amenities, is attached. The group indicated that, should funding be available once these improvements are completed, that other improvements be considered (e.g. solar lights). The revised budget reflecting the estimated costs is also provided for your information. CONCLUSION In order to continue to move forward with the park design concept (please see the attached layout of the new dog park prepared by the Administration) which incorporates the ideas and input of the residents, the Administration recommends the adoption of the attached Resolution authorizing the acceptance of these fundraising action steps, and referring the proposed donation from Mr. & Mrs. Probus, as well as the proposed memorial brick walkway in the Dog Park, to the Neighborhoods and Community Affairs Committee for review and consideration, as required by City Code.
