2009-3660 OrdinanceORDINANCE NO. 2009-3660 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA AMENDING MIAMI BEACH CITY CODE CHAPTER 2, ARTICLE VII, DIVISION 2 THEREOF BY CREATING SECTION 2-462 ENTITLED "PROHIBITING ~'~~ ~~5 MEMBERS OF CITY COMMISSION' FROM HAVING CERTAIN POST-SERVICE CONTRACTS WITH CITY", PROHIBITING FORMER r`~TV c~ ~~TCn ncc~~~ni c MEMBERS OF THE CITY COMMISSION FROM CITY EMPLOYMENT OR CONTRACTS ON ANY MATTER; PROVIDING FOR REPEALER, SEVERABILITY, CODIFICATION, AND EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1. That Miami Beach City Code Chapter 2, Article VII, Division 2 thereof, is hereby amended by the creation of the following Section 2-462 entitled "Prohibiting Members of City Commission from having certain post-service contracts with City" to read as follows: Sec. 2-462. Prohibiting eiestsd-e€fisiais Members of City Commission from having certain post-service contracts with City. (a) For a period of two vears after leavino City elestes{ service. no member of the City Commission shall be eli4ible to serve as employee, independent contractor, or agent for the City. or otherwise enter into any contract (other than for voluntary non-cemeencatpd (b) The provisions of this ordinance shall apply to all individuals elected or appointed/re- elected or re-appointed to serve on the Citv Commission subseauent to the effective date of this ordinance. (c) The repuirements of this Section maybe waived by afive-sevenths vote of the City Commission upon a finding by the City Commission that the public interest would be served by such waiver. SECTION 2. REPEALER. All ordinances or parts of ordinances in conflict or otherwise redundant herewith, be and the same are hereby repealed. If any section, sentence, clause or phrase of this ordinance is held to be invalid or unconstitutional by any court of competent jurisdiction, then said holding shall in no way affect the validity of the remaining portions of this ordinance. SECTION 4. CODIFICATION. It is the intention of the Mayor and City Commission of the City of Miami Beach, and it is hereby ordained that the provisions of this ordinance shall become and be made a part of the Code of the City of Miami Beach, Florida. The sections of this ordinance may be renumbered or re-lettered to accomplish such intention, and the word "ordinance" may be changed to "section," "article," or other appropriate word. SECTION 5. EFFECTIVE DATE. This Ordinance shall take effect the 24th day of October , 2009. PASSED and ADOPTED this 14th day of October , 2009.
