CITY OF MIAMI BEACH, FLORIDA, AMENDING RESOLUTION NO. 2003-25306 WHICH ESTABLISHED THE CURRENT SCHEDULE OF USER FEES FOR VARIOUS PARKS AND RECREATION PROGRAMS AND SERVICES, FACILITY ADMISSIONS AND RENTALS AND OTHER RELATED ACTIVITIES; BY AMENDING THE POOLS PARTY RENTAL FEE TO ENABLE INCOME ELIGIBLE MIAMI BEACH RESIDENTS TO RECEIVE A WAIVER FOR UP TO 100% OF THE ~ ESTABLISHED FIFTY DOLLAR ($50.00) RENTAL FEE AT THE NORMANDY ISLE AND FLAMINGO PARK POOLS, AS SET FORTH IN "ATTACHMENT 1" HERETO; FURTHER ESTABLISHING THAT THE WAIVER SHALL BE A REFUNDABLE FIFTY DOLLAR ($50.00) RENTAL DEPOSIT (NOT INCLUDING STAFFING COSTS), AND THE AMOUNT OF THE WAIVER IS DETERMINED BASED ON THE CITY'S PARKS AND RECREATION DEPARTMENT'S APPROVED VERIFICATION PROCESS FOR SCHOLARSHIPS/ FEE WAIVERS, AS DELINEATED IN "ATTACHMENT 2" HERETO. i WHEREAS, the City of Miami Beach adopted Resolution No. 2003-25306 on July 30, 2003, which established a schedule of user fees for various parks and recreation programs and services, facility admissions and rentals, including a fee for pool party rentals; and WHEREAS, the City of Miami Beach residents wishing to hold parties at the City lof Miami Beach's Flamingo or Normandy Isle Park pools are required to pay a reservation fee of $50.00; and WHEREAS, the Finance and Citywide Projects Committee, upon referral by the Miami Beach Commission on September 9, 2009, discussed the economic impact of waiving the $50.00 party reservation fee at the Normandy and Flamingo Park pools for income eligible Miami Beach residents; and ~ WHEREAS, the Finance and Citywide Projects Committee on September 24, 2009, discussed the methodology and criteria by which any waiver of the fees would be granted, and how reservations would be guaranteed to manage equal access to Normandy and Flamingo Park pools; and WHEREAS, the Finance and Citywide Projects Committee established certain eligibility criterion for a fee waiver, and recommended using a verification process for scholarships/fee waivers, which includes a sliding scale methodology for establishing eligibility consistent with the percentage of the waiver set forth under the sliding scale methodology; and I i WHEREAS, the Finance and Citywide Projects Committee's recommendations were subsequently forwarded to the City Commission on October 14, 2009, and accepted as submitted; and WHEREAS, "Attachment 1" hereto is the amended rental fee schedule which shall allow income eligible Miami Beach Residents to receive a waiver of the fifty dollar ($50.00) rental fee; and WHEREAS, "Attachment 2" is the City of Miami Beach Parks and Rec Department Scholarship Application that must be submitted by income eligible Miami residents in order to receive a waiver of the fifty dollar ($50.00) rental fee. NOW, THEREFORE, BE IT DULY RESOLVED THAT THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and City Commission hereby amend Resolution No. 2003-25306 which established the current schedule of user fees for various parks and recreation programs and services, facility admissions and rentals and other related activities; by amending the pool party rental fee to enable income eligible Miami Beach residents to receive a waiver for up to 100% of the established fifty dollar ($50.00) rental fee at the Normandy Isle and Flamingo Park pools, as set forth in "attachment~1" hereto; further establishing that the waiver shall be a refundable fifty dollar ($50.00) rental deposit (not including staffing costs), and the amount of the waiver is determined based on the City's Parks and Recreation Department's approved verification process for scholarships/fee waivers, as delineated in "attachment 2" hereto. j PASSED and ADOPTED this 9th day of December, 2009. The request to discuss the economic impact of waiving the $50.00 party reservation fee at the pools for income eligible Miami Beach residents was referred to the Finance and Citywide Projects Committee by the City Commission on September 9, 2009. The item was discussed at the September 24, 2009, meeting and concluded with the Committee recommending using the current Parks and Recreation's process for scholarships/fee waivers, including the sliding scale level of waiver depending on proof of eligibility. It was also recommended that the $50.00 fee be a refundable deposit, all or a portion of which would be returned to the resident following their party (depending on the percentage of waiver provided). BACKGROUND Resolution No. 2003-25306, adopted on July 30, 2003, established a schedule of user fees for various parks and recreation programs and services, facility admissions and rentals, including a fee for pool party rentals. A reservation fee of $ 50.00 was established for Miami Beach residents wishing to hold parties at the City's Flamingo or Normandy Isle Parks pools. The reservation entitles and ensures the resident a party location at either the Flamingo or Normandy Isle pools; umbrellas and chairs; and free admission to the pool for up to 25 persons for a maximum of 3 hours. In addition to the reservation fee, patrons are assessed a $ 25.00 per hour staffing fee (min of 4 hours), or a total of $100 for labor charges in order to have one staff at the party to set up, service the party and reset the furniture and clean up the area used. As such, the total cost to rent a portion of the pool deck for a three hour party totals $150.00 plus tax. Residents are entitled to purchase additional blocks of time for an additional $40 per hour. Commission Memorandum Amending Resolution No. 2003-25306 -Pool Party Rentals Page 2 of 2 The request to discuss the economic impact of waiving the $50.00 party reservation fee at the Normandy and Flamingo Park pool for income eligible Miami Beach residents was referred to the Finance and Citywide Projects Committee by the City Commission on September 9, 2009.The item was discussed at the September 24, 2009, Finance and Citywide Projects Committee meeting. At the time of the discussion, Normandy Pool had been rented for parties 29 times, and Flamingo Pool 16 times, for a combined total of 45 parties (FY 08/09). The following is a chart that outlines the fees collected from these rentals at the time of the discussion of this issue. The focus of the discussion at the September 24, 2009, Finance and Citywide Projects Committee meeting was not so much the loss of the revenues, which based on current rentals was not anticipated to be substantial, but the methodology and criteria by which any waiver of the fees would be granted, and how reservations would be guaranteed to manage equal access to the rental opportunities. To assist in the discussion, the Committee members were provided with the City of Miami Beach Parks and Recreation Department's scholarship application, which is used to provide fee waivers (scholarships) for our after school, summer camp and specialty programs. Additionally, the following eligibility criterion for a fee waiver was provided to the Committee: Proof the child is a Miami Beach resident. Does applicant /participant qualify for afree/ reduced school lunch program? If the applicant does qualify, they are entitled to an automatic 50% reduction in the program cost. Additional percentage reductions, up to 100% fee waiver, are granted based on additional information provided, such as income verification, Section 8 subsidy, Medicaid, food stamps or any other government assistance. Income review is based on the current United States Department of Housing and Urban Development, Section 8 Income Limits for this area. Attached for your information is a copy of the current document being utilized. At the conclusion of the discussion, the Finance and Citywide Projects Committee members recommended using the verification process in place for scholarships/fee waivers, including the sliding scale level of waiver depending on proof of eligibility provided and, in cases where waivers are requested, the $50.00 fee will be a refundable deposit, all or a portion of which would be returned to the resident following their party (depending on the percentage of waiver provided). This recommendation was subsequently forwarded to the City Commission on October 14, 2009, and accepted as submitted.
