A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, SETTING A PUBLIC HEARING TO
CONSIDER AN AFTER THE FACT REVOCABLE PERMIT REQUEST BY
THE BETSY ROSS OWNER LLC, OWNER OF THE BETSY ROSS HOTEL,
LOCATED AT 1440 OCEAN DRIVE, TO RETAIN APRE-FABRICATED
CANVAS AWNING THAT EXTENDS APPROXIMATELY FOURTEEN FEET
THREE INCHES (14'-3") OVER AND INTO THE PUBLIC RIGHT OF WAY
WITH A MINIMUM VERTICAL HEIGHT OF SEVEN FEET SIX INCHES (7'-6")
(AS MEASURED FROM THE FINISHED SIDEWALK GRADE).
WHEREAS, the Betsy Ross Hotel, located at 1440 Ocean Drive, was constructed in 1941 by
noted Architect L. Murray Dixon, and is located within the Art Deco Historic District; and
WHEREAS, the Betsy Ross Hotel recently completed a substantial renovation, including
restoration of this historically significant building; and
WHEREAS, the owner, The Betsy Ross Owner LLC has re-introduced the original front
entrance canopy that existed during the 1940's, based upon historic, period photographs, and is
requesting an after the fact revocable permit to retain this structure; and
WHEREAS, the owner, The Betsy Ross Owner LLC request that an after the fact revocable
permit to be approved for the Betsy Ross Hotel to retain the pre-fabricated canvas awning that
extends approximately fourteen feet three inches (14'-3") over and into the public right of way
with a minimum vertical height of seven feet six inches (7'-6") (as measured from the finished
sidewalk grade).
WHEREAS, pursuant to the City's requirements for considering revocable permits, the
Mayor and City Commission are required to set a public hearing to consider the aforestated
request.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and City Commission hereby set a
public hearing to consider an after the fact revocable permit request by The Betsy Ross Owner
LLC, owner of The Betsy Ross Hotel, located at 1440 Ocean Drive, to retain apre-fabricated
canvas awning that extends approximately fourteen feet three inches (14'-3") over and into the
public right of way with a minimum vertical height of (7'-6") from the finished sidewalk grade;
said hearing is hereby called to be held before the Mayor and City Commission in their
Chambers on the Third Floor of City Hall 1700 Convention Center Drive, Miami Beach, Florida,
on January 13, 2010, and the City Clerk is hereby authorized and directed to publish
appropriate notice of the said Public Hearing in a newspaper of Miami Beach, at which time and
place all interested parties will be heard.

Item Summary/Recommendation:
The Betsy Ross Hotel, constructed in 1941, was designed by noted Architect L. Murray Dixon. Historic
photographs from this period capture the eloquent architectural feature of the original canvas awning
which extended over and into, the public Right-of-Way (ROW) (see Attachment A). The currently built
canvas awning, which emulates the former design, extends over and into the public ROW with two (2)
fixed vertical support columns attached to two (2) steel base plates embedded into the public sidewalk.
The Betsy Ross Hotel is classified as `Contributing' in the Miami Beach Historic Properties Database and
is located within the National Register Architectural District and the Ocean Drive / Collins Avenue Local
Historic District. The style of the building is very unique and commonly referred to as `Colonial Deco',
given its contextual surroundings of historic Art-Deco buildings and the fact that the architect was one of
the most prolific designers of Art-Deco and Streamline Modern Architecture during this period in Miami
Beach.

ADMINISTRATION RECOMMENDATION
The Administration recommends setting a public hearing to consider an after-the-fact revocable
permit request by the Betsy Hotel Southbeach to retain a built entrance canvas awning that appeared
in historic photographs during the 1940s Art-Deco period in Miami Beach.
