CITY OF MIAMI BEACH, FLORIDA, APPROVING, FOLLOWING A
DULY NOTICED PUBLIC HEARING, THE PLACEMENT OF A
MEMORIAL PLAQUE IN THE WASHINGTON AVENUE DOG PARK,
LOCATED AT 225 WASHINGTON AVENUE, MIAMI BEACH, FLORIDA,
HONORING THE LATE REBECCA PROBUS IN ACCORDANCE WITH
SECTION 82-504 OF THE MIAMI BEACH CITY CODE AND
ACCEPTING THE ARTS IN PUBLIC PLACES (AIPP) COMMITTEE'S
RECOMMENDATIONS REGARDING THE MEMORIAL PLAQUE AT
THE COMMITTEE'S OCTOBER 27, 2009 MEETING; FURTHER
AUTHORIZING THE ACCEPTANCE OF A DONATION FROM CARLA
PROBUS AND JONAS MEYERS (SOUTH POINTE NEIGHBORHOOD
RESIDENTS) IN THE AMOUNT OF $10,000 FOR THE PLACEMENT
OF THE MEMORIAL PLAQUE HONORING THE LATE REBECCA
PROBUS AND ACCEPTING ADDITIONAL FUNDS IN THE ESTIMATED
AMOUNT OF $30,000.00 FROM OTHER INTERESTED INDIVIDUALS
WISHING TO MAKE DONATIONS TO THE WASHINGTON AVENUE
DOG PARK PROJECT BY PURCHASING BRICKS AND/ OR
CONCRETE SLABS IN THE WALKWAY OF THE DOG PARK FOR A
TOTAL ESTIMATED DONATED AMOUNT OF $40,000 TO BE
APPROPRIATED TO THE PREVIOUSLY ALLOCATED $60,836
BUDGET FOR THE WASHINGTON AVENUE DOG PARK PROJECT,
TO BE USED FOR IMPROVEMENTS TO SAID PARK.
WHEREAS, Jonas Meyers and Carla Probus, residents of the South Pointe
neighborhood and users of the City's dog parks, generously offered to donate $10,000 towards
the costs of construction of a water feature for the Washington Avenue Dog Park ("Dog Park"),
conditioned upon the placement of a memorial plaque honoring Mrs. Probus' mother, the late
Rebecca Probus; and
WHEREAS, Rebecca Probus, who passed away in 2001, was a community activist in
her hometown of Louisville, Kentucky, and was involved in historic preservation, community
gardening and beautification, local government, and supported the quality of life issues that
improved her city; and
WHEREAS, Carla Probus has taken an active role to support the Washington Avenue
Dog Park and believes that making contributions in her community, where it is going to do the
most good and be enjoyed by the residents of the community, is one of the best contributions to
be made in her mother's memory; and
WHEREAS, the memorial plaque in honor of Rebecca Probus would be in compliance
with the City's established procedures for such placement, as illustrated in Exhibit A, which is
attached hereto and incorporated herein, which provides a conceptual layout of the memorial
plaque to be installed; and
WHEREAS, at the June 3, 2009 Commission meeting, the issue of a dog park at South
Pointe Park was discussed and, following the discussion, the City Commission approved an
action that established an enclosed dog park at Washington Park, south of the old library
building, and appropriated $60,836 to complete the work; and
WHEREAS, included in the City Commission's action was the directive for the
Administration to work with the Responsible Dog Owners ("RDO") and other interested parties in
the community to obtain input towards the design and layout of the new Dog Park; and
WHEREAS; since the June 3, 2009 Commission approval, the Administration, RDO
representatives, and members of the community met on three occasions to discuss the layout
and design of the Washington Avenue Dog Park and expressed that this park should be
"something special" and should include some amenities that are in addition to those that are
found in other dog parks; and
WHEREAS, specifically, it was expressed that the Dog Park should have a water feature
for the dogs to play in, and a unique street crosswalk unifying the newly constructed Dog Park
with the existing dog park across the street; and
WHEREAS, it was made clear by the Administration that the funding approved by the
City Commission did not include these amenities and therefore such enhancements would need
to be paid for by other non-city sources and, in response, the community has worked with the
Administration to accomplish the following three-prong fundraising approach:
a) Jonas Meyers and Carla Probes, residents of the South Pointe neighborhood
and users of the City's dog parks, generously offered to donate $10,000 towards
the costs of construction of a water feature for the dog park, conditioned upon the
placement of a plaque honoring Mrs. Probes' mother;
b) Individual bricks with engraving (dog name, etc.) to be sold for $125.00 each;
and
c) "Grauman's Chinese Theatre" concept, whereby donors would purchase a "slab"
in the walkway at a donated cost of $1,000 each and have their dog's paw
imprints in the cement with their dog's name; and
WHEREAS, this matter was first discussed at the Neighborhoods/Community Affairs
Committee meeting held on October 7, 2009, and, at this meeting, the Committee did not make
a recommendation and ultimately referred the item back to the City Commission for direction
and, in order to keep the process moving forward, the Committee asked that the Administration
refer the item to the Arts In Public Places Committee (AiPP) prior to the referral back to the City
Commission; and
WHEREAS, the issue concerning the memorial plaque and brick walkway was
discussed at the AiPP Committee meeting of October 27, 2009, where the AiPP Committee
provided recommendations to the memorial plaque project with the recommendation that the
font on the Probes memorial plaque be changed to the standard font utilized by the City (Futura
std. light) which modification is reflected in the attached Probes memorial plaque layout in
Exhibit A; and
WHEREAS, following the approval of the Aipp Committee on October 27, 2009, the item
was again referred back to the Neighborhoods/ Community Affairs Committee for discussion at
their November 12, 2009 meeting where a majority of the Committee recommended approval of
the memorial plaque and the proposed brick walkway program; and
WHEREAS, at this time, the estimated Dog Park project cost is $97,152.88, with the
City's allocation of $60,836, leaving a balance of $36,316.88 to be raised by private efforts; and
WHEREAS, the additional funds generated by the Meyers/ Probus donation and the sale
of bricks and slabs in the walkway would need to be appropriated to the project's current budget
in order for the program to be completed.
NOW, THEREFORE, BE IT DULY RESOLVED THAT THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA hereby approve, following a duly
noticed public hearing, the placement of a memorial plaque in the Washington Avenue Dog
Park, located at 225 Washington Avenue, Miami Beach, Florida, honoring the late Rebecca
Probus and accepting the Arts In Public Places (AiPP) Committee's recommendations regarding
the plaque at the Committee's October 27, 2009 meeting; further, the Mayor and City
Commission hereby accept a donation from Carla Probus and Jonas Meyers (South Pointe
neighborhood residents) in the amount of $10,000 for the placement of the memorial plaque
honoring the late Rebecca Probus, and accept additional funds from other interested individuals
wishing to make donations to the Washington Avenue Dog Park project by purchasing bricks
and / or concrete slabs in the walkway of the Dog Park, estimated at $30,000, with the total
donated amount of $40,000 to be appropriated to the previously allocated $60,836 budget for
the Washington Avenue Dog Park project, all to be used for improvements to the Dog Park.

At the June 3, 2009 Commission meeting, the issue of a dog park at South Pointe Park was discussed.
The Commission ultimately approved an enclosed dog park at Washington Park, and appropriated
$60,836 to complete the work. The Administration was directed to work with the community to design the
layout of the dog park. Jonas Meyers and Carla Probus, residents of the South Pointe neighborhood
offered to donate $10,000 towards the cost of construction of the park, conditioned upon the placement of
a memorial plaque honoring Carla Probus' mother, Rebecca Probus, who passed away 2001. Mrs.
Probus was a community activist in her hometown of Louisville, Kentucky, involved in historic preservation,
beautification, local government and quality of life issues. Carla Probus believes supporting the
Washington Avenue Dog Park is an appropriate way of honoring her mother's legacy. The matters of the
memorial plaque, accepting the Probus donation and the memorial brick walkway program were discussed
at the Neighborhoods/Community Affairs Committee meeting of October 7, 2009. The Committee did not
make a recommendation and referred the matter to the full Commission for direction. However, to move
the process forward, the Committee asked that the item be referred to the Arts In Public Places Committee
(AiPP) as is required by the City's Code, Section 82-504. Typically, the AiPP review occurs after
Commission approval. The matterwas heard at the AiPP Committee meeting of October27, 2009, where
it was approved. The item was again heard at the Neighborhoods/Community Affairs Committee's

BACKGROUND
At the January 28, 2009, Commission meeting, the Administration requested the matter of dogs
off leash in City parks and other public properties in general, be referred to the
Neighborhoods/Community Affairs Committee for discussion. Subsequently, there were on-going
discussions at the Neighborhoods/Community Affairs Committee meetings concerning this issue.
At the June 3, 2009 Commission meeting, the issue of a dog park at South Pointe Park was
discussed. Following the discussion, the Commission approved an action that established an
enclosed dog park at Washington Park, south of the old library building, and appropriated
$60,836 to complete the work. Included in the action was the directive for the Administration to
work with the RDO (Responsible Dog Owners) and other interested parties in the community to
obtain input towards the design and layout of the new dog park.

Avenue Dog Park. During the initial discussion, it was expressed by both the RDO and
community that this park should be "something special" and that it should include some amenities
that are in addition to those that are found in other dog parks. Specifically, it was expressed that
the dog park should have a water feature for the dogs to play in, and a unique street crosswalk
unifying the newly constructed dog park with the existing dog park across the street.
!t was made clear by the Administration that the funding approved by the City Commission did not
include these amenities and therefore such enhancements would need to be paid for by other
non-city sources. In response, the community has worked with the Administration to accomplish
the following:

hometown, would feel such community support of the Washington Avenue Dog Park would be
very appropriate and in line with her beliefs in making contributions where it is going to do
good and be enjoyed by the residents. The plaque would be in compliance with the City's
established procedures for such placement, (please see "Exhibit A" proposed Probus
memorial plaque layout).
2. The working group identified other enhancements that exceeded the available funding.
These include an additional bench, a concrete slab surrounding the water feature, a water
collection cistern, and a crosswalk to more visibly link the two parks. Initial estimates indicate
that the water feature elements preferred (as well as associated infrastructure costs to install
the water feature) exceed the $10,000 donation. At the meeting held on August 6, 2009, the
working group agreed to a fundraising goal of approximately $20,000 - $25,000 to cover these
additional costs. The fundraising efforts would focus on a two-prong fundraising approach:
o LEVEL I: Individual "memorial" bricks with engraving (dog name, etc.) to be sold
for $125.00 each. It was agreed the first order would be for 200 bricks. The bricks
would be inlaid in the walkway and other areas of the dog park deemed
appropriate. (please see "Exhibit B" sample of the brick to be sold).
o LEVEL II: "Grauman's Chinese Theatre" concept, whereby donors would
purchase a "slab" in the walkway at a donated cost of $1,000 each and have their
dog's paw imprints in the cement with their dog's name. A conceptual layout of a
typical fundraising slab is depicted on the attached proposed dog park layout.
(please see "Exhibit C").
In addition, it was suggested that the City consider offer naming rights to the park. It was
suggested that the value of this could be $50,000 - $100,000, depending on terms and
conditions. No sponsor has been identified as yet, and any potential sponsor would be forwarded
to the City Commission for discussion, further direction and ultimate approval.
There was also discussion as to how the donated funds would be received/ deposited. The
conclusion was that the City of Miami Beach would develop the format and print the brick
donation order form. The individual brick order form would have both the City and RDO
(Responsible Dog Owners) logos, and indicate that the brick donation is $125.00 (the per brick
cost is $25.00 inclusive of engraving and shipping with the remaining $100.00 as the donation).

A goal of 200 bricks to be sold was established, with the volunteers assuming the responsibility to
"sell" the bricks. All checks and credit card orders would be deposited with and processed
through the City of Miami Beach.
The new Washington Avenue Dog Park as jointly conceptualized by our residents and the
Administration includes the following features:
• Perimeter fencing replacement and restoration;
• New double gated entry with swing gates;
• Installation of a new walkway designed to include inlay bricks and "paw print" slabs as
previously explained;
New striped crosswalk (location to be determined based on County approval) to tie into
the dog park currently located at the RDO across the street;
• Landscape improvements, to include but not be limited to, removal, re-grading, leveling
and grassing of the park; relocation of trees to other areas of the park to provide more
open space; the installation of fabric cloth and recycled pine bark brown mulch as needed;
planting of a hedge around the perimeter fence to soften appearance;
• Installation of a new irrigation system with controller;
• 20' diameter water spray feature with 5 features for dogs; (please see "Exhibit D"
conceptual layout of the water feature);
• A rain water cistern system to collect water to augment the irrigation system;
• New park furnishings to include trash receptacles (2); dog waste bag dispensers (3); park
benches (4); a drinking fountain w/ pet bowl; a donation plaque; and park rules and
regulations signage (please see "Exhibit E" conceptual layout of the Washington Avenue
Dog Park.)
ART IN PUBLIC PLACES REVIEW
Please note that this matter was first discussed at the at the Neighborhoods/Community Affairs
Committee meeting held on October 7, 2009. At this meeting the Committee did not make a

in an effort to keep the process moving forward, the Committee asked that the Administration

CONCLUSION
The estimated project cost is $97,152.88. The City's allocation is $60,836, leaving a balance of
$36,316.88 needed to be raised by private efforts. The additional funds generated by the
Meyers/Probus donation and the sale of memorial bricks would need to be appropriated to the
project's current budget in order for the program to be completed. The interested stakeholders
agree that certain improvements should be prioritized based on available funds.

The Administration recommends that the Commission adopt the attached resolution approving,
following a duly noticed public hearing, the placement of a memorial plaque in Washington
Avenue Dog Park, honoring the late Rebecca Probus in accordance with City Code, accepting
the donation offered by Mr. Jonas and Ms. Probus and appropriating the estimated $40,000
anticipated to be donated to the Washington Avenue Dog Park project. Further, it is
recommended that the prior AiPP review be sufficient to satisfy the code requirements.
