TRUJILLO AND MR. AND MRS. LARRY WYMAN, ALL IN ACCORDANCE WITH SECTION 82-504 OF THE MIAMI BEACH CITY CODE; ACCEPTING THE ARTS IN PUBLIC PLACES (AIPP) COMMITTEE'S RECOMMENDATIONS REGARDING THE MEMORIAL PLAQUES AT THE COMMITTEE'S FEBRUARY 23, 2010 MEETING; AND FURTHER AUTHORIZING THE ACCEPTANCE OF DONATIONS FROM JACKIE LALONDE, STACEY KRUGER, TONY A. TRUJILLO, AND MR. AND MRS. LARRY WYMAN (SOUTH POINTE NEIGHBORHOOD RESIDENTS) IN THE AMOUNT OF $3,000 EACH, FOR A TOTAL OF $12,000, TO BE ADDED TO THE WASHINGTON AVENUE DOG PARK BUDGET FOR THE PURCHASE OF THE FOUR (4) PARK BENCHES AND OTHER IMPROVEMENTS TO THE DOG PARK. WHEREAS, at its December 9, 2009 meeting, the City Commission approved fundraising efforts for the Washington Avenue Dog Park ("Dog Park") that included the sale of individual engraved "memorial" bricks, and the "Grauman's Chinese Theater" concept, whereby donors would purchase a "slab" in the walkway, at a donated cost of $1,000 each, and have their dog's paw imprints in the cement with their dog's name; and WHEREAS, as a result of the community fundraising campaign, some residents who have purchased a brick or concrete flag have also expressed an interest in doing more for the Dog Park; and WHEREAS, Mr. Tony Trujillo and Mr. and Mrs. Larry Wyman, have offered to donate $3,000 each for the purchase of park benches in the Dog Park, conditioned upon the placement of a memorial plaque in honor of their dogs on the park benches, and WHEREAS, as required pursuant to Section 82-564 of the City Code ("Monuments or Memorials"), the matter of accepting the donations for the two park benches, and approval of the placement of the respective plaques recognizing the donations of Mr. Tony Trujillo and Mr. and Mrs. Larry Wyman, was discussed by the Neighborhoods/Community Affairs Committee at its February 16, 2010 meeting; and WHEREAS, during the Committee's February 16, 2010 meeting, the Administration advised the Committee that, subsequent to the preparation of the Commission Committee memorandum, Ms. Stacey Kruger and Ms. Jackie Lalonde also offered to donate an additional $3,000 each for the purchase of two (2) more park benches, in consideration of plaques honoring their parents being placed on the park benches; and WHEREAS, the Committee reviewed the proposals and recommended to forward the establishment of the aforementioned memorials (and donations) to the City Commission; and WHEREAS, City staff forwarded the design and placement of the proposed plaques to the Art in Public Places (AiPP) Committee; and WHEREAS, at its February 23, 2010 meeting, the AiPP Committee approved the four (4) memorial plaques to be placed on the park benches within the Dog Park with the following conditions: • the plaque lettering is Futura; • the actual plaque be 2 '/z" X 7," (as presented to the AiPP members in the handout during the discussion see Exhibit A); • the plaque should be installed on the back of the bench; and WHEREAS, the Mayor and City Commission hereby approve and accept the recommended actions of the AiPP Committee regarding the four (4) memorial plaques to be placed on park benches in the Dog Park; and WHEREAS, at its meeting on March 10, 2010, the City Commission held duly noticed public hearings, in accordance with Section 82-504(a)(6) of the City Code, to consider establishment of the aforestated memorials. NOW, THEREFORE, BE IT DULY RESOLVED THAT THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA hereby approve, following duly noticed public hearings, the Neighborhood/Community Affairs Committee and AiPP recommendations regarding the placement of four (4) memorial plaques in the Washington Avenue Dog Park, honoring Sheldon & Susan Kruger (parents of Stacey Kruger), Lorraine Bolowich (mother of Jackie Lalonde), and dogs owned by Tony A. Trujillo and Mr. and Mrs. Larry Wyman, in accordance with the City Code, and further accept the donations from Jackie Lalonde, Stacey Kruger, Tony A. Trujillo, and Mr. and Mrs. Larry Wyman in the amount of $3,000 each, for a total of $12,000, for the placement of the memorial plaques on the park benches honoring Sheldon & Susan Kruger (parents of Stacey Kruger), Lorraine Bolowich (mother of Jackie Lalonde), and dogs owned by Tony A. The Commission also approved the sale of memorial bricks and flag stones to be located in the park. Some residents who have purchased a brick or concrete flag expressed interest in providing more assistance. Two residents (Mr. Trujillo and Mr. Wyman) generously offered to make donations in the amount of $3,000 each to purchase two park benches. As required per section 82-504, the Administration referred the matter to the Neighborhoods/Community Affairs Committee. The matter was included in the February 16, 2010, Neighborhoods) CommunityAffairs Committee agenda. Between the time of the submission of the committee referral and the meeting, two additional residents (Ms. Lalonde and Ms. Kruger) offered donations of $3,000 each for two more benches; the Committee was informed of these donations at their meeting. The Committee was requested to provide direction on: A) the acceptance of the proposed donations from Mr. Trujillo, Mr. Wyman, Ms. Lalonde and Ms. Kruger; and B) authorization for City staff to forward the proposed plaques directly to the Art in Public Places (AiPP) Committee for their review prior to placement on the Commission Agenda for the public hearings, which would be the final approval, as well as approving a process that allows us to bring future donations for pafk benches directly to the City Commission, after AiPP review, for a public hearing and final approval. The Committee supported the acceptance of the donations and authorized City staff to forward the discussion directly to the AiPP Committee for their review prior to placement on the Commission Agenda for the public hearing, which would be the final approval. The issue was discussed and approved at the AiPP Committee meeting of February 23, 2010. The Administration recommends the Commission adopt the attached resolution. BACKGROUND At the January 28, 2009, Commission meeting, the Administration requested the matter of dogs off leash in City parks and other public properties in general, be referred to the Neighborhoods/Community Affairs Committee for discussion. At the June 3, 2009 Commission meeting, the Commission approved establishing an enclosed dog park at Washington Park, south of the old library building, and appropriated $60,836 to complete the work. The Commission directed the Administration to work with the interested parties in the community to obtain input related to design and layout of the new dog park. Since the June 3'd Commission approval, the Administration and members of the community have worked together to layout and design the Washington Avenue Dog Park. During the initial discussion it was expressed by the community that this park should be "something special" and include some amenities that are in addition to those that are found in other dog parks. It was expressed that the dog park should have a water feature for the dogs to play in and other amenities to make the park unique. Additional unfunded improvements included an additional Commission Memorandum March 10, 2010 Approving Placement of Four (4) Memorial Plaques in Washington Avenue Dog Park & Accepting Donations for park Benches Page 2 of 3 bench, a concrete slab surrounding the water feature, a water collection cistern, and a crosswalk to more visibly link the two parks. It was made clear by the Administration that the funding approved by the City Commission did not include these amenities and therefore such enhancements would need to be paid for by other non-city sources. Previous Commission Action At the December 9, 2009 meeting, following a duly noticed public hearing, the Commission authorized the acceptance of a donation in the amount of $10,000 from Jonas Meyers and Carla Probus, residents of the South Pointe neighborhood and users of the City's dog parks, for the construction of a water feature for the dog park, conditioned upon the placement of a plaque honoring Mrs. Probus' mother. The plaque would be in compliance with the City's established procedures for such placement. Additionally, the Commission approved the fundraising efforts that included individual "memorial" bricks with engraving (dog name, etc.) to be sold for $125.00 each, and a "Grauman's Chinese Theater" concept, whereby donors would purchase a "slab" in the walkway at a donated cost of $1,000 each and have their dog's paw imprints in the cement with their dog's name. Since the December 9`h Commission approval, the residents have established a new group called the SoFi K9s that, among other things, serves as a "friends of Washington Avenue Dog Park" group. The members of the group then actively engaged in fundraising efforts to sell the memorial bricks and the concrete flag stones. As of mid-February, 2010, approximately $30,420, derived from the sale of memorial bricks and concrete flag stones, has been generated. As a result of the community fundraising campaign, some residents who purchased a brick or concrete flag also expressed an interest in providing additional assistance. In January, 2010, Mr. Tony Trujillo and Mr. and Mrs. Larry Wyman generously offered to make a donation in the amount of $3,000 each to cover the cost of the purchase of two park benches for the Washington Avenue Dog Park. As required pursuant to City Code Section 82-504 (Exhibit B), at the February 3, 2010 Commission meeting, the Administration referred the item to the Neighborhoods/Community Affairs Committee for consideration. Neighborhoods/ Community Affairs Committee Action of February 16, 2010 As required in Code Section 82-504, the matter of accepting the donations for the two park benches and approval of the placement of the respective plaques recognizing the donations of Mr. Tony Trujillo and Mr. and Mrs. Larry Wyman was included in the February 16, 2010, Neighborhoods/Community Affairs Committee agenda. In order to continue moving forward with the design and construction of the Washington Avenue Dog Park, which incorporates the ideas and input of our residents, the Administration requested that the Neighborhoods/ Community Affairs Committee discuss and provide direction on the following issues: A) The acceptance of the proposed donations from Mr. Tony Trujillo and Mr. and Mrs. Larry Wyman, and authorization for City staff to forward the proposed plaques directly to the Art in Public Places (AiPP) Committee for their review prior to placement on the Commission Agenda for the public hearings, which would be the final approval, instead of requiring the item to go to the Commission first for referral to the AiPP; and B) Approving a process that allows us to bring any future donations for park benches directly to the City Commission, after AiPP review, for a public hearing and final approval. Following a brief discussion, the Neighborhoods/Community Affairs Committee, members supported the acceptance of the donations from Mr. Tony Trujillo and Mr. and Mrs. Larry Wyman, as well as from the two additional donors, and authorized City staff to forward the proposed plaques directly to the Art in Public Places (AiPP) Committee for their review prior to placement on the Commission Agenda for the public hearing, which would be the final approval. The Committee members also approved the Administration to bring future donations for park benches directly to the City Commission, after AiPP review, for public hearings and final approval. The issue of the four (4) memorial plaques to be placed on the park benches was heard at the AiPP Committee meeting of February 23, 2010. Following the discussion, the AiPP Committee approved the four (4) memorial plaques to be placed on the park benches within the Washington Avenue Dog Park with the following conditions. • The plaque lettering is Futura; • The actual plaque be 2 '/s" X 7", as presented to the AiPP members in the handout during the discussion (see Exhibit A); The plaque should be installed on the back of the bench. The estimated cost of the Washington Avenue Dog Park project is $97,152.88. The City's allocation is $60,836. The private funds generated by the Meyers/Probus donation, the sale of memorial bricks and concrete flag stones, combined with the $12,000 in funding donated for park benches to date, represents $40,422.50 in additional funding, for a total project budget of $101,258.50 for improvements to the Washington Avenue Dog Park. Parks staff met with interested individuals, including representatives of SoFi K9 at the park on February 12, 2010 to discuss the current status of the project, and to discuss the amenities that have been previously identified to be funded by this allocation. Conclusion The Administration recommends that the Commission adopt the attached resolution approving, following duly noticed public hearings, the placement of four (4) memorial plaques in Washington Avenue Dog Park, honoring Sheldon & Susan Kruger (parents of Stacey Kruger), and Lorraine Bolowich (mother of Jackie Lalonde), and dogs owned by Tony A. Trujillo and Mr. and Mrs. Larry Wyman, in accordance with City Code, and as recommended by the AiPP Committee at their February 23, 2010 meeting; and further accepting the donations from Jackie Lalonde, Stacey Kruger, Tony A. (a) Whenever there is a proposal to establish a monument or memorial on public property in the city, it shall first be considered and reviewed by the committee according to the following procedures; (1) Any person, organization, association, corporation or other ent~fy, including a member of the city commission or the administration of the city, may propose the establishment of a monument or memorial at any time by submitting a proposal in writing • to the committee. (2) Within a reasonable time after receipt of the proposal, the committee shall meet to consider and review same. Notice of the meeting shall be given to al! persons who have proposed the establishment of the monument or memorial. (3) After reviewing the proposal in accordance with its established selection criteria, the committee shall transmit a written recommendation to the city commission regarding same. (4) The city commission may only consider a proposal to establish a monument or memorial that has been approved by a majority of the members of the committee. (5) Within a reasonable time after receiving the recommendation for the establishment of a monument or memorial from the committee, the city commission shall call a public hearing, (6) Notics of a public hearing regarding the establishment of the monument or memorial shall be published at least 10 days prior to the hearing in a newspaper of general c[rculation in the city. (7) At the close of the public hearing, the city commission may approve the establishment of the monument or memorial. in apptoving the establishment, the commission shall be governed by its established selectien criteria. Add}tionally, any proposal to establish a monument or memorial must.be approved by afive-sevenths vote of the city commission. (8) Upon approval of the establishment of the monument or memorial, the city commission dial] forward the proposal to the art in public places committee. The art in public places committee will then make its recommendation to the city commission regarding the location, aesthetic quality, malntanance, and other related issues, in accordance with the its established criteria.
