MIAMI BEACH REDEVELOPMENT AGENCY (RDA), AUTHORIZING AN
APPROPRIATION OF PREVIOUSLY APPROPRIATEDRbA FUNDS FROM THE

FROM CONSTRUCTION SAVINGS FROM THE NEIGHBORHOOD N0.9A, CITY
CENTER HISTORIC DISTRICT ROW PROJECT, FUND 365, ORIGINALLY
APPROPRIATED AS PART OF THE FY 2007/08 AND FY 2008/09 CAPITAL
BUDGETS.
WHEREAS, the City has identified the need to increase the capacity of a sewer on James
Avenue as a result of growth within the sewer-shed which encompasses the Cultural Campus and
City Center Area; and
WHEREAS, the City conducted a specific flow analysis resulting from flow contributions
from both the W-Hotel and Governor Hotel, and recommends that a 15-inch diameter pipe on
James Avenue, between 17th Street and 19th Street, be increased to 24 inches; and
WHEREAS, staff is negotiating with the W Hotel and the Governor Hotel for a fair and
equitable cost reimbursement formula for the portion of the improvements for which each is
responsible and each entity has committed to reimburse the City, with reimbursementsto the City
Center RDA, Fund 365; and
WHEREAS, this project should be expedited to avoid two construction impacts to this
street and to save added mobilization costs, since the City Center ROW Improvements Project is
now under construction and includes this section of James Ave; and
WHEREAS, a proposal has been negotiated with the City Center contractor, M. Vila &
Associates, Inc.
NOW, THEREFORE, BE IT RESOLVED BY THE CHAIRPERSON AND MEMBERS OF
THE MIAMI BEACH REDEVELOPMENT AGENCY, that the Chairperson and Members hereby
approve an appropriation of previously appropriated RDA funds for the City of Miami Beach Right
Of Way (ROW) Infrastructure Improvements Project for Neighborhood No. 9A, City Center Historic
District, in the negotiated amount of $646,031, to provide for construction and contingency of the
24-inch PVC Sanitary Sewer Improvements Capital Project from the FY2009/10 Capital Budget,
within the City Center Historic District; with funding for same available from construction savings
from the Neighborhood No. 9A, City Center Historic District ROW Project Fund 365, originally
appropriated as part of the FY 2007/08 and FY 2008/09 Capital Budgets.

In a separate effort from the Historic City Center Infrastructure Improvements Project, the City has identified the
need to increase the capacity of a sanitary sewer pipe on James Avenue. The warranted increase in capacity of
this sewer pipe was not yet needed or identified during the design phase of the Historic City Center Project. The
Historic City Center bids opened on March 16, 2009. While Historic City Center was in design from October 2005
to April 2008, the City was experiencing accelerated development activity. A Sanitary Sewer Evaluation Survey,
conducted by CDM in August 2008, recommended capacity increases as a result of growth anticipated within the
sewer-shed which encompasses the Cultural Campus and Historic City Center area. However, the specific capacity
increases as well as locations within the distribution system could not be fully ascertained until the City was able to
conduct a flow analysis resulting from specific flow contributions from both the W Hotel and Governor Hotel. On
June 19, 2009, CDM completed an analysis of the sewer basin and recommended that a 15-inch diameter pipe on
James Avenue between 17t" Street and 19`" Street be increased to 24 inches in diameter. To expedite the Project
execution, the sanitary sewer improvements were designed in-house, and it was decided to be in the best interest
of the City to add the installation of the 24-inch sanitary sewer pipe to the Historic City Center Project as a change
order. Installation of the entire underground infrastructure, including the 24-inch sewer main before the contractor
starts and finishes the above ground work, will eliminate the need to excavate and repave the street twice and will
save the City approximately 35% by executing the Project by a change order to the already mobilized Historic City
Center contractor, than by advertising, selecting and awarding astand-alone contract.
Staff is negotiating with the W Hotel and the Governor Hotel for a fair and equitable cost reimbursement formula for
the portion of the improvements for which each is responsible. Discussions began last yearwith these entities, and
they have committed to reimburse the City with reimbursements to the City Center RDA, Fund 365. Their
Certificates of Occupancy are contingent upon payment of the negotiated share of the cost.
To meet this timeframe, the Project has been expedited through in-house design and permitting by the Public
Works Department, Engineering Division. The CIP Office with participation of the Special Assistant to the City
Manager negotiated a final price of $587,301 with the City Center contractor, M Vila & Associates. Inc., including a
10% contingency of $58,730; the total appropriation for the additional work is $646,031.

ADMINISTRATION RECOMMENDATION
Adopt the Resolution.
FUNDING
An appropriation of $646,031 in previously appropriated funding from the Neighborhood No. 9A
City Center Historic District ROW Project Construction Savings, Fund 365.
ANALYSIS
The City Center Historic District Neighborhoods Improvements Project (City Center No. 9A) did
not have any sanitary sewer improvements in its scope of work. The City Center No. 9A project
had a complete design and was advertised on February 5, 2009 with bids opened on March 16,
2009. While the City Center No. 9 Project was in design from October 2005 to April 2008, the
City was experiencing accelerated development activity. A Sanitary Sewer Evaluation Survey,
conducted by CDM, in August 2008, recommended capacity increases as a result of anticipated
growth within the sewer-shed which encompasses the Cultural Campus and Historic City Center
area. However, the specific capacity increases as well as locations within the distribution system
could not be fully ascertained until the City was able to conduct a flow analysis resulting from
specific flow contributions from both the W Hotel and Governor Hotel. On June 19, 2009, CDM
completed an analysis of the sewer basin and concluded that the capacity of the sanitary sewer
collection system along James Avenue would be inadequate to sustain future sanitary sewer
flows resulting from development and land use modifications in the Historic City Center and the
Cultural Campus area: such as the W Hotel and the Governor Hotel. They recommended that a
15-inch diameter pipe on James Avenue between 17th Street and 19th Street be increased to 24
inches in diameter. These recommended improvements were then submitted as a separate

capital project, the 24-inch PVC Sanitary Sewer Improvements Project (the Project), and
subsequently adopted in the FY2009/10 Capital Budget, to be funded with future Water and
Sewer Bonds. To expedite the Project execution, the sanitary sewer improvements were
designed in-house, and it was decided to be the best interest of the City to add the installation of
the 24-inch sanitary sewer pipe to the City Center No. 9A project as a change order. Installation
of the entire underground infrastructure, including the 24-inch sanitary sewer main before the
contractor starts and finishes the above ground work will eliminate the need to excavate and
repave the street twice and will save the City additional mobilization and general overhead
costs. Plans were first provided to the City Center No. 9A contractor and to permitting agencies
in November 2009. Required design changes were completed in March 2010.
The rationale to integrate these two distinct scopes was adopted in the interest of completing
both projects under a single construction effort in order to ensure that the street and the
residents are impacted only once as well as allowing the City to save additional money by
reducing unwarranted mobilization costs. To meet the aggressive timeframe required to dovetail
this construction with that of City Center No. 9A, the Project has been expedited through in-
house design and permitting by the Public Works Department, Engineering Division. The CIP
Office then negotiated a price with the Historic City Center contractor, M Vila & Associates, Inc.
The original change order cost proposal totaled $686,000 including the construction cost and a
10% contingency. After negotiations and revisions to the scope, M. Vila & Associates, Inc.
submitted an acceptable proposal with a construction cost of $587,301 (Attachment A).
Including a 10% contingency of $58,730, the total appropriation is $646,031. The proposal has
been reviewed and approved by the Special Assistant to the City Manager. It is estimated the
approximately 35% in savings would be realized by installing the 24-inch sanitary sewer main by
a change order to M. Vila and Associates contract than by advertising, selecting and awarding a
stand-alone project.
Staff is negotiating with the W Hotel and the Governor Hotel for a fair and equitable cost
reimbursement formula for the portion of the improvements for which each is responsible.
Discussions began last year with these entities, and they have committed to reimburse the City,
with reimbursements to the City Center RDA, Fund 365. Their Certificates of Occupancy are

CONCLUSION
The Administration recommends that the Mayor and City Commission authorize the City to
appropriate funds in the amount of $646,031 from previously appropriated RDA funds for the
Sanitary Sewer Improvements along James Ave from 17th Street to 19`h Street, with the source
of appropriation to come from construction savings from the Neighborhood No 9A City Center
Historic District ROW Project Fund 365, originally appropriated as part of the FY 2007/08 and
FY 2008/09 Capital Budgets.
