A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY
OF MIAMI BEACH, FLORIDA, APPROVING AND OFFICIALLY ADOPTING
THE BASIS OF DESIGN REPORT (BODR) FOR THE MIAMI BEACH
BOTANICAL GARDEN PROJECT (PROJECT) WITH FUNDING PROVIDED
FROM THE PREVIOUSLY APPROPRIATED GENERAL OBLITGATION
BOND FUND AND CITY CENTER RDA FUNDS
WHEREAS, the Miami Beach Botanical Garden opened to the public on October
31,1962,as a Miami Beach City Park; and
WHEREAS, over the next two decades, the Botanical Garden served the City of Miami
Beach as a vital community resource; and
WHEREAS, art and. cultural programming catalyzed a positive transformation in the
Park, as it became the home of "Arts in the Garden", hosting from small theatrical productions to
contemporary art exhibitions, while also becoming an integral part of the Boat Show and Art
Basel ;and
WHEREAS, ''one of the Conservancy's primary goals is to achieve accreditation of ~ the
Miami Beach Botanical Garden through the American Association of Museums (AAM); and -
WHEREAS, historically, the City has provided basic services to the Park under the terms
of the Conservancy Management Agreement; and ,
WHEREAS, :the Miami Beach :Botanical Garden relies heavily on the support of
volunteer groups to organize the educational- programs, as well as develop- the-horticultural- and - = - -----
physical enhancements to the site; and
WHEREAS, is total of $1,380,753, is currently available for design and construction of
this project from the Series 2000 General Obligation Bond and City Center RDA funds; and
WHEREAS, ~ on June 25, 2008, the Mayor and the City Commission approved the
issuance of Request for Qualifications (RFQ) No. 36-07/08, for the Planning, Architectural,
Engineering, and Landscape Architectural services in connection with the ~Plarining, Design, Bid
and Award,. and Construction Administration services at a cost not to exceed .$125,000, based
on a project cost not to exceed $1.1 Million; and
WHEREAS, ~ Raymond Jungles Inc., (RJI) was retained to perform architectural,
,.
engineering, and landscape architecture services for the Miami Beach Botanical .Garden project
. , on September 10, 2008; and
WHEREAS, the Consultant's Notice to Proceed (NTP) for 'the ~ Planning Phase was
issued on or before April 13r 200.9; and
WHEREAS, ;on July 21, .2009, the Consultant conducted a limited Community Design
Workshop (CDW) with board members of both the Conservancy and the Holocaust Memorial;
and
. WHEREAS, the Consultant conducted a Community Design Workshop (CDW), wherein
the proposed .improvements are recommended to be implemented in four (4), phases (1, 2, 3,
and 4) for the Miami Beach Botanical Garden; and
WHEREAS, the total estimated construction cost to implement phases 1, 2, and 3, of the
master plan is $2,148,044; and '
WHEREAS, the current funding budget shortfall to implement phases 1, 2, and 3,
_ inclusive of funding for Art in Public Places (AiPP), CMB fees, and Construction Contingency is
$721,..227, a fourth. phase as identified in the. BODR but does.n.ot require funding from the City;
and
:NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby approve and
officially :.adopt the, Master Plan for the .Miami Beach Botanical Garden _ Project. The
Administration also seeks a recommendation to pursue the completion of the construction
documents for- all three {3) phases with the intent that the construction documents include the
proposed phase 1 and 2 work to be implemented simultaneously and that phase 3 work be
illustrated as future work

The Miami Beach Botanical Garden opened to the publicon October 31, 1962, as a Miami Beach City Park. Overthe

the Conservancy's primary goals is to achieve accreditation of the Miami Beach Botanical Garden through the
American Association of Museums (AAM). To this end,.'it has been working with the City in defining the scope of
capital improvements to achieve this goal. Originally, a total of $1.5 Million was allocated from the Series 2000
General Obligation Bonds to undertake the improvements. In July, 2003, following an RFQ selection process, EDAW
was selected to undertake the planning and design of the facility. Contract issues between EDAW and the City led to
EDAW's eventual termination for convenience, and the' project being put on hold' until additional funds could be
identified and/or the scope revisited. A total of $1,426,817 is currently available for design and construction of this
project from the Serie°s 2000 General Obligation Bond an'd City Center RDA funds. On June 25, 2008, the Mayor and
City Commission approved the issuance of Request for Qualifications (RFQ) No. 36-07/08, for the Planning,
Architectural, Engineering and Landscape Architectural services at a cost not to exceed $125,000 for certain
improvements to the Miami Beach Botanical Gardens Project (Project), based on a, project cost not to exceed $1.1

On July 14, 2008, the'RFQ was issued with an opening date of August 14, 2008. Apre-proposal meeting was held on
July 29, 2008, along with a site visit conducted with all prospective RFQ respondents held on August 5, 2008.
On August 25, 2008, pursuant to Evaluation Committee (Committee) appointments made via Letter to Commission
(LTC) No.195-2008, the Committee members convened!and unanimously selected'RaymondJupgles, Inc., (RJI) as
the top-ranked firm, Savino 8~ Miller Design Studio as.the second-ranked, and Arquitectonica as the third-ranked.
On September 10, 2008, the City Commission authorized, Resolution No.2008-26873, (Agenda item C7C), approving
and authorizing the Mayor and City Clerk to execute a professional services agreement with Raymond Jungles, Inc.,
in an amount not to exceed $125,000, for architectural,iepgineering, and landscape architecture services for the
master planning, design, bid and award, and construction administration services in an amount not to exceed
$125,000, for professional services .and an approved reimbursable allowance of $5,000, for a total .not to exceed
amount of $130,000.The draft BODR describes the proposed improvements to the garden to be implemented in four
(4) phases,. with only 2 phases currently fully funded by the City. The total cost for construction only, to implement the
entire master plan is estimated to cost $2,148,044. Currently, there are funds available to implement only Phases 1
and 2. The Administration seeks a recommendation to pursue the completion of the construction documents for all
three (3) phases with the intent that the construction documents include the proposed Phase 1 and 2 work to be
implemented simultaneously and that the Phase 3 work be~illustrated as future work. The costs associated with
Phase 3 will be identified as a capital budget to be considered as part of the capital budget process for fiscal year
2010/2011. r

significantly impacted the park, community interest was reinvigorated with the creation of
The Miami Beach Garden Conservancy (Conservancy). Art and; cultural programming
catalyzed a positive transformation in the park, as it became the home of "Arts in the
Garden". Following the onset of this program, the Botanical Garden Chas hosted, from small
theatrical ..productions to contemporary art~exl-iibitions, while also becoming an integral part
of the "Boat Show" and "Art Basel". Historically, the City has provided basic services to the
Park under the terms of the Conservancy Management Agreement. However, the Botanical
Garden relies heavily on the support of volunteer groups to organize the educational
programs, as well as develop the horticultural and physical enhancements to the site.

Upon renewal of the Conservancy's Managemenjt Agreement on January 17, 2007] the City
Commission directed the Administration to assisfthe Conservancy in utilizing the remaining
GO Bond funds to proceed with the Project. ;Following the .termination with EDAW, '

Initially, it was de~terrnined that the Conservaricy, acting in the capacity of a developer, would
undertake the P~roiect on behalf of the City. ~ It was subsequently decided that given the
~Iimited funds with which to undertake the improvements, itwou.ld be in the City's best interest

. The;Conservancywas a so determined~to engage a world renowned landscape architect fo
further develop ;the design and. proceed with an internal Request-for-Proposals {R1=P)
process, which resulted in the selection of the. land cape design firm of Raymond Jungles,
Inc., (RJI). Since. the. City had already selected the firm of Gurri ;Matute as the primary
consultant from :the active rotating list, it was, determined that RJI would work as the sub-
'consultant ,on the Project. Subsequent negotiations between th'e two firms over their
respective scopes and fees failed to~ produce a proposed contract price that was acceptable

.location makes it a most invisible. despite its cultural importance. The intersection of Meridian
Avenue and Dade Boulevard, two main arteries running through Miami Beach, defines the
northwest corner of the site, offering unique opportunities, in terms. of connections to the
arts, culture and education: The Botanical Garden site is zoned "CCC"- Convention Center

.Project Kick-off meeting to a limited Design Workshop (CDW) with board members .of both
the Conservancy and the Halocaust Memoria'I held on July 21, 2009.
The draft BODR (Attachment 1) describes the proposed improvements to the garden to be
implemented in four (4) phases. The total estimated construction cost to implement phase 1,
2,~ and 3 of the master plan is $2,148,044. The; current construction funding budgef shortfall
to implement Phases 1, 2, and 3;. inclusive of ;funding for Art in Public Places (AiPP), CM$
fees;. and Construction contingency is $721,227 (Attachment 2}. A fourth phase is identified
in the master plan but does not require funding from the City. The individual four (4) phases
of the. master -plan implementation are described below with their ±corresponding cost of
implementation as folllows:

Phase 1 ($899:580, without 10% contingency allowance) a

In this phase, the design elements consist of the demolition of existirig hardscape features, .
as well as som:e~ structural elements in preparation for the proposed hardscape features
(paths, sidewalks, plazas, patios, etc.); as well as addressing the southeast border of the
'propertywhere~a new entry plaza is proposed;. The design requiresthe removal of certain
.portions of the existing.fence in an effort to .reuse and relocate it within other key areas of the
plan. This phase will also require the proposed oolite monolithic wall jfeatures (refer to page
40 of Attachment 1, for site details) at the proposed entry to be set in !place, as a vital part of
the overall design intent which will aid in buffering key disturbances along the site's
perimeter-s. 1suture phases will incorporate remaining proposed oolite features along the
south. and east perimeter. Along with the proposed entry wall and plaza, a new entry gate will
be a necessity to complete this perimeter enhancement: !

Another main design feature in Phase 1 of the master plan is the proposed central pond and
water garden, which will need to be implemented immediately to stay in harmony with the
overall design, intent, thus facilitating the construction of the future phases. To help rid the
buildings of clutter and .circulation constraints,, the design requires the construction of a
proposed shade .structure located at the northeast. corner and away from the existing
structures for storage anal maintenance. The Landscape Architect.~has proposed to install
the overhead shade element in this phase and hold off on the actual structure for future
phasing. This will reduce costs and lower the; risk of disturbance in future phases.

The last few details pertaining to Phase 1 wi'11 consist of landscape planting, landscape
irrigation and. lighting. This phase will require seventy-five percent (75%0) of the overall
proposed plantings fo be set in place as well as any landscape irrigation that will be .needed
. ~to maintain these landscape plantings. These areas wil'I incorporate{ all perimeter plantings
. ~ ~ within the fencing material; the great lawn~feature and various water feature plantings: Also,
- ~ ~ necessary lighting fixtures -will be replaced. and added. as .per the design intent.

character of the garden site and. help achieve.the design intent. The:additional phases, when ~ .
implemented, will reinforce the overall` design° intent of Raymond 'Jungles Inc.

_ garden; installation of the remaining proposed oolite monoliths along south and east walls;.
along with the relocation and placement of existing fencing material, trellis work along the
. ~ south wall, repainting existing buildings and adding linear bench features throughout the
.~ garden. ;-

The;oolite monoliths will complete the character along the eastern' perimeter and help to
. ~ provide a much needed buffer between the: undesirable' public transportation along the
southern perimeter (bus staging area), and th;e garden. The jagged fence design along the
eastern perimeter will provide opportunities for additional.. planting to take ..place; thus
~. extending .the r garden out. This will serve; to encourage small public spaces to be
incorporated while inviting u:~ers to the garden. The trellis work along the., south wall. will be a
. ,~ ~sculpturai element that provides shade and shelter to those waiting for public transportation.
Another vital element of Phase 2 would require the existing buildingSs on site to be painted.
The design intent would' require painting the buildings to act~as a :backdrop for the planting
material set forth in the design. And finally, the placement of various Linear benches would
add to the aesthetic quality of the garden, while creating great places to relax and,enjoy the
..wonders of the; garden. This phase has an estimated construction total value of $227,549,
inclusive. of an additional 10 percentfor a contingency allowance in the construction phase.

Phase 3 ($647.,320, without 10% continaencv allowance
This phase, will primarily address the Collins Canal proposed. improvements which. have .
been in the past ignored as part of the garden. After meeting with MBBG board members,
everyone expressed their excitement of incorporating Collins.Canal~as part of the garden. In
preparation fo ~ Phase 3, the demolition of existing walks along the canal will be necessary to
- make way for the proposed hardscape plans for this area. Any and all site preparations
including excavation, planl: relocation and 'power line- relocation will be necessary to
:complete,. this phase, as ,per the design intent. Site elements such as the .proposed roll-up
.gates and benches will be implemented as described in the master plan. Lighting will be the
last amenity within this phase. Lighting, has been budgeted within thie cost estimate but has
yet to be designed. The estimate of probable cost for this phase is estimated to'be $712,052
' inclusive of an additional 10 percent for a contingency allowance in the construction phase.

It is recommended that a Re solution of the Mayor and City Commission of the City of Miami -
Beach, Florida ~, approving and officially adopting the. Master Plan LLfor- the Miami Beach
Botanical Garden Project be approved. The Administration also seeks arecommendation -
to pursue the completion of: the construction documents for all three (3) phases with the
intent that the construction documents include the proposed Phase 1' and 2 work to be
- ~ implemented sim.ultaneouslysnd tha# the Phase 3 work be illustrated as future work. The
`costs associated withPhase 3 will be identified as a capital budget to be considered as part.
of the capital b ~ dget process.
