A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, APPROVING ADDITIONAL
CONTINGENCY FUNDING, IN THE AMOUNT OF $469,175.21, FOR
THE CONSTRUCTION CONTRACT WITH HORIZON CONTRACTORS,
INC., FOR THE CONSTRUCTION OF THE SOUTH POINTE PHASE II
RIGHT OF WAY INFRASTRUCTURE IMPROVEMENT PROJECT, TO
FUND THE CONSTRUCTION OF ADDITIONAL CITY REQUESTED
ITEMS; WITH FUNDING AVAILABLE FROM PREVIOUSLY
APPROPRIATED SOUTH POINTE CAPITAL FUND 389.
WHEREAS, on December 10, 2008, pursuant to Invitation to Bid No. 48-07/08,
Commission approved the award of a construction contract to Horizon Contracts
(Contractor), in the amount of $7,683,901, for the construction of the South Pointe
Right of Way Infrastructure Improvement Project (Project); and

WHEREAS, on May 4, 2009, the Contractor was issued the Notice to Proceed to
mobilize and commence construction activities; and ~
WHEREAS, the Project is scheduled to be substantially complete by November 2010;
and
WHEREAS, during the construction of the Project, additional scope of work was
requested by the City, and
WHEREAS, the added scope of work includes the use of a permeable bound g
aggregate (Adapave, or approved equal), together with the Healthy Tree Fertilization S~
(HTFS); and '
WHEREAS, inline check valves will also be substituted for the mechanical gate
specified in the original scope of work; and
WHEREAS, the valves are intended to keep tidal surcharge from impacting the area
east of Alton Road; and
WHEREAS, the milling and resurfacing of the south half of 2nd Street, from
Washington Avenue to Alton Road, was not included in the original Project boundaries; hand
the existing grades at the intersection of 2nd Street and Meridian Avenue were found to
exceed the minimum standards; and ~
WHEREAS, the original scope of work includes irrigation bubblers and spray heatls for
trees and ground cover, and no irrigation was planned for the "swale areas" due to the lack of
funding at the time of the design, and ~
WHEREAS, the original Project contingency appropriation was $768,390.00; i the
Administration hereby requests that an additional $469,175.21 (for a total contingency of
$1,237,565.21) be added to fund the aforestated City requested changes; and
WHEREAS, funding is available from previously appropriated South Pointe Capital Fund
389 for this additional scope of work.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMI
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission
approve additional contingency funding, in the amount of $469,175.21, for Horizon Conti
Inc., for the construction of the South Pointe Phase II Right of Way Infrastructure Impro~
Project, to fund the construction of additional City requested items; with funding availab
previously appropriated South Pointe Capital Fund 389.

Item Summa /Recommendation:
On December 5, 2008, the City Commission approved the award of a construction Contract to Horizon
Contractors, Inc., for the construction of the South Pointe Phase II Neighborhood Improvement Project.
During the construction of the Project, additional scope of work was added to Horizon's contract
for the betterment to the overall project as requested by the City. The items that were added are
as follows:

The Administration recommends the implementation of the additional owner requested items and
betterment requests for the South Pointe Phase II Project and requests that additional funding in
the amount of $469,175.21 be added to project contingency to~allow for this work to be pe-formed.
This funding is available from South Point Capital Funds previously appropriated for in the Fiscal
Year 2007-2008, Capital Budget for the Project.

ADMINISTRATION RECOMMENDATION
Approve the additional contingency fund.
FUNDING
Funding is available in the amount of $469,175.21, previously appropriated for in the Fiscal
Year 2007-2008, Capital Budget, for Construction of the Project as follows:
Account No. 389.2332.069357 - $469,175.21
ANALYSIS
On December 10, 2008, the City Commission approved the award of a construction contract
to Horizon Contractors, Inc. (Horizon) in the amount of $7,683,901, for the construction of
the South Pointe Phase II Right of Way Infrastructure Improvement Project. Project
Contingency in the amount of $768,390, was also made available for the Project
contingency fund.
The Project limits include the area bounded to the north by Fifth Street, to the south by
Second Street, to the east by Washington Avenue and to the west by Atton Road, excluding
Third Street. The Project scope of work includes the replacement of approximately 5,610
linear feet of existing water lines within the alleyways and along 4th Street to enhance the
water distribution system pressure; the installation of new storm water infrastructure to meet
the Master Plan recommended Level of Service (LOS) throughout the project area which
includes approximately 6,160 linear feet of storm drainage collection pipe, approximately 130
drainage structures, andtwenty-one (21) gravity wells; streetscape improvements, including
traffic calming measures and enhanced pedestrian access, bump-outs and defined
neighborhood entrances; landscaping; pedestrian lighting and parking improvements.
On May 4, 2009, the contractor was issued the second Notice to Proceed (NTP) to mobilize
and commence the construction activities. The installation of the water mains included in the
original scope of work, and the added scope of work (the installation of a 12-inch diameter
water main on 4~' Street from Jefferson court to Washington Avenue) is complete. The water
mains included in the original scope of work have been placed into service, and the water
main included in the new scope of work have been approved to be placed into service by the
by the Department of Health (DOH). The work currently in progress includes the placement
of the new water meter boxes which are primarily located in the alleyways.
The storm water drainage system is 95% complete. The City received the DERM Class V
dewatering permit on June 14, 2010, and Horizon commenced the cleaning and testing of
the storm water system on June 28, 2010.Once the system has been cleaned, tested, and
approved by the City, the final lift of asphalt will be placed throughout the project area. The
project street lighting is complete and inspections are in progress for final acceptance by the
City. Landscaping and original irrigation improvements are 85% complete, pending testing
of the irrigation system and acceptance by the City. The overall project is scheduled to be
substantially completed by November 2010.
During the construction of the Project, additional scope of work was added to Horizon's
contract for the betterment to the overall project as requested by the City. The items that
were added are as follows:
Adapave and Healthy Tree Fertilization System
The original contract scope of work specified the installation of concrete tree grates.
During the construction of the Project, the Parks and Recreation Department requested
the use of a permeable bound granite aggregate (Adapave, or approved equal) together
with the Healthy Tree Fertilization System (RTES). The CIP Department consulted with the
City's Planning Department which also recommended and approved the use of the ADA
compliant bound aggregate and HTFS for the tree pit treatment. Horizon submitted a cost
proposal in the amount of $387,098.16 for the installation of this system at 136 tree pits
throughout the project limits; this amount was negotiated down to $340,840.48,
approximately $2,506.18 per tree pit. The City also obtained a credit in the amount of
$152,250 for the concrete tree grate installation. The total additional cost to the Cityfor the
implementation of the City standard tree pit treatment is $188,589.84.
Check Valves in Lieu of Mechanical Gate Valves
During the course of the construction of the storm drainage system, issues were raised
regarding the performance and maintenance requirements for the mechanical gate valves
that were specified by the project team. The City's Public Works Department and
Wolfberg Alvarez and Partners, the design Engineer of Record (EOR) agreed that the use
of inline check valves would be more suitable than the mechanical gate valves specified.
On January 5, 2010, Horizon submitted a proposal for the substitution of the specified six
(6) Neenah 5050 Mechanical Gate Valves and two (2) additional inline check valves. The
valves are intended to keep tidal surcharge from impacting areas east of Michigan
Avenue. The FOR reviewed and approved the substitution, including an additional two (2)
inline check valves for a total of eight (8) valves (two 8-inch diameter, three 15-inch
diameter and three 24-inch diameter) in the amount of $43,252.85. The prices submitted
were reviewed by the project team and found to be fair and reasonable.

On December 9, 2009, the City requested that Horizon submit a cost proposal for the
milling and resurfacing of the south half of 2nd Street from Washington Avenue to Alton
Road (south half). This Work was not included in the original project boundaries. The City
also requested that Wolfberg Alvarez and Partners (Wolfberg) re-evaluate the 2nd Street
and Meridian Avenue intersection to ensure that the existing cross slopes and grade
elevation changes complied with established minimum standards. Wolfberg confirmed the
existing conditions at this intersection exceeded the minimum standards and completed a
design for the 2"d Street & Meridian Avenue intersection on April 25, 2010. Wolfberg
issued Revision No. 22 to the construction documents drawings and Horizon was
requested to include this work in the cost proposal for milling and resurfacing the south
half of 2"d Street from Washington Avenue to Alton Road.
On May 25, 2010, Horizon submitted a cost proposal and it was negotiated to the final
amount of $78,827.97.
Michigan Avenue and 2"d Street Intersection Modifications
On December 10, 2009, Wolfberg issued revision 16 which added approximately 15 LF of
storm drainage line, a drainage structure and grate to address the need for additional storm
water collection system requirements. This is additional scope of work that was not
contemplated in the plans and verified in the field as being necessary to accommodate the
drainage flow pattern. On June 6, 2010, Horizon submitted a cost proposal for the work in
the amount of $9,518.49. The City, Wolfberg and Horizon negotiated and agreed on a fair
and reasonable price of $7,474.81 for this work.
Jefferson Court Storm Sewer
During the reconstruction of the Jefferson Court alleyway, an old 24-inch ductile iron pipe
was found a few inches below existing grade. The pipe was old, brittle and further
damaged by the reconstruction of the alleyway. The Public Works Department confirmed
that this abandoned sewer pipe had been converted to a storm water conveyance pipe
and the City wished to retain it in use. A repair was developed which removed the
damaged section and replaced it with a Class 53 ductile iron pipe (thick pipe wall) so that
the existing pipe can remain in service. On May 28, 2010, Horizon submitted a cost
proposal for the repair of the existing sewer pipe in the amount of $1,243.17. The proposal
was negotiated in the final amount of $1,029.74.
Additional Irrigation Systems
During plan development, Wolfberg was concerned that the budget could not provide for
swale irrigation along Euclid, Jefferson and Michigan Avenues. The Parks and Recreation
Department requested that irrigation be added to the project to fully irrigate the areas that
will receive sod. The original scope of work includes irrigation bubblers in all tree pits
along 4~' Street and 2"d Street and irrigation spray heads at all bump-outs that will receive
trees. No irrigation was planned for the "swale areas" along the Avenues due to the
perceived lack of funding during design development.

With the assistance of the Parks and Recreation Department, cost proposals have been
requested from three (3) vendors that provide irrigation services to the Parks and
Recreation Department. On a parallel path, Horizon was also requested to provide a cost
proposal to integrate the additional irrigation along the swales. As of this writing, only two
proposals are in receipt. An estimated budget of $150,000 is anticipated to accommodate
this request.
A summary of the additional funding request is as follows:
