2010-27435 ResoRESOLUT/ON NO. 2010-27435 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, SETTING A PUBLIC HEARING TO CONSIDER THE PROPOSED DESIGNATION OF THE MIAMI BEACH ROD & REEL CLUB HISTORIC SITE, AT 218 SOUTH HIBISCUS DRIVE, BY AMENDING THE LAND DEVELOPMENT REGULATIONS OF THE MIAMI BEACH CITY CODE; AMENDING SECTION 118-593, "HISTORIC PRESERVATION DESIGNATION"; AMENDING SECTION 118-593(E), "DELINEATION ON ZONING MAP"; AMENDING SECTION- 118-593(E)(1), "HISTORIC PRESERVATION SITES (HPS) BY DESIGNATING THE MIAMI BEACH ROD 8~ REEL CLUB HISTORIC SITE. WHEREAS, on May 1 1, 2010, the City of Miami Beach Historic Preservation Board held a public hearing and voted (7 to 0) in favor of recommending that the Mayor and City Commission designate the Miami Beach Rod & Reel Club Historic Site; and WHEREAS, on July 27, 2010, the City of Miami Beach Planning Board is scheduled to hold a public hearing regarding the proposed designation of the Miami Beach Rod & Reel Club Historic Site; and WHEREAS, the City of Miami Beach Planning Department has recommended this amendment to the Land Development Regulations of the City Code; and WHEREAS, pursuant to section 118-164(1) of the Land Development Regulations of the City Code, for changes to the actual zoning map designation for a parcel or parcels of land involving less than ten contiguous acres, the City Commission shall hold one public hearing on the proposed ordinance. Immediately following the public hearing, the. City Commission may adopt the ordinance; and WHEREAS, the Administration is requesting that the first and only reading public hearing for the proposed designation of the Miami Beach Rod & Reel Club Historic Site be set at this time; NOW THEREFORE, BE /T DULY RESOLVED BY THE MAYOR AND C/TY COMM/SS/ON OF THE C/TY OF M/AM/ BEACH, FLOR/DA, that a first and only reading public hearing shall be held on September 15, 2010, to consider the proposed designation of the Miami Beach Rod & Reel Club Historic Site as follows: Public Hearing First and Only Reading After 5:00 p.m. in the City Commission Chambers at 1700 Convention Center Drive, Miami Beach, Florida, and the City Clerk is hereby authorized and directed to publish and distribute the appropriate public notice of said public hearing, at which time all interested parties will be heard. ADMINISTRATION RECOMMENDATION The Administration is requesting that the Mayor and City Commission schedule a first and only reading.. public hearing on September 15, 2010 to consider the proposed designation of the Miami Beach Rod 8 Reel Club as an individual local historic site. The Administration recommends that the Mayor and City Commission adopt the resolution. BACKGROUND On June 16, 2009, the Chairman of the Historic Preservation Board directed the Planning Department to schedule a special meeting of the board for the purpose of hearing and acting upon a request to consider the possible designation of the Miami Beach Rod and Reel Club as a local historic site. Accordingly, the Planning Department contacted all board members and scheduled a special meeting for June 29, 2009. Further, Planning staff prepared a Preliminary Evaluation and Recommendation Report for submission to the board relative to this possible designation. Pursuant to Section 118-591(e) of the City Code, the Historic Preservation Board, may, by motion of the Board, instruct the planning department to prepare a designation report and implement interim procedures for demolition permits. The planning director, or designee, may prepare and submit to the historic preservation board an evaluation and recommendation for designation at a meeting noticed in a newspaper of general circulation at least five business days in advance of the hearing. The property owner Commission Memorandum of July 14, 2010 Setting of Public Hearing -Historic Designation Miami Beach Rod 8 Reel Club, 218 South Hibiscus Drive Page 2 of 3 shall be notified in writing, by regular mail sent to the address of the owner on the Miami- Dade County Property Appraiser's tax records, and postmarked at least five business days in advance of the hearing. The city commission shall also then be notified. On Sunday, June 21, 2009, the public advertisement for this special meeting appeared in the Neighbors Section of the Miami Herald. On June 22, 2009, an LTC was sent to the Mayor and Commissioners notifying them that the Chairman of the Historic Preservation Board called a Special Meeting of the Board to be held on Monday, June 29, 2009, at 6:00 PM for the Board to consider directing staff to prepare a Designation Report for the Miami Beach Rod and Reel Club, located at 218 South Hibiscus Drive, on Hibiscus Island. On June 29, 2009, the Historic Preservation Board held a special meeting to review the preliminary evaluation and recommendation report with recommendations prepared by the Planning Department relative to the proposed designation of 218 (aka 208) S. Hibiscus Drive as the Miami Beach Rod & Reel Club Historic Site. The Board approved a motion (3-1-3 absent) to direct staff to prepare a designation report and schedule a public hearing to consider the proposed historic designation. Pursuant to Section 118-591 of the City Code, when the Historic Preservation Board directs staff to prepare a designation report for a proposed new historic district or site, the Mayor and City Commission shall be notified of the board's decision and the initial boundaries proposed for designation. Within 60 days of the vote of the Historic Preservation Board to direct the Planning Department to prepare a designation report, the City Commission may, by afive-sevenths vote, deny or modify the proposed request for designation, as well as establish specific timeframes for the completion of the evaluation and recommendation and/or designation report. Within this 60 day'period the City Commission may also, by afive-sevenths vote, deny or modify the proposed designation boundaries. An LTC was issued on June 30, 2009, and no requests were made to modify the proposed designation within the ensuing 60 day period or thereafter. On February 3, 2010, an LTC was sent to the Mayor and Commissioners updating them on the zoning issues associated with the non-conforming use of the Rod & Reel Club. On May 11, 2010, the Historic Preservation Board reviewed the designation report and unanimously approved a motion (7 to 0) to recommend approval of the designation of the proposed Miami Beach Rod & Reel Club Historic Site. The Planning Board is scheduled to review a Designation Report relative to the proposed historic designation of the Miami Beach Rod 8~ Reel Club as a local historic site on July 27, 2010. DESIGNATION PROCESS The designation report for a proposed historic district is required to be presented to the Historic Preservation Board and the Planning Board at separate public hearings. Following public input, the Historic Preservation Board votes on whether or not the proposed historic district meets the criteria listed in the Land Development Regulations of the City Code and transmits a recommendation on historic designation to the Planning Board and City Commission. If the Historic Preservation Board votes against the designation, no further action is required. If the Historic Preservation Board votes in Commission Memorandum of July 14, 2010 Setting of Public Hearing -Historic Designation Miami Beach Rod 8 Reel Club, 218 South Hibiscus Drive Page 3 of 3 favor of designation, the Planning Board reviews the designation report and formulates its own recommendation. The recommendations of both Boards, along with the designation report, are presented to the City Commission. Because in this instance the proposed ordinance involves an area less than ten (10) contiguous acres, the City Commission must hold one public hearing on the designation. Upon conclusion of the hearing, the City Commission can immediately adopt the ordinance with a 5/7 majority vote. STAFF ANALYSIS The proposed designation of the Miami Beach Rod 8< Reel Club Historic Site is appropriate to protect the aesthetic, architectural, and historical importance of the City of Miami Beach. The positive social and economic impact that preservation has had on the revitalization of Miami Beach is well known. Local residents, as well as visitors from around the world, are seeking the very special urban character of Miami Beach that the Planning Department seeks to preserve. Further, alterations are permitted to historic structures provided that the changes are found to be appropriate by the Historic Preservation Board. Therefore, the Administration recommends that the Mayor and City Commission adopt this resolution scheduling a first reading public hearing on September 15, 2010 to consider the proposed designation of the Miami Beach Rod & Reel Club Historic Site.
