2010-27456 ResoRESOLUTION NO.' 2010-27456 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND ADOPTING THE BASIC OPERATIONAL GUIDELINES FOR THE USE OF THE WEST LAWN/FIELD IN SOUTH POINTE PARK AS RECOMMENDED BY THE NEIGHBORHOODS/COMMUNITY AFFAIRS COMMITTEE AT ITS MEETING OF MAY 25, 2010. WHEREAS, the Neighborhoods/Community Affairs Committee held an initial discussion which concerned the operational issues of the newly reconstructed South Pointe Park (the "Park") during its February 17, 2009 meeting; and WHEREAS, the Administration requested direction and guidance on pending issues that would ultimately shape the future uses of the Park, included but not limited to, such matters as park hours, facility and field rentals, motorized and non-motorized vehicles in the Park, programming and special events; and WHEREAS, a City of Miami Beach community meeting was held on May 12, 2009 at the Park's community room to gain additional input from the residents as to operational issues; and WHEREAS, the Neighborhoods/Community Affairs Committee, by and through subsequent meetings with the community, gained additional input from the residents and the Mayor and City Commission related to operational issues, which resulted in recommendations being forwarded to the Mayor and City Commission of the City of Miami Beach; and WHEREAS, the Mayor and City Commission of the City of Miami Beach, at its April 14, 2010 meeting, approved Resolution No. 2010-27375, Approving and Adopting Operational Guidelines for South Pointe Park relating to Park Hours, Bicycles and Skateboards, Motorized Vehicles, Fishing and Swimming in the Park, the Rental of the Recreational Center (Community Room), Fields and Pavilion (Rooftop), and Special Events in the Park as Recommended by the NeighborhoodslCommunity Affairs Committee at its Meeting of February 16, 2010; and WHEREAS, the Administration was directed to refer the issue of field rentals to the Neighborhoods/Community Affairs Committee for further development and direction, and the issue of field rentals in the Park was discussed at the May 25, 2010, Neighborhoods/ Community Affairs Committee meeting; and WHEREAS, the Neighborhoods/Community Affairs Committee set forth, and approved the below guidelines for the usage of the west lawn/field area in the Park by schools and other youth organizations, specifically: (1) There will be no rentals of any field in the Park, however, the west lawn/field area can be rented by schools and other youth organizations on a space available basis and only within the approved times. (2) The west lawn/field would only be available for use by school aged youth weekdays (Monday -Thursday) during the hours of 10:00 A.M. and 5:00 P.M., for a maximum of four (4) hours at a time. (3) Use of the west lawn/field by school aged children or a school aged youth group would only be available for non-league, non-organized play that does not require temporary structures (e.g. tents requiring permits) or other supports that would require a special event permit. (4) There would be no field use requests approved on weekends (Friday -Sunday). (5) There can be no sales/service/consumption of alcoholic beverages. (6) Live entertainment or amplified sound are not permitted. (7) The Administration is to track the reserved usage of the west lawn/field by school aged youth and youth groups and report back to the Neighborhood/Community Affairs Committee once the Park is fully functioning as intended. NOW, THEREFORE, BE IT DULY RESOLVED THAT THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, hereby approves and adopts the basic operational guidelines for the west lawn/field in South Pointe Park as recommended by the Neighborhoods/Community Affairs Committee at its meeting of May 25, 2010. The Administration prepared an agenda item related to the operational guidelines for South Pointe Park that was discussed at the April 14, 2010 Commission meeting and that resulted in approval of operational guidelines for South Pointe Park relating to park hours, bicycles and skateboards, motorized vehicles, fishing and swimming in the park, the rental of the recreational center (Community Room) and Pavilion, and special events in the park. The issue of Field Rentals was referred to the Neighborhoods/Community Affairs Committee for further development and direction. The issue of field rentals in South Pointe Park was discussed May 25, 2010 at the Neighborhoods/Community Affairs Committee meeting. Following comments and discussion by the Commission Committee members, residents and the administration, the Committee made a motion approving guidelines for the usage of the west lawn/field area by schools and other youth organizations, permitting the use subject to the restrictions and criteria developed. It is recommended that the Commission adopt the attached resolution. The discussion focused on a number of issues, including the park's proposed maintenance, security and programming plans, and the assigned responsibilities of various departments contributing to the successful operations of the new South Pointe Park. The Administration also requested direction and guidance on pending issues that would ultimately shape the future uses of the park. These included, but were not limited to, such matters as park hours, facility and field rentals, motorized and non-motorized vehicles in the park, programming and special events. Subsequent meetings with the community and the Neighborhoods/Community Affairs Committee were held over the next year to gain additional input from the residents and Commission related to operational issues, resulting in recommendations from the Committee being forwarded to the full Commission. While there was agreement on park hours, fishing, community room rentals and motorized/non-motorized vehicles in the park, the Committee did not recommend field rentals, or whether special events should be permitted. APRIL 14, 2010 COMMISSION DISCUSSION The Administration prepared an agenda item related to the operational guidelines for South Pointe Park to be discussed at the April 14, 2010 Commission meeting. At the Commission meeting the issues were discussed by both the community and commission, resulting in the approval of Resolution No. 2010-27375, approving and adopting operational guidelines for South Pointe Park relating to park hours, bicycles and skateboards, motorized vehicles, fishing and swimming in the park, the rental of the recreational center (Community Room), fields and pavilion (rooftop), and special events in the park as recommended by the Neighborhoods/ Community Affairs committee at its meeting of February 16, 2010 (as amended allowing for City produced special events only). Page 2 of 3 South Pointe Park In light of no agreement on the issue of field rentals, the Commission referred the discussion of field rentals to the Neighborhoods/Community Affairs Committee for further development and direction. As directed, the discussion of field rentals was placed on the April 27, 2010 Neighborhoods/ Community Affairs Committee meeting for discussion. At the April 27~h meeting the item was deferred at the request of the Administration due to a limited number of residents present. The item was subsequently included on the May 25, 2010 Neighborhoods/Community Affairs Committee agenda. NEIGHBORHOODS COMMITTEE -MAY 25. 2010 Residents attended the meeting to participate in the discussion on this issue. While it was suggested that no action be taken until such time as the turf conditions and other issues at the park are resolved (e.g. children's playground, Washington Avenue Fountains), the Committee members felt that the use of the west lawn/field for youth groups, with the parameters proposed, should be permitted. Following comments and discussion by the Commission Committee members, residents and the administration, the Committee made a motion approving the following guidelines for the usage of the west lawn/field area in South Pointe Park by schools and other youth organizations: • No field rentals would be permitted other than for school-aged youth or youth organizations. • The west lawn/field would only be available for use by school-aged youth weekdays (Monday- Thursday) during the hours of 10:00 A.M. and 5:00 P.M., for a maximum of four (4) hours at a time. • Use of the west lawn/field by school-aged children or a school-aged youth group would only be available for non-league, non-organized play that does not require temporary structures (e.g. tents requiring permits) or other supports that would require a special event permit. • There would be no field use requests approved on weekends (Friday -Sunday) or holidays. • There can be no sales/service/consumption of alcoholic beverages. • Live entertainment/amplified sound are not permitted. • The Administration is to track the reserved usage of the west lawn/field by school aged youth and youth groups and report back to the Committee. FIELD RENTAL/RESERVATION RATE The field rental rate at City Parks, as established by the City Commission in 2003, is $150 for a four hour period. There is an additional cost for rentals for staffing @$25.00 per hour per staff, 4 hour minimum. The number of staff is determined by the supervisor depending on the scope of the rental; insurance may also be required. The Parks and Recreation Department, throughout the year, receives periodic requests to use various recreation facilities, such as softball fields, tennis courts, swimming pools, etc., from local public and private schools, as well as other user groups. Most often a school will seek a waiver of the rental fee by submitting a written request to the City, as is permitted per Resolution No. 2002-24731. This request is then submitted via the Parks and Recreation Department to the City Manager (or his designee) with a recommendation for a fee waiver based on the established criteria in the above cited resolution. The City Manager is authorized to approve the waiver of the rental fee only with the requesting organization responsible for paying all direct costs, including labor for the event, a damage/clean-up deposit and insurance if deemed necessary. Page 3 of 3 South Pointe Park CONCLUSION .The administration recommends that the Commission approve and adopt the basic operational guidelines for the use of the west lawn/field in South Pointe Park as recommended by the Neighborhoods/Community Affairs Committee at its meeting of May 25, 2010, and the proposed field rental (reservation) fee, consistent with fees at other City parks.
