PENALTIES," BY AMENDING SUBSECTION (N), ENTITLED

RATING OF SIX "6" OR HIGHER ("SMARTWAY" DESIGNATION) AND

RESERVED HYBRID VEHICLE SPACES AT THE 42ND STREET GARAGE
FROM ONE PERCENT (1%) TO TWO PERCENT (2%), ESTABLISHING
ONE PERCENT (1%) OF THE PARKING SPACES AT THE 7T" STREET
GARAGE AND 13T" STREET AS RESERVED FOR HYBRID VEHICLES
ONLY, AND ESTABLISHING AN AUTOMATIC REVIEW OF ALL HYBRID
VEHICLE INCENTIVES UPON REACHING A HYBRID PERMIT SALES
THRESHOLD OF FIVE PERCENT (5%) OF TOTAL PERMIT SALES;
PROVIDING- FOR CODIFICATION, REPEALER, SEVERABILITY, AND AN '
EFFECTIVE DATE.
WHEREAS, Ordinance No. 2007-3586 was passed and adopted on December 12, 2007; by
the Mayor and City Commission establishing incentives for use of Hybrid/ILEV vehicles in the City;
and
WHEREAS, on May 14, 2008, the City Commission approved an amendment increasing the
parking permit discount from 25% to 50%; establishing a $100.00 annual fee for Hybrid Citywide
Parking Decals; and honoring said Hybrid Citywide Parking Decals at both on-street and off-street
metered parking spaces; and
WHEREAS, the City of Miami Beach Parking Department recognizes that additional
amendments to the Hybrid/ILEV (Inherently Low Emissions Vehicles) incentives are necessary' in
order to further incentivize and promote Hybrid/ILEV vehicles; and
WHEREAS, the EPA (Environmental Protection Agency) also recognizes the benefit; of
energy efficient vehicles and provides for vehicle emissions criteria and ratings for all vehicles
according to their performance, and all street .legal electric vehicles also provide these same
benefits; and
._. WHEREAS, the City wishes to establish further incentives for Hybrid/ILEV vehicle use in the
City by expanding reserved hybrid parking spaces at the 42"d Street Garage from one percent (1 %)
to two percent (2 /o), and by establishing one percent (1 %) of the parking spaces at the 7th Street
Garage and the 13th Street Garage as reserved spaces for Hybrid/ILEV vehicles; and '

WHEREAS, it is prudent to establish an automatic review of all Hybrid/ILEV vehicle
incentives upon reaching a hybrid permit sales threshold of five percent (5%) of total permit salles;
and
WHEREAS, the City's Transportation and Parking Committee (TPC) discussed and
endorsed the recommendations set forth in this Ordinance at their meetings held on April 12, 2010
and June 7, 2010, and the Sustainability Committee also discussed and endorsed these
recommendations at its meeting on April 20, 2010; and

WHEREAS, the amendments set forth below are necessary to accomplish all of the above
objectives.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION ~~OF
THE CITY OF MIAMI BEACH, FLORIDA, AS FOLLOWS: -
SECTION 1. That Chapter 106, "Traffic and Vehicles," Article I I, "Metered Parking," Division 1,
"Generally," Section 106-55, "Parking Rate Fees, and Penalties," Subsection (n), "Hybrid/ILEV
(Inherently Low Emissions Vehicles) Vehicle Incentive" of the Code of the City of Miami Beach,
Florida, is hereby amended, as follows:
Chapter 106. Traffic and Vehicles
Sec. 106-55. Parking rates, fees, and penalties.
(n) Hybrid/ILEV (Inherently Low Emissions Vehicles) Vehicles Incentive:
Effective ~ , ~A9~ October 1. 2010, the ~#-a Hybrid/ILEV
Program will use the State ILEV listi EPA (Environmental Protection Agencv)
vehicle rating of six "6" or higher or "Smartway" designation; and allow all street legal
electric vehicles to qualify" for participation in the Program. Incentives to
be offered to qualified and registered vehicle owners include:
a. Monthly parking permit holders for all facilities will be afforded a fifty percent
(50%) discount on the monthly rate.
b. Residential permit holders in all designated zones shall receive a fifty percent
(50%) savings on either their annual or semi-annual residential permit.
c. Five hundred (500) Citywide parking decals,
honored at metered spaces only, shall be available only to State registered
Hybrid/ILEV vehiclesi vehicles receiving an EPA (Environmental Protection
Agencv) rating of six "6" or higher or "Smartway" designation• and all street legal
electric vehicles on a first-come, first served basis. The cost of the Hybrid
Citywide Decal is $100.00 per year.

d. 8qe Two percent {~} (2%) of the parking spaces at the 42nd Street Municipal
Parking Garage may be designated as "Hybrid/ILEV Vehicle Parking Only" for
use by recognized Hybrid/ILEV vehicles. One percent (1 %) of the parking
spaces at the 7t" Street Garage and 13t" Street Garage may be designated as
"Hybrid/ILEV Vehicle Parking Only" for use by recognized Hybrid/ILEV
vehicles.Notwithstanding the preceding sentence, the City Manager or his
designee, who shall be the City's Parking Director, reserves the right, in his
reasonable business judgement and discretion, to temporarily suspend the
aforestated "Hybrid/ILEV Vehicle Parking Only" during special events in orderto
ensure maximum utilization of all parking spaces.
SECTION 2. CODIFICATION.
It is the intention of the Mayor and City Commission of the City of Miami Beach, and it is
hereby ordained that the provisions of this ordinance shall become and be made part of the Code of
the City of Miami Beach, Florida. The sections of this ordinance maybe renumbered or relettered to
accomplish such intention, and the word "ordinance" may be changed to "section", "article", or other
appropriate word.
SECTION 3. REPEALER.
All ordinances or parts of ordinances in conflict herewith be and the same are hereby
repealed.
SECTION 4. SEVERABILITY.
If any section, subsection, clause or provision of this Ordinance is held invalid, the remainder
shall not be affected by such invalidity.
SECTION 5. EFFECTIVE DATE.
This Ordinance shall take effect ten (10) days following adoption.

In order to continue providing incentives to the public at large promoting hybrid vehicle use, the City's Transportation
and Parking Committee (TPC) endorsed the amendments below on April 12, 2010 and June 7, 2010 and the
Sustainability Committee (SC) endorsed the amendments below on April 20, 2010. An amendment to the City's
Parking Rate Ordinance is necessary in order to initiate these amendments. The following are the recommended
.amendments to the program: In addition to the list maintained by the Florida Department of Highway Safety and
Motor Vehicles, vehicles with an EPA (Environmental Protection Agency) rating of six "6" or higher or "Smartway"
designation will also be honored. Vehicles rated at a six "6" or higher by the EPA are rated as "very good
environmental performers relative to other vehicles". In addition, all street legal electric vehicles will also be honored
in the program with the exception of those electric vehicles for rent at commercial establishments.
41 "d Street Municipal Parking Garage -Increase the number of spaces for ILEV hybrid vesicles from one percent
( /o) to two percent (2 /o) representing 13 spaces of the 620 parking spaces within the 42 Street parking facility.
7~' Street and 13~' Street Garages -One percent (1 %) of the parking spaces within theses parking facilities shall be
identified as "Hybrid Vehicle Parking Only" for use by recognized ILEV/hybrid vehicles. The 7th Street Municipal
Parking Garage has 646 spaces; therefore, one percent or seven (7) parking spaces will be designated as "Hybrid
Vehicle Parking Only".* The 13~' Street Municipal Parking Garage has 286 spaces; therefore, one percent or three
(3) parking spaces will be designated as "Hybrid Vehicle Parking Only".*
Automatic Review - It is prudent to establish an automatic review of all Hybrid/ILEV vehicle incentives upon reaching
a hybrid permit sales threshold of five percent (5%) of total permit sales is necessary.
Note: *ILEV/Hybrid vehicle spaces will be progressively enforced to ensure compliance; however, during major

ADMINISTRATION RECOMMENDATION
The Administration recommends that the Mayor and Commission approve the amendment
of the ordinance on second reading and final public hearing.
First Reading Discussion by the City Commission:
On July 14, 2010, at the first reading of the proposed ordinance amendment, the Mayor and
Commission referred the item to the Finance and Citywide Projects Committee for
discussion. In addition, members of the City Commission had inquiries regarding the
availability of parking for employees of commercial corridors such as Lincoln Road.
The Municipal Monthly Parking Program (MMPP) is available for all members of the public
and is the primary option for commercial employee parking needs. The MMPP is available
at a monthly rate of $70.00 (plus sales tax). Employees receive either an access card-for a
garage or receive a permit which must be affixed to the driver's side windshield.
Typically, requests for monthly parking are handled as availability allows. Most municipal
surface lots have sufficient availability to accommodate demand; however, most garages do

not. For those facilities that do not have immediate availability, customers are placed on a
waiting list for their "preferred facility' and an "interim facility' is offered until their place on
the waiting list is reached. By way of example, the Lincoln Road corridor is lined on both
sides with municipal surface parking lots. Customers wishing to use either the 17~' Street
Garage or City Hall Garage are placed on each facility's waiting list and an interim facility (a
surface lot) is offered until they are transitioned into a garage.
Historically, employee parking in the Lincoln Road area meant very long waiting lists with
over one thousand (1,000) customers and at its peak had an 18 month wait time (2004 -
2008). This has improved significantly over time. Most recently, the opening of the City Hall
Garage in December 2009 created sufficient availability in the area for monthly parking that
waiting lists for both garages were depleted. Since that time, demand has begun to creep
again and as of August 25, 2010, there were 207 and 75 customers on the waiting lists for
the 17~' Street Garage and City Hall Garage, respectively. The opening of the Pennsylvania
Garage, which is expected shortly, should absorb most, if not all, of the cun'ent waiting lists
for the existing garages. The Parking Department continues to closely monitor transient and
monthly usage levels in order to optimize this delicate balance.
ANALYSIS

April 12, 2010 and June 7, 2010 and the Sustainability Committee (SC) endorsed the
amendments below on April 20, 2010. An amendment to the City's Parking Rate Ordinance
is necessary in order to initiate these amendments.
The following are the recommended amendments to the program:
• In addition to the list maintained by the Florida Department of Highway Safety and
Motor Vehicles, vehicles with an EPA (Environmental Protection Agency) rating of
six "6" or higher or "Smartway' designation will also be honored. The EPA
evaluates all vehicles on their impact to the environment. Ratings are based on a
scale of one (1) to ten (10) with "10" being the highest and best rating. Each
vehicle receives. an Air Pollution Score and Greenhouse Gas Score. Vehicles
rated at a six "6" or higher by the EPA are rated as "very good environmental
performers relative to other vehicles". In addition, all street legal electric vehicles
will also be honored in the program with the exception of those electric vehicles for
rent at commercial establishments.

percent (2 /o) of the parking spaces within the 42 Street parking facility shall be
identified as "Hybrid Vehicle Parking Only" for. use by recognized ILEV/hybrid

spaces in the facility with only disabled parking spaces being in more convenient
and accessible locations. The 42nd Street Municipal Parking Garage has 620
spaces; therefore, up to two percent (2%) or up to thirteen (13) parking spaces will
be designated as "Hybrid Vehicle Parking Only".*
• 7ri Street Garage -One percent (1%) of the parking spaces within the 7~' Street
parking facility shall be identified as "Hybrid Vehicle Parking Only' for use by
recognized ILEV/hybrid vehicles. These parking spaces will be located in the most

CONCLUSION
In conclusion, the Administration recommends that the Mayor and City Commission amend
Chapter 106, "Traffic and Vehicles" Article II, "Metered Parking" by amending Sections 106-
55(n), "Parking Rates, Fees, and Penalties; amending incentives for Hybrid/ILEV vehicles.
The Administration will monitor the program over the next six months in order to determine
the amendments impact and effectiveness.
Furthermore, at the request of the City Commission this program was referred to the Finance
and Citywide Projects Committee for discussion. The Administration will report the outcome
of that discussion via a Letter to Commission.
