A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF MIAMI BEACH, FLORIDA, ACCEPTING THE
$OLOCAUST MEMORIAL IMPROVEMENTS DONATED TO THE
CITY BY THE HOLOCAUST MEMORIAL COMMITTEE, INC.
WHEREAS, City of Miami Beach ("City") on the 31st day of July,
1987, entered into an agreement with -the Holocaust Memorial
.Committee, Inc. ("Committee") whereby the Committee agreed to pay
for-and install a Holocaust Memorial and. related improvements on
City property (the "Property") located at the southeast
intersection of Dade Boulevard and Meridian Avenue, (the
"Agreement"); and
WHEREAS, the Committee has installed all of the improvements
contemplated under the Agreement at its sole cost and expense, and
a certificate of occupancy has been issued for use of the Holocaust
Memorial, and the Committee has tendered the improvements to the
City by a Bill of Sale; and
WHEREAS, the City wishes to accept the donation of the
Holocaust Memorial improvements with the understanding that the
Property will continue to be used in the future as a Holocaust
Memorial.
WHEREAS, nothing herein is intended to supersede the agreement
of July 31, 1987, which agreement survives this resolution.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, that ,the City Commission hereby
accepts the donation of the Holocaust Memorial Committee, Inc. as
set forth in the Bill of Sale, with the understanding that the
property shall continue to. be used as a Holocaust Memorial, and
that nothing herein is intended to supercede the agreement of July
31, 1987, which agreement survives this resolution.
