94-21274 Reso RESOLUTION NO. 94 -21274 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AMENDMENT TO THE AGREEMENT BETWEEN THE CITY OF MIAMI BEACH AND THE LESBIAN, GAY AND BISEXUAL COMMUNITY CENTER, INC. FOR THE PROVISION OF COUNSELING, EDUCATION, RECREATIONAL ACTIVITIES, AND SOCIAL SERVICES FOR BOTH ALTERNATIVE LIFESTYLE COMMUNITY AND NEIGHBORHOOD RESIDENTS; THE AMENDMENT EXTENDING THE TERM OF THE AGREEMENT FROM SEPTEMBER 30, 1994 TO JULY 31, 1995. WHEREAS, on October 20, 1993, the Mayor and City Commission approved Resolution No. 93- 20927, authorizing the Mayor and City Clerk to execute an agreement between the City of Miami Beach and the Lesbian, Gay and Bisexual Community Center, Inc. (LGBCC) for the provision of counseling, education, recreational activities, and social services for both alternative lifestyle community and neighborhood residents (Agreement); and WHEREAS, pursuant to the Agreement the LGBCC received a total amount of twenty thousand dollars ($20,000) from Federal Community Development Block Grant (CDBG) Year Nineteen funds for the above stated purpose; and WHEREAS, the parties now wish to amend the Agreement to extend the term from September 30, 1994 to July 31, 1995 (the Amendment); and WHEREAS, the Amendment would not affect the total dollar amount of the LGBCC line item as City's s published in the City s CDBG Year Nineteen Final Statement or in the Agreement. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA that the Mayor and City Clerk are hereby authorized to execute the attached Amendment to the Agreement between the City of Miami Beach and the Lesbian, Gay and Bisexual Community Center, Inc. for the provision of counseling, education, recreational activities, and social services for both alternative lifestyle community and neighborhood residents, extending the term from September 30, 1994 to July 31, 1995. FOR THE PROVISION OF COUNSELING, EDUCATION, RECREATIONAL ACTIVITIES, AND SOCIAL SERVICES FOR BOTH ALTERNATIVE LIFESTYLE COMMUNITY AND NEIGHBORHOOD RESIDENTS, THE AMENDMENT EXTENDING THE TERM OF THE AGREEMENT FROM SEPTEMBER 30, 1994 TO JULY 31, 1995. ADMINISTRATION RECOMMENDATION: That the Mayor and City Commission adopt the attached Resolution authorizing the Mayor and City Clerk to execute an Amendment to the Agreement with the Lesbian, Gay and Bisexual Community Center,Inc. ( LGBCC), dated October 1, 1993, extending the term from September 30, 1994 to July 31, 1995. BACKGROUND: On October 20, 1993, the City of Miami Beach entered into the Year Nineteen (19) Sub - recipient Agreement with the LGBCC for the provision of counseling, education, recreational activities, and social services for both alternative lifestyle community and neighborhood residents with federal Community Development Block Grant (CDBG) funds in the amount of Twenty Thousand dollars ($20,000),(the Agreement). The Lesbian, Gay and Bisexual Community Center was purchased in September 1993 with the assistance of Year Eighteen (18) federal CDBG funds, with the official dedication of the facility in February 1994. Prior to the receipt of its occupational license in July 1994, LGBCC only incurred under this Agreement those start -up costs necessary to initiate operations (i.e. insurance, audit, etc.). A ramp was also installed for handicapped accessibility. Operational expenses related to those services partially funded under this Agreement commenced on August 1, 1994. Fifty (50) Miami Beach HIV -SERO positive residents, registered with Cure AIDS Now, Inc., are receiving counseling and referral services at the facility. Three youth focus group meetings regarding HIV education prevention have been held, each attended by 8 to 10 youth. 400 pieces of HIV education /prevention materials have been distributed. Activities scheduled to commence after September 1, 1994, include: three different types of HIV support groups meetings on a regular basis, self defense classes (groups of 5 to 10 people), and short - term individual counseling and ongoing support groups for youth. 32 AGENDA _24_ G ITEM DATE 91-9ci Press releases have been sent to eight magazines (i.e. New Times, Wires, etc.) regarding information on the support groups and HIV/ AIDS education and prevention services at the LGBCC. In addition, ongoing services will be advertised through donated space received by LGBCC. LGBCC has requested that the City extend the term from September 30, 1994 to July 31, 1995. LGBCC is not a recipient of Year Twenty (20) federal Community Development Block Grant (CDBG) funds (FY1994 -95). The Amendment to the Agreement will allow LGBCC to complete the Scope of Services of the Year Nineteen (19) CDBG Sub - recipient Agreement and continue to utilize those federal CDBG funds already available under the Agreement for the provision of services at the Lesbian, Gay and Bisexual Community Center for both alternative lifestyle community and neighborhood residents through July 31, 1995. The source of funds are Year Nineteen (19) federal Community Development Block Grant (CDBG) funds. ANALYSIS: Since the CDBG Year Nineteen (19) funds have not been fully utilized, and since the Community Development Advisory Committee (CDAC) and the City Administration both supported the carry -over of these funds into the next Program Year (FY1994 -95); no new Year Twenty (2 0) CDBG funds were recommended for funding by the CDAC and the City Administration, nor awarded by the Commission to LGBCC. Therefore, in order for the activities to continue, this Amendment to Agreement is necessary. The Amendment would not affect the total dollar amount of the LGBCC line item as published in the City's Year Nineteen (19) Final Statement or the Year Nineteen (19) CDBG Sub - recipient Agreement, as LGBCC will continue utilizing carry -over federal CDBG funds available under this Agreement. CONCLUSION: The Administration recommends adoption of the attached Resolution which authorizes the Mayor and City Clerk to execute the Amendment to the Agreement between the City of Miami Beach and the Lesbian, Gay and Bisexual Community Center, Inc., for the provision of counseling, education, recreational activities, and social services for both alternative lifestyle community and neighborhood residents, extending the term from September 30, 1994 to July 31, 1995. RMC /STP /ASP /wp 33 AMENDMENT TO AGREEMENT This Amendment to Agreement, dated October 1, 1993, between the CITY OF MIAMI BEACH, a Florida municipal corporation, having its principal office at 1700 Convention Center Drive, Miami Beach, Florida, hereinafter refer to as the "City ", and the LESBIAN, GAY AND BISEXUAL COMMUNITY CENTER, INC. (LGBCC), hereinafter refer to as the "Provider ", is entered into this 1� day of c§-4/44"--- , 1994. WITNESSETH: WHEREAS, on October 20, 1993, the Mayor and City Commission approved Resolution No. 93- 20927, authorizing the Mayor and City Clerk to execute an agreement between the City and the Provider, for the provision of counseling, education, recreational activities, and social services for both alternative lifestyle community and neighborhood residents (the Agreement); and WHEREAS, pursuant to the Agreement the Provider received a total amount of Twenty Thousand dollars ($20,000) from Federal Community Development Block Grant (CDBG) Year Nineteen (19) funds for the above stated purpose; and WHEREAS, the parties now wish to amend the Agreement to extend the term from September 30, 1994 to July 31, 1995 (the Amendment); and WHEREAS, the Amendment would not affect the total dollar amount of the LGBCC line item as published in the City's CDBG Year Nineteen (19) Final Statement or in the Agreement. NOW, THEREFORE, the Agreement is hereby amended as follows: 1. SECTION III (TERM OF AGREEMENT), page 10, paragraph 2, is amended as follows: This project shall become operational as of October 1, 1993, subject to the approval of this Agreement by the Mayor and City Commission, and shall be completed by July 31, 1995. The term specified herein may be subject to any applicable term restrictions and limitations prescribed by HUD, and /or as may be otherwise prescribed herein. 2. All other terms and conditions of the Agreement between the City and the Provider shall remain the same in full force and effect.
