A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, REJECTING ALL
PROPOSALS RECEIVED IN RESPONSE TO RFP 105-97/99 FOR
THE PURCHASE OF PUBLIC ADVERTISEMENTS IN A
SPANISH LANGUAGE PERIODICAL ANI? DIRECTING THE
ADMINISTRATION TO PREPARE A NE\V RFP.
\VHEREAS, on September 16, 1998, the City issued a Request for
Proposals No. 105-97/99 (RFP) soliciting proposals for the provision of public
advertisements in a Spanish-language periodical, with an opening date of October 10,
1998; and
\VHEREAS, t\venty-six (26) specifications were mailed and a prc-
proposal conference was held on September 29, 1998, resulting in the receipt of two (2)
responses from Endless Creations, d/b/a "Hola Amigos," and tyliami Beach .-\.rt Deco
Publishing, Inc.; and
. .\VHEREAS, an Evaluation Committee was appointed to revie\v the
proposals received and during the evaluation process, it was determined that the
proposals were not responsive to the minimum requirements as set forth in the RFP: and
\VHEREAS, the City currently has a contract with The Miami HeraldlEl
Nuevo Herald to meet its legal advertising obligations; and
\VHEREAS, accordingly, the Administration would recommend that the
Mayor and City Commission reject of all proposals received pursuant to the RFP and
direct the Administration to prepare a new RFP.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR
AND CITY COMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the
Mayor and City Commission herein authorize the Administration to reject all proposals
received pursuant to RFP No. 105-97/99, for the purchase of public advertisement in a
Spanish-language periodical, and direct the Administration to prepare a new RFP.

DIRECTING THE ADMINISTRATION TO PREP ARE A NEW RFP.
ADMINISTRATION RECOMMENDATION:
Reject all proposals and direct the Administration to prepare a new RFP,
BACKGROUND:
The Request for Proposals (RFP) was issued on September 16, 1998, with an opening date of
October 10, 1998, Twenty-six (26) specifications were mailed and a pre-proposal conference was
held on September 29, 1998 resulting in the receipt of two (2) responses from:

Proposals were solicited to provide courtesy public advertisements in a Spanish-language periodical
in an effort to inform the Hispanic public of job announcements, public hearings, and/or other public
information. The contract is for a one (1) year, with two (2) one-year renewal options.
At the July 15, 1998 Commission meeting, the Administration was directed to issue a new RFP
based on the fact that Art Deco Tropical was not publishing as agreed. The contract with Art Deco
Tropical stipulated that the periodical must publish on a weekly basis and they had lapsed in
publishing weekly.

Art Deco Tropical currently has an extended contract with the City for this service, Prior to the
award of RFP No, 70-96/97 on September 15, 1997, the City placed advertisements in Spanish in
Art Deco Tropical for job announcements, public hearings and bids, At that time, Art Deco Tropical
was one of the few circulated newspapers in Miami Beach that printed in Spanish,
The City meets its legal advertising obligations by advertising in The Miami Herald, The City
currently has an advertising contract with The Miami Herald/EI Nuevo Herald.
ANAL YSIS:
The Evaluation Committee (Liliam Lopez, Hispanic Affairs Committee Chairperson; Pola Reydburd,
Hispanic resident of Miami Beach; Jorge Gomez, Planning & Zoning Manager; Nannette Rodriguez,
Media Relations Officer; and Robert Parcher, City Clerk) met on January 12, 1999. and after
reviewing the proposals, found them to be unresponsive to the City's minimum requirement for the
following reasons:

Pursuant to Section III - Proposal Format, Part B, Minimum
Requirements/Qualifications, paragraph seven (7). states that
"the periodical must follow a 'general news' format, covering
local (Miami Beach), regional, national and/or international
news, and limit its editorial content to the paper" s editorial
section'.'There were examples in the respondent's proposal of
where the respondent did not meet this requirement.
Endless Creation,
d/b/a "Hola Amigos"
As required in Section I - Overview and Proposal Procedures,
Part J, Vendor Application requirements, the respondent did
not submit disclosure of corporation (articles of Incorporation
- Copy of Certification page) and copy of Business or
Occupational License. Director of Procurement determined
that based on the omission of these items, the bid was
unresponSIve,
The Committee further recommended that if a new RFP is issued to advertise in a Spanish-language
newspaper, that it be issued with modifications to the minimum requirements by not limiting the
geographical location of the business to Miami Beach and increasing the circulation requirements.
Additionally, the Committee raised three concerns: 1) the potential legality issues in respect to the
proper translation of any proposed Ordinance advertisement, particularly proposed Zoning
Ordinances; 2) the need to provide courtesy notices in a Spanish-language newspaper; and 3)
circulation and readership.

CONCLUSION:
The proposals should be rejected as recommended by the Evaluation Committee. The
Administration should review the RFP, taking into consideration the recommendation of the
Evaluation Committee and recommending to the Commission policy dealing with courtesy and legal
notices in a revised RFP. In the meantime, the City should continue with the extended contract with
Art Deco Tropical.
