SUBJECT: Status of "Obstinate Lighthouse" in South Pointe Park
The purpose of this Letter to Commission (LTC) is to inform you of the status of the new LED lights
installed at the Art in Public Places "Obstinate Lighthouse" in South Pointe Park.
On January 17, 2013, the new LED lights were reviewed and approved by the Planning Department
and on January 23, 2013, the LED internet connectivity was reviewed and approved by the IT
Department. The Administration then approved the installation, which was completed on May 3,
2013. On May 6 staff conducted the first site inspection and the LED lights and video content were
working properly. On June 25, 2013, staff conducted the final inspection and the artwork was
accepted by the City.
The cost of the new LED lights was $50,000 including installation, and was paid from the project
budget.and the Artist's Contingency Fee. The LED lights have been working properly for seven (7)
weeks and come with the following warranty:
• Digital Display Experts, Inc. two (2) years on -site labor warranty; and
e Philips Color Kinetics, manufacturer of the LED, a five (5) years material warranty from date
of installation on May 9, 2013.
The City's contract with the Artist is for a not to exceed amount of $500,000 for creation, design
development, fabrication, installation, conservation documentation and a contingency. City included
a fifteen (15 %) percent contingency fee, in the amount of Seventy Five Thousand Dollars
($75,000.00) to provide for unforeseen costs. The budget did not include an artist fee, but the
contract provided that any unused portion of the Contingency may be paid to the Artist as an artist
fee. Still outstanding are payment five (5) and six (6) totaling $100,000 and include submission of
photo and cataloging documentation, contingency and artist fee.
