RE: Notice of Late Fine
Dear Mr. Levine:
Your Paid Campaign Workers Participating In Absentee Ballot Activities Summary (Form MD-ED 26)
was due on November 1, 2013 before 5:00 p.m. The report was received by the Office of the City
Clerk on November 4, 2013, with a postmark date of November 2, 2013, one day after the designated
due date.
Pursuant to Section 12-14.1 (2) of the Code of the Miami-Dade County, Florida, "Any candidate failing
to file a report as required by this section on the designated due date shall be subject to a fine of$50
per day for the first three (3) days, thereafter, $500 per day for each day late not to exceed $5,000."
According to this formula, your late fine is $50 for the one day past the due date of November 1, 2013.
Such fine shall not be an allowable campaign expense and shall be paid only from the personal funds
of the candidate. Please make the check payable to the City of Miami Beach.
Any candidate may appeal or dispute the fine to the Miami-Dade County Commission on Ethics and
Public Trust based upon, but not limited to, unusual circumstances surrounding the failure to file on
the designated due date, and may request, and shall be entitled to, a hearing before the Commission
on Ethics and Public Trust, which shall be made within twenty (20) days after receipt of notice that
payment is due or such appeal or dispute shall be waived.
Additionally, we request that you amend page 2 of your report to complete the following sections:
Report Name; Cover Period; and Page Number(s).
