2001-24665 Reso -, RESOLUTION NO. 2001-24665 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ADOPTING THE CERTIFICATES OF THE RESULTS OF THE NOVEMBER 6, 2001 SPECIAL ELECTION FOR THE CITY OF MIAMI BEACH AND DECLARING RESULTS THEREOF. WHEREAS, as a result of action taken by the Miami Beach City Commission on September 20, 2001 authorizing composition of the City of Miami Beach Canvassing Board for the City's November 6,2001 Special Election, City Manager designee Mayra Diaz Buttacavoli, Clerk of the Miami-Dade Circuit and County Courts Harvey Ruvin, and Circuit Court Judge Rosa Rodriguez were designated to act as the City of Miami Beach Canvassing Board representatives regarding the conduct of the November 6, 2001 Special Election for the City of Miami Beach; and WHEREAS, City Manager designee Mayra Diaz Buttacavoli, Harvey Ruvin and Rosa Rodriguez acted as the commission representatives/Canvassing Board for the November 6, 2001 Special Election; and WHEREAS, the Certification of the results of the City of Miami Beach Special Election have been received and are attached hereto as Composite Exhibit "A" and are incorporated herein; and WHEREAS, said Certification reflects that: Question "A" as set forth below was approved by the electorate of the City of Miami Beachl; Question "B" as set forth below was approved by the electorate of the City of Miami Beach; Question "c" as set forth below was approved by the electorate of the City of Miami Beach; Question "D" as set forth below was approved by the electorate of the City of Miami Beach; and Question "E" as set forth below was rejected by the electorate of the City of Miami Beach. I The five ballot questions have been lettered "A"; "B"; "C"; "D"; and "E" for ease of reference herein only and were not so lettered on the ballot. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that having canvassed the returns of the November 6,2001 Special Election of the City of Miami Beach, it hereby adopts the certificates as to the results of said Special Election and it is hereby ordered that the Certificates of Election and this Resolution be recorded in the minutes of the meeting as a permanent record of the results of said election; and be it further resolved that as a result of the City of Miami Beach November 6,2001 Special Election, the votes upon the questions presented reflect the following results: Question "A": CLARIFYING/AMENDING CHARTER SECTION 1.03(c) REGARDING VOTER APPROVAL BEFORE INCREASING WATERFRONT PROPERTY'S FLOOR AREA RATIO SHALL CHARTER SECTION 1.03(c) BE: --CLARIFIED BY DELETING THE WORD "PLA TIED", TO CONFIRM ZONED FLOOR AREA RATIO OF ALL SPECIFIED WATERFRONT PROPERTY, EVEN IF UNPLATTED, MAY NOT BE INCREASED WITHOUT VOTER APPROVAL; AND --AMENDED TO STATE THAT COMMENCING JULY 18, 2001, THE APPLICABLE ZONED FLOOR AREA RATIO WHICH MAY NOT BE INCREASED WITHOUT VOTER APPROVAL IS CHANGED FROM FLOOR AREA RATIO EXISTING ON JUNE 4, 1997 TO FLOOR AREA RATIO EXISTING ON NOVEMBER 7, 2001? 7.329 or 75.47%YES 2.382 or 24. 53%NO 2 Question "B": AMENDING CITY'S RELATED SPECIAL ACTS. Agenda Item ff7C. 1700 Convention Center Drive -- Fourth Floor -- Miami Bel Date 1/- 7- (J I o STATE OF FLORIDA: COUNTY OF MIAMI-DADE: We, Harvey Ruvin, Clerk of the Miami-Dade Circuit and County Courts, Circuit Court Judge Rosa Rodriguez, and Mayra Diaz Buttacavoli, Assistant City Manager, City Manager's designee, acting as designees of the Miami Beach City Commission and serving as the City of Miami Beach Canvassing Board for the City of Miami Beach November 6, 2001 General and Special Elections, do hereby certify that we have made an examination of the returns of the General and Special Elections held in Miami Beach, Florida, on November 6, 2001, as conducted by the Clerks and Inspectors who were duly appointed by the Miami-Dade County Supervisor of Elections; and as reflected by certification received from the Supervisor of Elections of Miami-Dade County, Florida, such examination having been made solely, exclusively and entirely from such returns and certifications; and DO HEREBY CERTIFY that as a result of said examination we have found and DO HEREBY DECLARE the results of said election to be as follows: THAT there were a total of 13,039 votes cast.
