2014-28556 Reso RESOLUTION NO. 2014-28556 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING THE VACATION OF AN EXISTING 10 FOOT UTILITY EASEMENT AND ACCEPTING A 20 FOOT UTILITY EASEMENT FROM PALAU SUNSET HARBOR, LLC FOR THE CONSTRUCTION, INSTALLATION, MAINTENANCE, REPAIR, AND REPLACEMENT OF A CITY DRAINAGE OUTFALL PIPES. WHEREAS, Palau Sunset Harbor, LLC ("Palau") submitted a building permit application for review and comments regarding 1201, 1225, and 1237 20th Street; and WHEREAS, the plans identified an existing 10 foot utility easement, which conflicts with the proposed building design; and WHEREAS, Palau requests that the City vacate an existing 10 foot utility easement, located within their property and is the northerly portion of an existing 10 foot utility easement as described in the Official Record Book 19894, Page 1687, located on a portion of Lot 25 and 26, Block 15-A, Island View addition, according to the Plat thereof as recorded in Plat Book 9, Page 144, of the Public Records of Miami-Dade County, Florida; and WHEREAS, the new easement area that Palau will grant to the City will be 10 feet in width for 29 feet in length, and 20 feet in width for 73 feet in length for an area of approximately 1750 square feet, generally on the southerly and the westerly side of the Palau property; and WHEREAS, the new easement area provides the City with the ability to construct, install, inspect, operate, and maintain a drainage outfall pipe, utilities infrastructure, and all appurtenant facilities thereto, with the right to reconstruct, improve, change and remove all or any of the facilities within the Easement; and, WHEREAS, the Public Works Department has reviewed the drainage calculation and has no objection to vacating the existing easement and accepting the proposed easement. The existing stormwater drainage pipes would be rerouted by the City to maintain the discharge. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby approve the vacation of an existing 10 foot utility easement and accept a 20 foot utility easement from Palau Sunset Harbor, LLC for the construction, installation, maintenance, repair, and replacement of a City drainage outfall pipe, as described above, or in such other configuration as is determined acceptable by the City's Public Works Director and City Engineer. In exchange for this easement vacation, The Palau Sunset Harbour LLC will grant the City a new 20 foot drainage easement, for the construction, installation, maintenance, repair, and replacement of City drainage outfall pipes that will connect to the remaining easement that will stay in place. The Public Works Department has reviewed the drainage calculation and has no objection to vacate the existing easement and accepting the proposed easement. The existing stormwater drainage pipes would be rerouted by the City to maintain the discharge. Based on the revisions to the Stormwater Management Master Plan, injection wells will eventually need to be converted to direct discharges. Sunset Harbour Pump Station #3 has been redesigned and the result is a need for a gravity outfall and a force main outfall. An additional 10 foot stormwater easement is now required. The outfalls for the redesigned Sunset Harbour Pump Station #3 will be accommodated with the proposed 20 foot easement. THE ADMINISTRATION RECOMMENDS ADOPTING THE RESOLUTION.
