2014-28560 Reso RESOLUTION NO. 2014-28560 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, ACCEPTING THE RECOMMENDATION OF THE MAYOR'S BLUE RIBBON PANEL ON NORTH BEACH REVITALIZATION AND ESTABLISHING A NORTH BEACH SPECIAL EVENT INCENTIVE PROGRAM ("PROGRAM") DESIGNED TO ATTRACT AND ENCOURAGE EVENTS IN THE NORTH BEACH AREA OF THE CITY ESTABLISHING CRITERIA FOR THE PROGRAM, REQUIRING THE CITY ADMINISTRATION TO PROVIDE QUARTERLY WRITTEN UPDATES TO THE CITY COMMISSION, AND TO REVISIT THE PROGRAM EIGHTEEN (18) MONTHS FROM THE ADOPTION OF THIS RESOLUTION UNLESS OTHERWISE PROVIDED BY THE MAYOR AND CITY COMMISSION. WHEREAS, in January 2014, the City Administration began efforts to develop a North Beach Economic Development and Revitalization Strategy Plan; and WHEREAS, in March 2014, Mayor Philip Levine created the Mayor's Blue Ribbon Panel on North Beach Revitalization; and WHEREAS, the Mayor's Blue Ribbon Panel on North Beach Revitalization has met weekly and recommended that the City waive special event fees for events that take place in North Beach as a means to incentivize event producers to host events in the area; and WHEREAS, the Mayor's Blue Ribbon Panel on North Beach Revitalization believes hosting a wide variety of special events will enhance the offerings available for the local residents while also attracting visitors to the area; and WHEREAS, the following criteria have been developed for the waiver of special event fees in the North Beach area: 1. The City Manager shall be charged with the responsibility and authority to approve the waiver of any and all special event fees for events taking place within the following boundaries: the south side of 63rd Street on the south, the north side of 87th Terrace on the north, the west side of Bay Drive on the west, and the Atlantic Ocean on the east. 2. All persons or entities interested in conducting a special event must complete an application and meet all the requirements to obtain a permit as specified in Section 12-5 of the City Code and as more specifically set forth in the City's adopted Special Event Requirements and Guidelines. 3. The entity producing the event must be in good standing with the City and be current on all debts; and WHEREAS, upon satisfaction of the above criteria, the City Manager may waive any and all of the following Special Event Permit Fees: Application Fee, Permit Fee, Use of Public Property Fee, Concession Agreement Fee, Vehicle Access Fee, Park User Fees, Right-of-Way Permit Fees, Lightpost Banners Fees for lightposts in North Beach, Police Department Off-duty Administrative Fees, Fire Department Off-duty Administrative Fees, Parking Department i i I Administrative Fees, and may provide for a Special Event Parking Rate. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby accept the recommendation of the Mayor's Blue Ribbon Panel on North Beach Revitalization and hereby establish a North Beach Special Event Incentive Program as set forth herein which is designed to attract and encourage events in the North Beach area of the City, establishing criteria for the Program, requiring the City Administration to provide quarterly written updates to the City Commission, and to revisit the program eighteen (18) months from the adoption of this Resolution unless otherwise provided by the Mayor and City Commission. The Blue Ribbon Panel has met weekly and has begun to identify a number of items that could immediately help in the revitalization efforts. ADMINISTRATION RECOMMENDATION Adopt the Resolution. BACKGROUND In January 2014, the City Administration began efforts to develop a North Beach Economic Development and Revitalization Strategy Plan. The initial steps of the plan focus on gathering public input to serve as the foundation. To date, two general public input meetings have been held with approximately 130 attendees at each meeting. One additional meeting geared towards issues and obstacles' facing commercial property owners and business owners of the area was also held with strong attendance.Another general public input meeting will be held on April 22,2014,which will begin to fine tune the priorities for this plan and to work with the public in prioritizing concerns Economic Development staff is working to compile a master list of all of the concerns raised in the meetings and will be working with each department to ascertain issues/concerns that can be resolved immediately, those which require specific allocations through future budgets, and those that may require more time, coordination with other entities, or further study in order to resolve. The Economic Development staff is also working to undertake interviews with key stakeholders as identified by the Mayor and Commission as well as the Administration. The public has gotten behind our North Beach efforts and they remain quite engaged an involved which has led to the cultivation of some excellent input. Staff will strive to address the concerns and issues raised and to prepare a realistic and implementable plan for North Beach's future for presentation to the Commission during the summer months. North Beach Special Event Incentive Program City Commission Meeting April 23, 2014 Page 2of3 Criteria for Waiver of Special Event Permit Fees for North Beach Events The City Manager shall be charged with the responsibility and authority to approve waiver of of any and all special event fees for events taking place in North Beach, more specifically defined with boundaries on the south of 63rd Street, on the north of 87th Terrace,on the west at Bay Drive, and on the east at the Atlantic Ocean. All persons or entities interested in conducting a special event must still complete an application and meet all the requirements to obtain a permit as specified in Section 12-5 of the City Code and more specifically in the City's adopted Special Event Requirements and Guidelines. The entity producing the event must be in good standing with the City and be current on all debts. Recommended Special Event Permit Fee Waivers Application Fee—This fee is non-refundable and must be made payable to the City of Miami Beach at the time of application. $250 Permit Fee—This fee is refundable if application is denied and must be made payable to the City of Miami Beach at the time of application. $250/$500 Use of Public Property- permit holders are be charged a net square footage rate of$.25 per square foot,for public property occupied by the event for stages, booths, displays or areas restricted for exclusive use by the event. Concession Agreements—Unless the City charges the Use of Public Property Fee, all events which include retail sales or vending are be required to enter into a written concession agreement with the City. Beachfront and non-beachfront events shall provide 15% and 10% respectively of all gross revenues derived from admissions and the sale of food, beverages, and merchandise. Vehicle Access Policy—Certain events taking place on the beach, in parks or other authorized use areas may require vehicular access for the purposes of loading-in and out of equipment for the event, all such vehicles must be removed from such areas immediately thereafter. There is a vehicle access fee of$150.00, per vehicle, per event. A Vehicle Access Permit will be issued by the Special Events Office and must be displayed on the windshield of every vehicle on the beach Park User Fees-A special event impact fee is imposed for all events taking place at a City Park. This supplementary user fee will be calculated at the rate of twenty-five (25%) percent of the total cost of City services for the event. These funds will be used exclusively for enhancements to those parks utilized by said events. Right-of-Way Permit-- A Right-of-Way Permit must be obtained when there is anchoring to or excavation of any right-of-way or City property. The method of anchoring or location of any excavation may be denied or altered by the City based on potential hazards to existing utilities. The cost for such permit will be pursuant to City ordinances (concerning work on the right-of-ways) and may include a cash bond based on estimated potential damage to City property. Proof of financial ability to cover estimated damages must be submitted to the Special Events Office. For events occurring on City streets or sidewalks, an inspector from the Public Works Department will inspect the area in question prior to the event for any hazards, potholes or damaged fixtures. A visual inspection will take place following the event to identify any damage to City property caused by the event. Lightpost Banners -- Lightpost banners are permitted in the City when approved by the Planning Department and the City Manager for special events taking place in the City of Miami Beach,and by the City Commission,for special events held outside of the City of Miami Beach. A$50.00 per banner fee ($25.00 per banner fee if applicant is a 501(c)(3) or other equivalent non-profit organizations and verified by state records)and $50.00 processing fee will apply. Lightpost banners on State Roads(i.e. 5th Street, Collins Avenue,41 st Street, etc.)require an additional permit from the Florida Department of Transportation. The Administration recommends waiver of the Lightpost Banner fees for any event taking place in the target area and only for the banners located on poles within the target area. Police Department Off-duty Administrative Fee - Depending upon the type of special event and estimated attendance, security personnel, such as off-duty police personnel and private security personnel, may be required. The City charges an administrative fee of$10.00 per hour, per off-duty police officer. Fire Department Off-duty Administrative Fee - Depending upon the type of event and estimated attendance, off-duty or private fire rescue personnel may be required at the expense of the applicant. The City charges an administrative fee of$7.00 per hour, per off-duty firefighter. Parking Department Administrative Fee - The City of Miami Beach Parking Department has established administration fees ranging from $20.00 - $30.00 depending on the number of meters rented. Regular rates would be maintained. Recommended Parking Incentive Special Event Parking Rate —The City has a number of public parking lots north of 63rd Street. All metered parking in this area is enforced from 8:00 a.m. until 6:00 p.m., seven days per week at$1.00 per hour, with special event flat parking fees that range from $15 - $20. The Administration recommends no longer charging the Special Event Parking Rate for events in North Beach as an inducement to attract attendees. CONCLUSION The Administration recommends the Mayor and City Commission adopt the Resolution establishing North Beach Special Event Incentive Program, sunsetting the program three (3) years from the adopT'qn d unless otherwise extended by the Mayor and City Commission.
