A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE MAYOR
AND CITY CLERK TO EXECUTE CHANGE ORDER NO. 1 TO THE
AGREEMENT BETWEEN THE CITY AND LANZO CONSTRUCTION CO.,
DATED JUNE 19, 2013 (THE AGREEMENT), FOR ADDITIONAL
ENGINEERING SERVICES, DRAINAGE STRUCTURE MODIFICATION,
DRAINAGE PIPE, FENCING AROUND PUMP STATIONS, ELECTRICAL
COMPONENTS, AND PREPARATION OF SITE FOR STOCKPILING OF
MATERIALS FOR THE SUNSET HARBOUR PUMP STATIONS RETROFIT
AND DRAINAGE IMPROVEMENTS PROJECT; SAID CHANGE ORDER, IN
THE AMOUNT OF $315,123, PLUS A PROJECT CONTINGENCY IN THE
AMOUNT OF $231,358, FOR A TOTAL COST OF $546,481.
WHEREAS, Pursuant to Invitation to Bid No. 060-2013TC, and as approved at the May
8, 2013 City Commission meeting, the City entered into an agreement with Lanzo Construction
Co., dated as of June 19, 2013 (Agreement), in connection with the Sunset Harbour Pump
Stations Retrofit and Drainage Improvements Project, in the amount of $1,854,963.40, plus a
10% project contingency, for the total cost of$2,040,459.74; and
WHEREAS, as an initiative to continue infrastructure improvements throughout Sunset
Harbour, the Public Works Department requested an additional scope of work to the existing
Agreement (Change Order No. 1), consisting of the installation of additional drainage pipes for
direct storm water discharge to Biscayne Bay; existing drainage structure modifications; fencing
around Pump Stations No. 1 and No. 2; additional electrical components to raise control panels
to 2-feet above flood elevation at Pump Stations No. 1 and No. 2; preparation of site for
stockpiling of materials at Green Waste Facility; and additional engineering services; and
WHEREAS, the amount requested for Change Order No. 1 is $315,123, plus a total
project contingency in the amount of$231,358; for a total construction cost of$546,481.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, hereby approve and authorize the Mayor and City
Clerk to execute Change Order No. 1 to the Agreement between the City and Lanzo
Construction Co., dated June 19, 2013, for additional engineering services, drainage structure
modification, drainage pipe, fencing around pump stations, electrical components, and
preparation of site for stockpiling of materials for the Sunset Harbour Pump Stations Retrofit and
Drainage Improvements Project,-in the amount of $315,123 plus a total project contingency in
the amount of$231,358; for a total cost of$546,481.

Pursuant to Invitation to Bid (ITB) 060-2013TC for the Sunset Harbour Pump Station Retrofit and
Drainage Improvements Project, on May 8th, 2013, the City Commission authorized an award for
construction contract with Lanzo Construction Co. in the amount of $1,854,963.40. In addition, a base
project contingency in the amount of $185,496.34 totaling a construction cost of $2,040,459.74. The
project's scope of work includes drainage improvements within the Sunset Harbour Neighborhood,
consisting of new retrofit pumps, connections for direct discharge to Biscayne Bay, control panel
modifications at Pump Stations No. 1 and No. 2; and complete reconstruction of Pump Station No. 3,
including associated drainage pipes.
As an initiative to continue the infrastructure improvements throughout Sunset Harbour, the Public
Works Department has requested that Lanzo Construction Co. provide all necessary labor and
equipment for the installation of additional drainage pipes for direct storm water discharge to Biscayne
Bay, existing drainage structure modifications, fencing around Pump Stations No. 1 and No. 2,
additional electrical components to raise control panels to 2-feet above flood elevation at Pump Stations
No. 1 and No. 2, preparation of site for stockpiling of material at Green Waste Facility, as well as
additional engineering services. In addition, an October 1St, 2014 deadline has been added to the
contract, in order to ensure the completion of all pump station-related work by this date, making Lanzo .
Construction Co. liable for damages in the amount of$2,800 per day for non compliance.

BACKGROUND
Pursuant to Invitation to Bid (ITB) 060-2013TC for the Sunset Harbour Pump Station Retrofit
and Drainage Improvements Project, on May 8th, 2013, the City Commission authorized an
award for construction contract with Lanzo Construction Co. in the amount of$1,854,963.40. In
addition, a base project contingency in the amount of$185,496.34 totaling a construction cost of
$2,040,459.74. The project's scope of work includes drainage improvements within the Sunset
Harbour Neighborhood, consisting of new retrofit pumps, connections for direct discharge to
Biscayne Bay, control panel modifications at Pump Stations No. 1 and No. 2; and complete
reconstruction of Pump Station No. 3, including associated drainage pipes.

COST ANALYSIS
Lanzo Construction Co. has submitted a cost proposal in the amount of $315,123 (Attachment)
for additional drainage pipes for direct storm water discharge to Biscayne Bay, existing drainage
structure modifications, additional electrical components to raise control panels to 2-feet above
flood elevation at Pump Stations No. 1 and No. 2, preparation of site for stockpiling of material
at Green Waste Facility, as well as additional engineering services.
This cost proposal has been submitted to the City's Public Works Department for further review
and recommendation. City staff reviewed the proposal and found that the amount was fair and
reasonable.
CONCLUSION
The Administration recommends adopting the Resolution

With this proposal we request a thirty(30)day contract acceleration cost and extension in the amount of$ 1,400.00
per day for a total of$42,000.00, as seen on item(18)of the attached schedule of values. This item is to be paid in
five equal amounts of$8,400.00 from May to September 2014.
Lanzo understands that the Pumps, outfalls and Tide Flex Valves for Pump Stations 1, 2 & 3 must be functional as
well as the Tide Flex valves on Dade Blvd by October 15`, 2014 or there will be Liquidated Damages in the amount of
$2,800.00 per day until these items are substantially completed.
These thirty days contract extension will extend the contract Substantial Completion date to October 31", 2014 and
the Final Completion date to November 30th, 2014, while having a Milestone completion for Pump Stations 1, 2 & 3
items for October 151, 2014, as stipulated above. For concurrent delay for the Milestone and the Substantial
Completion, the greater amount of the applicable Liquidated Damages will apply. Nothing contained here allows for
additive Liquidated Damages.
