90-20000 Reso RESOLUTION NO. 90-20000 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, PURSUANT TO ORDINANCE NO. 90-2690, CREATING A RESIDENTIAL PARKING PERMIT AREA IN THE AREA BOUNDED ON THE SOUTH BY THE CENTERLINE OF FIFTH STREET, ON THE NORTH BY THE NORTHERLY RIGHT-OF-WAY LINE OF FIFTEENTH STREET, ON THE WEST EY THE CENTERLINE OF COLLINS AVENUE AND ON THE EAST BY THE EASTERLY RIGHT-OF-WAY LINE OF OCEAN DRIVE, TO BE REFERRED TO AS "RESIDENTIAL PARKING PERMIT AREA # 1/1. WHEREAS, the City Commission of the City of Miami Beach has enacted Ordinance No. 90-2690, authorizing the creation of residential parking permit areas in the City of Miami Beach; and WHEREAS, the City Manager has determined that the area bounded on the South by the centerline of Fifth Street, on the North by the northerly right-of-way line of Fifteenth Street, on the West by the centerline of Collins Avenue and on the East by the easterly right- of-way line of Ocean Drive is impacted by commuter vehicles; and WHEREAS, residents of the above described area have been provided notice of a public hearing in accordance with the requirements of Ordinance No. 90-2690; and WHEREAS, the affected residents have had the opportunity to express their concerns and considerations at a public hearing as prescribed by Ordinance No. 90-2690. NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, as follows: 1. A residential parking permit area is hereby created in the area bounded on the South by the centerline of Fifth Street, on the North by the northerly right-of-way line of Fifteenth Street, on the West by the centerline of Collins Avenue and on the East by the easterly right-of-way line of Ocean Drive, to be referred to as "Residential Parking Permit Area # i". 2. The City Manager is authorized to implement a residential parking permit program in Residential Parking Permit Area # 1 as 1 a test area only for a period of six months, after which period an evaluation of the program will determine its continuation. 3. The City Manager is authorized and directed to create a residential parking permit for Residential Parking Permit Area # 1 which will allow permitted vehicles to- be parked in the following areas only: (a) at any available municipal metered parking space within Residential Parking Permit Area # 1, (b) at any available municipal attended parking space at the fourth (4th) level and above of Parking Garage # 17A at 13th Street and Collins Avenue, and (c) at any available space in the specific "Residential Parking Permit- Only" locations in Residential Parking Permit Area # 1, as shown on Exhibit "A" attached hereto and by reference made a part hereof, during the following hours: - From 6:00 P.M. to 8:00 A.M. , Monday through Friday. - Twenty-four hours a day on Saturdays, Sundays and holidays. 4. The permit for Residential Parking Permit Area # 1, shall not be honored at any municipal parking facility (on-street, off- street, metered or attended) outside of Residential Parking Permit Area # 1. 5. The cost for the permit for Residential Parking Permit Area # 1 is hereby established in the amount of $75. 00 per vehicle for the six month trial period. On March 21, 1990, . the City Commission adopted Ordinance No. 90-2690 which authorized the creation of a residential parking program in the City of Miami Beach. Accordingly, the first test area was recommended to be between Fifth and Fifteenth Streets and Ocean Drive and Collins Avenue (east side) . In accordance with the guidelines set forth in the enabling legislation, the City Commission adopted Resolution No. 90-19985, scheduling a public hearing for the purpose of obtaining public input from residents of the affected area and establishing a fee schedule for .the permits. The attached resolution delineates the specific target area of Residential Parking Program (RPP) Phase I (Fifth to Fifteenth Streets, Ocean Drive to Collins (east) Avenue respectively) . The resolution also authorizes the City Manager to implement this program for a six-month period followed by an evaluation of the program to determine its continuation. The resolution also establishes the cost of the six month permit at $75.00. The RPP Permit would not be honored outside of the target zone. It would, in effect, be over. and above all other permits sold by the Parking Department. ADMINISTRATION RECOMMENDATION: The Administration recommends that the City Commission of the City of Miami Beach adopt the attached resolution which authorizes the City Manager to implement a six-month residential parking program as defined with an evaluation to be completed at the close of the specified six-month period.
