Amendment (Resolution):
1. Motion made by Commissioner Diaz to move the item with an amendment giving the City
Manager the discretion to obtain an additional lobbyist at the state or federal level to do so at
$25,000 per lobbyist
2. Commissioner Gross amended the motion and increased the Manager's spending authority
to $50,000 per lobbyists, Commissioner Diaz accepted the amendment.

Amendment Federal Legislative Agenda:
Add to the legislative priorities for the state/federal to monitor, report and advocate for full
finding of budget allocations which fund social services programs which our Miami Beach
organizations currently rely on to provide services to our residents.
End
Commissioner Tobin stated that he separated the item because he met with the City's Federal
lobbyist and because there is a new federal administration and a trillion dollar stimulus package
asked that in addition to the City's current lobbyist, should the Commission consider retaining
an additional lobbyists to lobby on the specific issue of the money in the federal economic
stimulus package.
Commissioner Diaz stated that perhaps the City should be lobbying at the state level.
Commissioner Tobin suggested reaching out to those members of the community who
contributed large sums of money to the Obama campaign to try to get them to help the City get
some of the economic stimulus money.

Manager the discretion to obtain an additional lobbyist at the state or federal level to do so at
$25,000 per lobbyist; seconded by Commissioner Tobin; Voice vote: 7-0.
Commissioner Tobin requested to have the Administration check what other cities are doing in
hiring special lobbyists specifically for the economic stimulus package. He suggested calling
the City Manager in Key West. Kevin Crowder to handle.
Commissioner Gross amended the motion and increased the Manager's spending authority to
$50,000 per lobbyists, Commissioner Diaz accepted the amendment.

Each year, the Mayor and City Commission adopt the City's legislative priorities that will be
pursued by the City's representatives in Washington D.C. during the annual Congressional
Session. The attached list of priorities was developed by the Administration in consultation
with the City's lobbyists, and by meetings held on December 22-23, 2008 between the Mayor
and each Commissioner and the City's lobbyists.
The recommended 2009/10 agenda includes legislative and funding requests, including
infrastructure, beach renourishment, housing,and transportation.The agenda also includes the
City's priorities for economic stimulus and transportation re-authorization legislation

ADMINISTRATION RECOMMENDATION
Adopt the Resolution.
ANALYSIS
Each year,the Mayor and City Commission adopt the City's funding and legislative priorities
that will be pursued by the City's representatives in Washington D.C. during the annual
Congressional session.
The proposed priorities include appropriation, authorization, and legislative requests that
were developed through discussions between the Administration, the Mayor and City
Commission, and the City's federal lobbyists.
The City has been very successful in securing appropriations for City projects in the past few
years, most notably in the areas of beach renourishment and transportation. The City has
had some success with funding for historic preservation and infrastructure improvements,
although competition for this funding has grown significantly.
Generally, there are a number of areas that are 'earmarked' by Congress each year during
the appropriations process, and the City has identified a priority funding project for each of
these areas. Unfortunately, some of these areas will most likely be included in the same
appropriations bill. At best, the City can realistically expect to have only one project funded
per appropriations bill; it is also extremely unlikely that the City would receive an
appropriation in every bill in which one is requested.
This year, the City's Federal Legislative Agenda includes four(4) categories:
• Completion of FY 2008/08 Appropriations
• FY 2009/10 Appropriation Agenda
• Transportation Reauthorization
• Economic Stimulus Legislation

FY2008/09 APPROPRIATION REQUESTS
At the end of Federal Fiscal Year on September 30,2008, Congress had completed action
on only three of the twelve annual appropriations bills: Homeland Security, Defense, and
Military Construction. The City received an earmark in the amount of $1,000,000 for the
City's erabili s Intero /Communication/EOC Initiative from the Homeland Security
ty
Appropriations Bill.
The areas funded by the nine remaining appropriations bills are currently operating under a
Continuing Resolution. It is expected that Congress will consider and approve a final
omnibus appropriations bill in February. During the development of these bills during 2008,
the City had a$200,000 earmark for the After School Program included in the House version
of the Justice Appropriations Bill, and an earmark for an unknown amount in the
Transportation Bill for the Atlantic Greenway. As Congress considers final approval of FY
2008/09 spending, the City will continue to pursue these and any other potential
appropriations.
FY2009/10 APPROPRIATION REQUESTS
On January 22-23, 2009, the Mayor and each Commissioner met with the City's federal
lobbyists to discuss the City's priorities for the upcoming Congressional session. The
proposed Federal Legislative Agenda for FY2009/10 is as follows:

Miami Beach Sustainability Initiative Energy and Water $2,000,000
The City further supports:
• Full funding of the Erosion Control Projects, based on the funding needs of the Army
corps of Engineers;
• Miami-Dade County's request for Beach Renourishment Funding;
• Miami-Dade County's request for Venetian Causeway Funding;
• Full Funding of the Energy Efficiency Block Grant Program, CDBG, Home, Urban
Area Security Initiative, Hazard Mitigation Grant Program, and the Pre-Disaster
Mitigation Grant Program.

ECONOMIC STIMULUS LEGISLATION
On January 15, 2009, the House's Committee on Appropriations and the Committee on
Ways and Means released summaries of the American Recovery and Reinvestment bill of
2009. A list of infrastructure projects that may be eligible for funding is included as
Attachment 'B'. This list was developed following review of current financing needs for
projects approved in the 2008/09 Capital Budget,and narrowed down to those projects with
short-term development timelines that will produce long-term benefits; have identifiable
eligible funding streams via existing federal and state programs; and have the potential for
job creation.
The attachment includes estimates of the number of jobs supported by each project.These
estimates are based on an average of 20,000 fobs being supported by each $1 billion of
infrastructure spending. During the current debate regarding stimulus legislation,the range
of estimate has been between 25,000 and 45,000 jobs per billion dollars spent. These
figures are only provided based on requests from various outside organizations such as the
US Conference of Mayors; job figures are only estimates and are subject to a significant
margin of error.
To date, the Administration has discussed the City's needs with the City's Congressional
delegation, Members of the Florida Senate and House of Representatives, and staff from
the Governor's Office of Policy and Budget. The projects have been identified by type, as
well as the time frame in which they can be "shovel ready'.
• The Administration has identified 13 capital projects in the Capital Budget that, if full
funding was available,would start construction within 90 days.Construction of these
projects would contribute $66 million into the economy.
• The Administration has also identified 14 capital projects that, if full funding was
available,would start construction in between 90-180 days, providing an additional
$186 million to the local economy.
• The Administration has also identified$30 million of spending on additional projects
that could start before the end of 2009, and another $186 million that would be
"shovel in the ground" in 2010.
CONCLUSION
The Administration recommends that the Mayor and City Commission review the proposed
legislative agenda, establish the priorities and adopt the attached Resolution.

WHEREAS, the City must avail itself of all potential sources of funds; and
WHEREAS, Federal legislation may need to be enacted to protect and enhance the City's
interests; and
WHEREAS,action of Federal executive agencies maybe necessaryforthe same purposes;
and
WHEREAS,it is imperative that the City's legislative consultant is aware of,and has a list of,
City priorities; and
WHEREAS,the Administration has prioritized funding needs and identified potential funding
sources; and
WHEREAS,the City's numerous Federal-level needs have been assessed and prioritized to
produce the most effective use of its legislative team; and
WHEREAS, in addition to the annual appropriations bills,the U.S. Congress is considering
economic stimulus legislation, also known as"The American Recovery and Reinvestment Act", to
provide infrastructure funding to state and local governments; and
WHEREAS,the Administration has prepared a list of infrastructure projects that may qualify
for federal economic stimulus funding; and
WHEREAS, since the specific details on how federal economic stimulus funding will be
distributed have not yet been released, additional City initiatives may qualify for federal funding.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA,that the recommended Federal Legislative Priorities for
Fiscal Year 2009/10 Federal Governmental Agenda be approved, as more specifically set forth in
the attached Exhibit A; further directing the Administration to continue to monitor all developments
related to economic stimulus legislation and make the appropriate adjustments to the list of
economic stimulus infrastructure projects, more specifically set forth in the attached Exhibit B.

A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, URGING THE
FEDERAL GOVERNMENT TO OFFER LOW INTEREST LOANS
TO MUNICIPALITIES FOR INFRASTRUCTURE PROJECTS;
URGING THE UNITED STATES CONGRESS AND THE
FLORIDA LEGISLATURE TO ENSURE THAT LOCAL
GOVERNMENTS WITH `READY TO BUILD'
INFRASTRUCTURE PROJECTS RECEIVE FUNDING
ASSISTANCE FROM FEDERAL ECONOMIC STIMULUS
LEGISLATION THAT PROVIDES INFRASTRUCTURE
FUNDING; FURTHER DIRECTING THE ADMINISTRATION TO
PRESENT A LIST OF `READY TO BUILD' INFRASTRUCTURE
PROJECTS TO THE CITY'S CONGRESSIONAL AND STATE
REPRESENTATIVES.
WHEREAS, state and local government spending is a key component of Gross
Domestic Product; and
WHEREAS, due to the difficult economic times that currently exist and the lack of
access to, or the high cost associated with, the municipal bond market, much needed
infrastructure projects are being postponed by local governments; and
WHEREAS, the Federal government, through the Department of the Treasury, along
with the Federal Reserve, have provided assistance to certain economic sectors during 2008;
and
WHEREAS, the United States Congress has recently approved legislation providing
financial assistance to certain sectors of the U.S. economy; and
WHEREAS, the City has numerous `Ready to Build' capital improvement infrastructure
projects for which construction can begin within 90 and 180 days; and
WHEREAS, the United States Congress is debating economic stimulus legislation that
may include funding support for local government infrastructure projects; and
WHEREAS, in order to provide necessary public services for local communities, low
interest and long term financing by the Federal government would provide an affordable
opportunity for communities to improve their clean water infrastructure, sewage treatment
facilities, municipal roads and bridges, public transit, and waste management facilities; and
WHEREAS, the provision of low interest, long term loans by the Federal government
would provide an innovative financing tool to be used by local governments to renew and build
critical public infrastructure assets which will not only provide necessary services, but will
enhance the quality of life for citizens and offer economic stimulus through the creation of
employment opportunities for such projects.
NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Federal government is
hereby urged to offer low interest, long term loans to municipalities for infrastructure
improvements and projects; that Congress and the Florida Legislature are urged to ensure that
local governments with 'Ready to Build' infrastructure projects receive funding assistance from
federal economic stimulus legislation; and further directing the Administration to present a list of
'Ready to Build' infrastructure projects to the City's Congressional and State representatives.
