2014-28878 ResoRESOLUTION NO, 2014-28878 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA ACCEPTING THE RECOMMENDATIONS OF THE FINANCE AND CITYWIDE PROJECTS COMMITTEE AT ITS NOVEMBER 12, 2014 MEETING, AND AUTHORIZE THE CITY ADMINISTRATION TO PROCEED WITH THE REVISED CONCEPTUAL MASTER DESIGN PLAN FOR IMPROVEMENTS TO NORTH SHORE OPEN SPACE PARK (THE PROJECT), WITH THE DESIGN AND CONSTRUCTION AMOUNT OF SUCH PROJECT NOT TO EXCEED $6.69 MILLION, AND FURTHER TO EXPLORE THE PROCUREMENT OF A CONCESSIONAIRE TO OPERATE A RESTAURANT IN NORTH SHORE OPEN SPACE PARK. WHEREAS, the City holds a right-of-way ("ROW') dedication to a 50 foot wide road, running east of Collins Avenue, known as 87th Terrace; and WHEREAS, on September 17, 2014, the City Commission approved Resolution No. 2014-28743, which authorized the vacation of that certain City ROW currently known as 87th Terrace, east of Collins Avenue, in favor of 8701 Collins Development, LLC ("8701"); and WHEREAS, in connection with the aforestated vacation, 8701 agreed to make a voluntary contribution to the City in the amount of $10.5 million; and WHEREAS, on September 24, 2014, the Finance and Citywide Projects Committee (FCWPC) discussed the appropriate public use for the $10.5 million voluntary contribution by 8701 and recommended that the City utilize the funds in North Beach for projects that would benefit the community in that area; and WHEREAS, on November 19, 2014, the City Commission adopted Resolution No. 2014-28839, approving, on second and final reading, a Development Agreement between the City and 8701, which among other things, memorialized the conditions for vacating the City's ROW, including the payment terms and schedule for payment by 8701 to the City of the $10.5 million voluntary contribution; granted the City a perpetual pedestrian access easement across a portion of the vacated City ROW; and provided for a crosswalk on Collins Avenue at 8701's expense; and WHEREAS, on November 19, 2014, the City also adopted Resolution No. 2014-28839 which provided for allocation of the voluntary contribution, and provided that fifty percent (50%) of such contribution (or $5.25 million) be allocated toward the design, construction, and thereafter, maintenance of the proposed improvements to North Shore Open Space Park (the Project); and WHEREAS, the initial conceptual master plan for North Shore Open Space Park was designed by the City's project design consultant, West 8; and WHEREAS, based on the initial design, the estimated cost for the Project is approximately $10 million and includes: • Circulation and Lighting — an expanded path network, new lighting and an extension of the Beachwalk; • Planting — revitalized lawns, tree pruning, removal of invasive plants, and a diversified native plant palette; • Program Enhancements — new concessions, restrooms and shade structures; • Fencing and Gateways — new perimeter fence, four iconic park gateways and park signage; and WHEREAS, the City met with West 8 and adjusted the Project scope in order to reduce the Project budget; the revised conceptual master design plan includes: • Circulation and Lighting — Reduce lighting by 15%; • Planting — Reduce trees by 25%; • Program Enhancements — Eliminate the Park Hub; • Fencing and Gateways — Eliminate new perimeter fence; and WHEREAS, on November 12, 2014, the City Administration provided the FCWPC with a presentation on the conceptual design plans for the Park and, after being presented with both design options, the FCWPC recommended that the full City Commission approve the revised conceptual master design plan, with a resulting Project cost of approximately $6.69 million; and WHEREAS, the FCWPC also recommended that the Parks and Recreation Department work with the Procurement Department in order to explore the procurement of a concessionaire to operate a restaurant in the Park that could help defray the annual maintenance costs of the Park. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby accept the recommendations of the Finance and Citywide Projects Committee at its November 12, 2014 meeting, and authorize the City Administration to proceed with the revised conceptual master design plan for improvements to North Shore Open Space Park, with the design and construction amount of such Project not to exceed $6.69 million, and further to explore the procurement of a concessionaire to operate a restaurant in North Shore Open Space Park. As part of Resolution 2014-28743, 8701 agreed to a term sheet, which shall be turned into a Development Agreement with the City, which would provide the City with a $10.5 million voluntary contribution. On September 24, 2014, the Finance and Citywide Projects Committee discussed the appropriate public use for the $10.5 million dollar voluntary contribution and believed it to be in the best interest of the City to utilize the funds in North Beach, for projects that would benefit the community in that area. The FCWPC unanimously recommended that the entire $10.5 million dollar voluntary contribution be utilized in North Beach, north of 69th Street and further recommended that half of the voluntary contribution be utilized to repair and renovate the North Beach Open Space Park; with a portion of those funds to be set aside as an endowment fund to ensure that the capital costs associated with the future "renewal and replacement" maintenance needs of the Park are maintained without causing an increase in the millage rate to support the Park. On October 22, 2014, the City Commission adopted Resolution No. 2014-28814 accepting the recommendations of the FCWPC. On November 12, 2014, the Administration presented the FCWPC with the initial design plan of approximately $10 million and a revised design plan of approximately $6.69 million. After a lengthy discussion, the Committee unanimously recommended that the entire $10.5 million dollar voluntary contribution be utilized in North Beach, north of 69th Street. The Committee further recommended that half of the voluntary contribution be utilized to repair and renovate the North Beach Open Space Park; with a portion of those funds to be set aside as an endowment fund to ensure that the capital costs associated with the future "renewal and replacement" maintenance needs of the Park are maintained without causing an increase in the millage rate to support the Park.
