2014-28880 ResoRESOLUTION NO. 2014-28880 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, THAT THE MAYOR AND CITY COMMISSION HEREBY ACCEPT THE RECOMMENDATION OF THE LAND USE AND DEVELOPMENT COMMITTEE TO ALLOW A FAENA DESIGN TO THE BEACHWALK ALONG THE FAENA DISTRICT, AND A 100 FOOT TRANSITION AREA NORTH AND SOUTH OF THE FAENA DISTRICT; AND SHALL REQUIRE FAENA TO BE RESPONSIBLE FOR THE DESIGN, CONSTRUCTION, AND MAINTENANCE OF THE FAENA PORTION OF THE BEACHWALK AND THE RIGHTS-OF-WAY WITHIN THE FAENA DISTRICT, AS REFLECTED IN THE FAENA BEACHWALK PLAN ATTACHED EXHIBIT 1. WHEREAS, on April 13, 2011, the 2025 Miami Beach Comprehensive Plan was adopted by the City Commission and became effective July 1, 2011; and WHEREAS, pursuant to the policy adopted by the City Commission as part of the 2025 Miami Beach Comprehensive Plan, the Administration has continued to implement the beachwalk and baywalk projects in order to further the City's vision of a continuous on -grade recreational paths running north/south along the coast linking the City's South, Middle, and North Beach Neighborhoods; and WHEREAS, on October 17, 2007, the Miami Beach City Commission adopted the Atlantic Greenway Network (AGN) Master Plan also known as the Bike Master Plan; and WHEREAS, the 2007 AGN Master Plan focused on creating an interconnected network of bicycle and pedestrian facilities by way of on -street bicycle facilities, shared -paths, Beachwalks, Baywalks, and establishing connections between the City network and the County's and State's regional bicycle network; and WHEREAS, the City's Beachfront Management Plan with the State of Florida also lists the development of the AGN as a management activity that enhances the natural resource value and/or public recreation value for which the lands were acquired; and WHEREAS, the beachwalk is an on -grade, ADA accessible pathway that supports bicycle use and other recreational and non -motorized transportation activities that are in line with the goals of the AGN; and WHEREAS, the existing boardwalk is not part of the AGN because its current width does not allow for safe bicycle and pedestrian shared use; and WHEREAS, as part of the development review process, the City has accepted voluntary proffers from a number of upland properties that are adjacent to the boardwalk to assist in the development of segments of a public beachwalk; and WHEREAS, on May 20, 2013, the City Commission directed the Administration to keep the boardwalk from 24 Street to 29 Street; and WHEREAS, Miami Beach Drive promenade runs just east of Collins Avenue and west of the boardwalk between 24 Street and 29 Street, which allows for a smooth transition of bicyclists to the promenade while still retaining a segment of boardwalk; and WHEREAS, at its April 9, 2014 meeting, the Land Use and Development Committee recommended to remove the boardwalk and replace it with a paver pathway to maintain the design consistency and uniformity of the beachwalk system; and WHEREAS, on May 21, 2014, the City Commission approved the removal of the boardwalk and replace it with a paver pathway, with the exception of the boardwalk between 24 Street through - 29 Street, to maintain design consistency and uniformity of the beachwalk system; and WHEREAS, the City is currently designing the remainder of its beachwalk system, and Mr. Faena, the developer of the Faena Districts, and owner of Tower 3314 LLC and 3201 Hotel LLC, [hereinafter Faena] have created a unique design for the beachwalk and rights-of- way along the Faena District located within the following district boundaries: lying East of Collins Avenue between 32nd Street and 35th Street (excluding the property presently zoned GU); and lying West of Collins Avenue between 33rd Street and 35th Street (excluding Lots 14-17, Block 22 of the Ocean Front Property of the Miami Beach Improvement Co. Subdivision); and lying at the Northwest corner of Collins Avenue and 35th Street (Lots 10, 11 and 15, Block 24 of the Ocean Front Property of the Miami Beach Improvement Co. Subdivision); and WHEREAS, the Land Use and Development Committee recommended an action item to the City Commission to approve incorporating the Faena design into the beachwalk; and WHEREAS, the City and Faena agree that the beachwalk design for the Faena District will be in substantial form to the attached proposed plan, including a transition area at least 100 feet north and south of the start of the Faena District beachwalk area, and which plan is attached and incorporated by reference herein as Exhibit 1; and WHEREAS, Faena will be responsible for the construction, installation and perpetual maintenance of the Faena design as proposed in Exhibit 1. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND. CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby accept the recommendation of the Land Use and Development Committee to allow a Faena design to the beachwalk along the Faena district, and a 100 foot transition area north and south of the Faena district; and shall require Faena to be responsible for the design, construction, and maintenance of the Faena portion of the beachwalk and the rights-of-way within the Faena District, as reflected in the Faena beachwalk plan attached Exhibit 1. BACKGROUND On November 19, 2014, the City Commission discussed a potential Resolution in support of a Faena District Beach -Walk and Streetscape Plan (item R9M). The Commission requested that a formal Resolution be brought back to the December 17, 2014 Commission Meeting. The Faena Hotel Group is proposing an alternative beach -walk pavement for the Faena District, including a design scheme and materials that deviates from the standard beach - walk. Although the material and the design would be different, the location of the beach - walk would remain the same. THE PROPOSAL The owner and developer of the new FAENA Hotel project on Collins Avenue between 32nd and 35th Streets has acquired a number of adjacent parcels, with frontage along both sides of Collins Avenue and a smaller more limited frontage on Indian Creek Drive. The City is currently designing the remainder of its beach -walk system, and the Faena group has created a unique design for the beach -walk and rights-of-way within the Faena District (see attached overlay map). Commission Memorandum Faena District Beachwalk Resolution December 17, 2014 Page 2 of 3 ANALYSIS The subject Resolution authorizes a different design for the beach -walk within the Faena District, including a 100 foot transition area north and south of the Faena District. The Resolution also requires the Faena Group to be responsible for the design, construction, and maintenance of the Faena portion of the beach -walk and the rights-of-way within the Faena District, as reflected in the Faena beach -walk plan attached. The Administration would also recommend that the approval /of the Resolution authorizing the proposed new design concept include a provision requiring that the Faena Group bear the entire cost of its portion of the beach -walk. This would be in addition to the amount that they agreed to cover in the initial beach -walk agreement entered into a few years ago. Since a significantly different design and material palette is proposed, as part of an overlay district unique to the Faena properties, the Administration believes that the increased cost should be borne by the developer. CONCLUSION The Administration recommends that the City Commission adopt the Resolution, inclusive of an additional provision requiring that the Faena Group bear the entire cost of its portion of the beach -walk.
